      Add the videos to the interrogation-
      Her insistence she wasn’t drunk yet seems her former husband’s testimony about her drinking and behavior will show her claim on that to be a potential lie.
      I felt like some of the previous attorneys disagreement with her might have been claim of battered spouse with the interrogation & videos

      That's the job of the defense. The state has to follow the rules and not violate the defendant's rights. Everyone in law enforcement know this, some don't care (Trooper Proctor). But its important.

      @@PurlingQueen Simple response: She didn't know BWS was a defense. She didn't know that if she said "I was afraid to let him out because he would beat me like he did before" that was a valid defense. So naturally, she tried other ways to minimize her culpability (saying she went to sleep, denying she was drunk). That's why you need a lawyer before you talk to the police. A lawyer in Florida would have known that "I fell asleep" was not a defense to depraved heart (because she left him in mortal peril) but would have known that BWS was a possible defense.

    Went back and watched the interrogation Owens was speaking about and the only thing the detective didnt say was the very last sentence you commonly hear"with these rights in mind do you still want to talk with us" but she did ask everything else including"did anyone threaten you etc to talk" and most importantly "do you understand everything i've read to you" and the answer from Sarah was "yes" and she confirmed it wasn't the 1st time she was read her Miranda Rights...not gonna lie Owen's motions were kinda ridiculous but if Sarah is running the ship im not surprised he's making these kinds of arguments🤷🏽‍♀️🤦🏽‍♀️Great vid as always❤ & I hope everyone has a wonderful day 🥰

      In the car interview, SB wasn't detained or called to the station and willingly got into the cop car to speak with them. They mirandized her even though they were not required to.
      When they spoke to SB at the LE station, The detective's had Sarah Boone sign a Waiver of her rights, instead of asking her out loud. I guarantee you that she signed that she understood them and choose to waive her rights and to speak with them anyway.
      They could have gone one step further and asked if there was any reason she wished to talk to a lawyer prior to speaking to them, but they were not required to do that. SB thought she could convince them she wasn't at fault so she wanted to talk to them.

Every case/trial absolutely and fundamentally serves as the basis for all later cases…

      ​​@@Kim-g8j5s That's pretty common behavior for people who are victims of DV. I suspect based on her level of entitlement and other factors (control of money, etc) that Sarah is more likely abuser than victim. But I don't think her bailing him out is a good indicator either way.

    I appreciate your brilliant breakdown of this hearing. As far as their defense: Sarah constantly provoked and attacked the victim then recorded him when he fought back in order to manipulate the situation to make it look like he was abusive. There's absolutely no way she stopped recording if he started threatening her from within the suitcase, and I sure hope the jury recognizes a lie when they hear it.

    The problem with Owens' position is that he wants to know exactly what the state's argument is going to be regarding Mr. Torres' death so that he can fashion a set of facts that runs contrary to it; in other words, he wants to refute everything the prosecution is going to say at trial -- BEFORE the trial.
    He SHOULD BE formulating a set of facts as they see them, REGARDLESS of what the prosecution is going to allege, and THAT'S why the state's objecting.

    The problem with the self defense, battered spouse defense is 1. Her record of abuse against her ex and Jorge and 2. Jorge sounds so desperate to get out of the suitcase, he is begging her on the video to let him out, begging for his life and it's HEART BREAKING to hear. She got a video of that but didn't get a video of him threatening her life?? Its because he didn't and she is a liar and an abuser.
    Sarah has been doing her own hair her entire life...she can do it now too. How rediculous 🙄🙄🙄

    She had a list of questions, including getting her phone back, the kids device , oh and ……the ring off the cold dead hand of the man she murdered. Remember how she was so disappointed she wasn’t getting that ring back. That sounds just like a woman who was terrified of the man she had to kill in self defense.
    I’m no one but I think she would have faired better to go with accident. Give her a damn fair trial but this woman is guilty of second degree murder.

Manslaughter vs 2nd degree is a harder call for me, partially just because as a non-expert it's not fully clear where the lines are drawn between the types in Florida... I'm very eager to hear the state explain the elements of the charge, and why they believe the evidence supports that.

    Ok so bottom line - if she was terrified of his actions when he got out because she was a BS - then she would never have just went up to bed. Never. Who goes to bed knowing or even thinking they may wake up to a beating any moment.
    She also hammered home so hars that he could get out. So it doesnt fly that she would take that risk.

    Here’s your particulars: Jorge died alone stuffed in a hot dark suitcase that Sarah says she told him to get in and then she zipped it up. He begged for air and to get out of that suitcase while Sarah filmed him and laughed and mocked him, and then skipped off to bed as he drew his last painful breathes.
    She’s an alcoholic, lying, narcissist. Never said I’m sorry to his family or anybody. It’s all about Sarah and her plight. I’m glad she has a lawyer. But he won’t do her any good. Even if she produces photos of bruises etc, battered wife does not track. Even if we didn’t have the video. They had a good day. There was no tension. They’ve been good lately.       One of the times when he said "I can't breathe" she responded "then you should probably shut the #*@% up." She basically told him the air in his lungs is the last he's going to have, and he's wasting it by begging for his life. To me that shows premeditation. She knew he was dying and gave him some advice for how to eke out a few extra minutes.

    I imagine that while on the stand, Sara Boone will start out calm but may get rather defensive along the way. But she may surprise us!! As for her wanting makeup, that's not so unusual a request, but Judge Kraynick was not the person to ask. If I heard right, it's Miss Click who handles those matters. LOL! When Owens asked about the makeup, Judge Kraynick paused a couple of seconds before answering. I had to laugh! In either case, this is going to be one very intriguing trial! I think the judge is often very astute, and he is only human but missed the fact that Owens said he's claiming self defence.

    Blunt force trauma to the head is how she got him in the suitcase and is not unrelated at all. It was proven that he did not have those injuries until that night when he went inside with Sarah. She did that to him. That night. Therefore it is 100% related and is tied to the murder.

    Owens claim the detective didn't ask Sarah a question in the end. I figured he meant the female detective didn't ask her if she understood the rights that had been read to her. I went back an listened to the interrogation with Sarah and that question was clearly asked and Sarah answered yes that she indeed did understand.

The female Detective did do something incorrectly, b/c the male detective put his hand up to stop the female detective before she cuffed her. The female detective didn’t read off a card, but started to read her charges and cuff her before confirming that everything she said was truthful and accurate.

    Some of the arguments Owens makes sound like some of the handwritten letters/motions Sarah wrote. Leads me to believe Sarah is leading the charge in her defense (like she always wanted) & Owens is committed now so he has just going along with it. She literally has to change the "not intentional" to "it was intentional". They have to try to get the police interview thrown out because that would screw up her defense.

    Peter, I sent you my book about my Dad, Dr. C Henry Kempe, who in 1962 coined the phrase The Battered Child Syndrome in a speech to the American Academy of Pediatrics and was a pioneer in CA. The definitions of Battered Spouse or Battered Woman were taken from that legal definition of child abuse, and adapted from that definition. Of course any kind of abuse to others affects all of those in the circle around a victim. As in CA, it has become overused and randomly applied in defenses. It is strange for me every time I hear "battered" as my Dad used that term to draw attention to a once under-reported or recognized syndrome. Thanks, Annie K

      The issue for viewers here was that Peter couldn't balance his microphone volume to the court audio by lowering the level/moving mic/speaking more quietly, that's entirely his issue. Broadcasters with considerably less subscribers produced streams with balanced audio.

    The defense is going to have to explain to the jury why she lied about it for more than four years. And why their expert witnesses didn't think she was a battered spouse for for years, but changed her mind right before trial.
    I wish I could be in the room when Owens figures out that the cell phone image that they've had the whole time includes all the information on the cell phone.
    This hearing is the first time that Owens mentioned that he had requested the card. He did not include that in his motion. It's not the state's fault that he waited until the eleventh hour to mention the wait time for his request.

    I've been saying this for weeks. Sarah boone is to claim she was afraid of what Jorge would do, so she left him in the suitcase and went upstairs to secure herself. She called Brian to get Jorge out of the suitcase/out of the house. She fell asleep waiting for him (knowing he had a key to her place) . That's why she wasn't worried in the morning. She thought Brian dealt with Jorge, so all was well. It's all bull spit, but I'm so afraid the jury's gonna buy into her crap.

    To me, it's very clear that she got completely wasted, which turned a possible fun night for once bring out all the animosity from the past. I can't see people on the jury not having seen a drunk person who changes once having too many drinks. I do believe that she blacked out and passed out. It is very common for alcoholics to be in denial regarding their drinking. If she had remembered what happened, I would think she would have tried deleting that video.     Sarah was like the cat who hangs onto the mouse, not killing it, but holding it hostage. She enjoyed having him confined & under her control. This was up to the point he was begging for his life, getting weaker, telling her he can't breath. She continued to mock him, after he told her he was suffocating. I view her as enjoying the power she had over Jorge. She used the damsel in distress card, to have him arrested repeatedly. Sarah is a predator, she treated Brian the same way. I hope her ex husband testifies truthfully, to the full extent of Sarah's violent nature.

    Sarah Boone was definitely intoxicated when she was videotaping the game. Her problem is in her interview, she didn’t , want to admit it. She said they just “shared” a bottle of wine. That was bs. After both getting drunk, decided to play stupid games. Once he got in the suitcase, and both drunk, she was like, aha, I’ll just let you sit for awhile while you beg me to let you out after everything you do to me. Then she winds up passing out. I do not think she did this intentionally.
    She bailed his ass out just for him to come back home I believe more than once.
