Say you're a mixed-race couple; one works as a cashier in a store, and the spouse comes in. The cashier spouse refuses to serve the other, saying, 'I don't serve Asians, no Asians allowed; I hate Asians' or something like that. You get that on video, sue for discrimination. In this case, you'd be suing the store where the cashier spouse works, rather than an insurance company, but it's probably the same. Let's run with it. Even if there's no secret that you're a couple, I'm _still_ not sure what the company's lawyers can argue exactly, legally speaking. The act of racial discrimination still really did happen. And it's still illegal. And the store is still legally liable. I'm not a lawyer, though; Idk how that works. But this seems like a 'limit case' for discrimination law-suits that may not have been tested. Since it's legal in America to _be racist,_ that means the white employee is not legally culpable for anything, to anybody. But it's not legal for a company to _discriminate_ based on race. So the _store is_ liable if the _employee_ discriminates based on race. In theory it should work with insurance too, but most insurance is to cover actual damage to property, and the damage has to actually happen. You could have, for example, angry girlfriend burn down boyfriend's house, so he can collect the insurance. But this is not effective because: 1) damaging the property is illegal, the person who does it is liable, and thus the girlfriend gets into real trouble. And 2) the house is gone. You lose actual value, approximately in proportion to the value gained from the insurance. So there's no build-in net gain anyway. By contrast, if an employee is racist, this is illegal, but the _store,_ not the employee is legally culpable, for some reason. That's huge. So the one doing it can't really get in trouble. And second, there's no real loss of value incurred by the victim, no house burning required. Thus, if the employee and the victim are working together, there's no culpability _and_ no loss of property/value for the team; only the employer gets shafted. Normally, when a law suit is made, the prosecution has to demonstrate that actual harm has been caused. But, because the nation is very sensitive about race, I think the 'harm' clause doesn't really apply in racial discrimination cases. Demonstration of the discrimination itself is probably sufficient. For example, the store _can't_ just say, well the black person wasn't substantively harmed, because there were other stores he could go to that sell the same products. That's _not_ going to work in a racism case. So there is conjunction of two legal fictions that would allow this to happen. One is that we hold the company culpable for what the employee does, though the company can't control what the employee does until after the fact(by firing.) And the second is that we allow suits, which are for compensation against incurred harm, in this narrow area, _without_ the need for the victim to demonstrate incurred harm. A _presumption_ of something like vague moral or emotional harm, 'lived experience' harm has to be sufficient in such cases - something unverifiable. I'm 99% certain nobody will read this. Just working out my thoughts in text.
