@Mad Planet it's called the English rule in lawsuits. Was in place during Thatcher. Everything else about England is shitty nowadays but they got that one right awhile ago.
Nearly every Western democracy other than the United States follows the English rule. Our liberal lawyers in the US is what keeps it from happening here, abulance chasing skirt chasing John Roberts, clintons etc built their career on frivolous lawsuits.
How about defendant just rock up the defence legal fees with 1000 usd/ hour , so they can deter all the helpless victims can't speak up or sue them. That is not a perfect solution for this problem. If they going to make plaintiff lawyer pay a percentage of losing legal fee, they could probably think twice about taking on ridiculous cases.
I was an FF/EMT. I use to get frustrated having to “rescue” stupid people who texted or talked on their cell phones while driving. I once had to testify in court on why we, myself and another EMT, hadn’t transported a patient in an accident sooner. We were trying to stabilize the patient before transport with two sets of hands instead of one in the ambulance. We were being sued because the patient wasn’t satisfied we’d done enough at the time. The patients attorney asked me on the stand if I didn’t have a moral, as well as professional obligation, to do the best for the patient. I said, “ no more than the patient had to not be texting while driving which was why he’d been in the accident to begin with”, the attorney immediately wanted my statement stricken from the record and the jury to told to ignore my response. Surprisingly the judge didn’t do it. This was a lesson to me about frivolous law suits. Now I’m retired and I don’t stop for accidents involving stupid people unwilling to do their best behind the wheel, I got tired of rescuing “stupid”.
I'll tell you a little story. I'm originally from small-town Pennsylvania. Back in the late 1980s I was traveling with my dad going to various places and we would stop at diners and talk with people while we were in between locations. Often, these were the owners of those diners. At this time any of them were facing severe economic hardship. I saw a good many of these very places shuttered not long after. You see, there were lawyers from New York who would come to Pennsylvania, and stop purposely at these diners. At some point, they would go into the restroom with a tape measure, and examine everything in that restroom. You see, they had copies of the state statutes regarding safety, and federal statutes regarding safety, so they looked for violations. A week or so later the attorney would come back to these diners with papers. These papers were in the form of legal complaints. They would tell the owners they were in violation because of log X Y and Z and would be liable for fines in this amount that amount and the other amount. They were all ready to file these papers, which would shut these restaurants down. Unless... For a fee like $3,000 or $4,000, the same attorneys could be placed on retainer to protect them from such complaints until they should actually have things rebuilt to compliance with safety codes. Faced with this (which, as you can see, was actually nothing more than extortion), they would have to pay the attorneys for really nothing more than being scammed-- on top of additional cost that they would incur for all this construction work. many of these cases were because they were informed they had to have equal access handicapped ramps-- which would eat up sidewalk and parking space. As I said, I saw many of these places shuttered very soon thereafter. That is how attourneys have caused a great many small town places to shut down across the state and even the country. Fast forward to 1998, when I go to New York City. The hometown where all these vultures operate from had terrible access to the subways, which were often the only practical means with which to get about. access to most of these stations was still about what you would find back in 1910-- and much of the construction was nearly as old as that, and crumbling. ... it turns out the MTA had hired the really big guns to represent them through which they managed to work out a deal. People who would need handicapped access were not given handicapped access but instead were permitted to use something called Access-A-Ride. a car would be sent to pick up the customer and take them to where they needed to go. Sounds good, right? Not so fast. In practice, One driver would go around and pick up five different people. one would think they would pick up people all going to the same general destination, say Somewhere in Brooklyn. Having spoken at length with people who I worked with who use these access-a-rides, it became evident that they would set up a schedule in which the driver would pick up people from widely scattered destinations, then take their time going on what would look like the most circuitous route. You see, all the MTA was required to do was to provide A ride, - -NOT necessarily the BEST ride on the BEST route. MANY times, this would lead to missed appointments-- which would often have to be reset, only to be missed again because of the driver. ....as you may imagine, very few people take advantage of acces-a-ride. I'm sure some lawyer gave them advice on how to make this happen. So yes, this is exactly why we hate lawyers AND New Yorkers.
Simple solution is to have plaintiffs pay defense's legal fees if they lose their case. Too much incentive to fraudulently sue with little consequences.
Legal costs are paid by the losing side in the UK and Aus. It's been working quite well, big business would rather settle cases since there's a big risk you double your costs of litigation.

Ron Helton Excellent idea. But, what if the GOVERNMENT OWNED every business. If an idiot got hurt using a GOVERNMENT product, the GOVERNMENT is IMMUNE.
Gas cans suck so bad these days. The nozzles on them work like crap. I love my old plastic gas cans. Easy and quick to use. I've had them since 1998. I'll hold onto them forever. The people dumping gas from a can into a fire should be the ones sued. Taking about being idiots. Does anyone still read warning labels these days? You can't stop idiots with a warning label or anything else.
I don't think they're to long. The problem with these newer nozzles is they're a pain to open and use. They have these slide, move type nozzles that work like crap and end up spilling more gas then anything one you can get it to release the gas. The 3 old Plastic Gas can I have, I just unscrew the top cap, and pull right out the flex nozzle and it seals up at the end. It's quick and easy to use. Then I have this small plastic tank for use with my Chain saw and other devices that need a gas/oil mix. The Nozzle for that. I have to unscrew the top, flip the nozzle from inside to outside. It has some twist lock thing on the bottom and some small spring. I have to push the nozzle down to get it to open so the gas will even flow out of it. It really does SUCK!!! I have one at work I got about a year ago, a 1 gallon size and it's almost as bad. It's how these cans are now made for the CA market!!! I don't just if it's just as bad outside of CA or not? My old cans I'll keep forever as I can't replace them. Not without getting ones with a crap nozzle for them. I don't think any of them are to long. You clearly should be dumb enough to start dumping gas onto a fire, let alone directly into a fire. That is natural selection at work.

this reminds me of gillivers travels where he explains the legal system "if my Neighbour want me how, he can hire a lawyer to say he should have cow for me"
We need to adopt 'Loser Pays' in our tort system; with the lawyers (not their clients) who take on cases on a contingency fee basis personally liable for all costs if they lose. The frivolous suits will be cut by 90%.
Sadly it will never happen in a million years. Who do you think the members of our federal and state legislatures are comprised of? It certainly isn't comprised of design engineers. What do you call a lawyer who is a failure at his profession? A: Politician.

McDonald's legal fees are going to be in the tens of millions because they will get the best lawyers, if not a team of them, how the hell are plaintiffs supposed to pay for that.
That's actually how it's done in the rest of the developed world. It's sometimes called the "English Law" but it should be everywhere. Only the United States and corrupt banana republics have a messed up legal system.
This video hits the nail on the head in this video about the Blitz vs. the new "safer" gas cans. I used to have one of the Blitz cans. Just a plain old simple gas can that poured great. Now all I can buy is one of the safety cans which are horrible. You have to stick the spout in the filler hole and use the rim to depress a tab which allows the gas to pour. It is very awkward to use and the gas splashes all over the place. That smug lawyer knows nothing.
Exactly right. I didn't use to spill gasoline filling my equipment until I started ( trying ) using one of those things. I think Ill just rip it off and replace it with a piece of fuel line.
First thing I do with a gas can is disable the crappy "safety" features of the spout.... Cut off the ratcheting tab that gets in the way of removing the spout. Clip the lock on the spout that keeps you from easily dispensing fuel and then wire the valve open. They've messed around with gas cans and car gas fill caps to where you have to use a transmission fluid funnel to put gas in your car using a gas can. We have to defeat all of the "safeties" in order to actually do what we want the gas can for...
I wouldn't "wire the valve open" as that will cause fuel vapors to leak out when not using the can. Bad for the gas and now you've got fuel vapors hanging around which are highly explosive.
you know I use those safty cans, for the life of me, how is itgoing to protect stupid people? most can read cant they? cant they just remove the lid and pour or click the pour leaver and pour it into a fire? how is that safer? instead of a lawsuit why did they just not let the poor company know that they want safter lids and they probably could of advise the design with little costs. why sue? oh yea it is about money errr justice, I get it now.

Getting a lawyer depends on what it's for. I tried to get a lawyer to help with Social Security Disability. I called one of those that advertise locally, but, oddly, they don't do that. It turned out that I didn't end up needing a paid liar. Kudos for me.
Darrell Emerick, the new cans with their crazy valves and nozzles are almost impossible to use without spilling at least a few drops or getting some on your hands or gloves..
Sorry, but that won't work. It's illegal (and a very hefty fine) for a gas station to let anyone put gas into any non-approved container. Politicians and lawyers closed that door.
I love his comments about "leaving it up to the Jury.." Why? Because lawyers intentionally relieve or excuse the most intelligent ones they can get away with disposing of leaving 12 of of the most common folks they can find in the box. The defense seeks not to prove anything, merely to confuse one person in that jury box. I have personally watched IT professionals and Software engineers tossed of Civil Jury's in which the case was directly related to the IT industry and software patents. Lawyers didn't want anyone with a clue in that box.
The defense isn't required to prove anything. Incidentally, in this instance, it was the plaintiffs who were attempting to obfuscate the facts, not the defense. How do you know that was their intention? Attorneys have many legitimate reasons for excusing potential jurors.
I don't know what the truth is, all I can do is argue for what I believe to be true; it's up to the jury to decide what's true. Bilk someone . . . they come to an attorney, not the other way around; it's a voluntary transaction. I don't know the circumstances surrounding that event, so I don't know if it's dubious or not. Overwhelming or beguiling a jury, if that is a course that a counselor takes, is a valid one. It is the jury's responsibility to see through the smoke screen, or to allow themselves to be blinded by it. After all, everyone is entitled to a vigorous defense conducted by a zealous advocate. Jurors, while perhaps not perfect, are not stupid. Some of they may be, however, many juries attempt to serve justice.
One way to reduce outrageous injury lawsuits is to do something about our ridiculously expensive health care system. Sometimes people sue everyone because it's the only way they're not going to lose their home if they get hurt.
Kauko Laurinolli and then you'd be next. Just like in Soviet Russia or communist China. If you don't believe in the law, perhaps you should go there. The problem is that the people do not consent to their government.
A few years ago, I went to buy a gas can as my old one sprung a leak. With the only one I could purchase, you could not pour gasoline out of it; instead you have to press the outside part of the nozzle against the gas tank aperture to open a valve, so gas could come out.
It should be the law that you must pay for the other defendants legal defense if you bring a lawsuit and it fails. But guess what? All the law makers are Lawyers... Lawyers even have government lobbies.
The whole problem is not merely lawyers. It is the legal concept that stupid people are not responsible for themselves.

@Mad Planet it's called the English rule in lawsuits. Was in place during Thatcher. Everything else about England is shitty nowadays but they got that one right awhile ago.

Not true. Vaccine manufacturers have politicians in their pockets, too. They are immune from being sued. Read up, folks.
And when Blitz went out of business, other companies started to make cans and tripled the price.
Imagine having the balls to call lawyers “parasites” and “awful” TO A LAWYER.
But it's exactly what they are.
OMG this reads like a criminal horror story

Simple solution is to have plaintiffs pay defense's legal fees if they lose their case. Too much incentive to fraudulently sue with little consequences.
Legal costs are paid by the losing side in the UK and Aus. It's been working quite well, big business would rather settle cases since there's a big risk you double your costs of litigation.
The US has it too. Or at least in the state where I'm from. You can only retrieve legal fees if the lawsuit is considered frivolous and unnecessary.

The people dumping gas from a can into a fire should be the ones sued. Taking about being idiots. Does anyone still read warning labels these days? You can't stop idiots with a warning label or anything else.
JB Dragon they're too long, a little common sense goes a long way.

If the splashed gas cought fire that's another lawsuit.....now I just by red water jugs with a threaded bung and attache a 3\4" hose to them......

You are correct, they will throw tons of information at the jury and overwhelm them and confuse them in an attempt to win.
The defense isn't required to prove anything. Incidentally, in this instance, it was the plaintiffs who were attempting to obfuscate the facts, not the defense. How do you know that was their intention? Attorneys have many legitimate reasons for excusing potential jurors.
James Maxwell you are correct. Many reasons, to win. Those reasons are called "dollars".
What's wrong with trying to win a case, or, for that matter, making a profit?
It was so cold at the courthouse that i saw a lawyer with his hands in his own pockets!😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂
"That's up to a jury"
lmao
"You deprive me of good stuff"
"Let's have a discussion...first let's get rid of the Lawyer's"-----Shakespheare
And this is the reason for exploding medical costs, lawyers suing and driving up the already extreme costs of malpractice insurance
There's a special place in hell for lawyers.
Is being a lawyer still considered a profession? I've always thought of it as organized crime.
No your talking about law enforcement and government. Lawyers are just their slimy associates who benefit from the organized crime.
Ever try to use one of those new safe gas can? It's fucking impossible
LOL. Stossel says right to his face: "you awful people". That's great
What's 10,000 POS lawyers in the bottom of the ocean? A good start.
God have mercy on the citizens of Bikini Bottom!
Clorox Bleach Mr. Krab and Plankton will be out of business :(
Kauko Laurinolli and then you'd be next. Just like in Soviet Russia or communist China. If you don't believe in the law, perhaps you should go there.
The problem is that the people do not consent to their government.
Josh B Eh Plankton will close down either way
Rebuilding the reef.
I love how he just calls the lawyer to his face a “parasite”.
A few years ago, I went to buy a gas can as my old one sprung a leak. With the only one I could purchase, you could not pour gasoline out of it; instead you have to press the outside part of the nozzle against the gas tank aperture to open a valve, so gas could come out.
The layers defense is that it is always up to a jury, which is code for "if you fall for my lies its your own fault".
It should be the law that you must pay for the other defendants legal defense if you bring a lawsuit and it fails. But guess what? All the law makers are Lawyers... Lawyers even have government lobbies.
We miss Blitz... Their cans were easy to fill up our boat
The grand jury system has to be totally revamped. The lawsuit system has to be thrown out. We live everyday from the remains of these vultures.
I had a small company & product liability law suits always scared me. Thank God there never was a lawsuit.
