    Okay I was assigned a court-appointed attorney for a DCS case in Richmond Indiana I was just wondering if they're supposed meet at DCS office to represent me when to talk to DCS

    What if had counsel that I was paying for and after a minor setback I now do NOT have counsel. And during this setback I was not able to make the last court date. It was pre-trial prior to the final jury trial that I missed. Due to this court date I missed I now have a warrant. How would I go about requesting a Public defender again? The court said I need to write and request a public defender and depending on my circumstances they will appoint me one and set a new court date for plea deal and or sentence. My main concern is what would be good reason to go about requesting a public defender? I’d like to keep it as short and sweet as possible.

      Sorry to say I can’t give this kind of specific advice. Where I practice the typical procedure would be that once you’re booked on your Pretrial warrant they give you an appearance at which time you would address the appointed counsel situation. Or you hire new counsel and see what they can do about setting aside the warrant and getting new court dates established. But also where I practice the policy is judges don’t set aside Pretrial warrants until the defendant has been booked on them. But it can also depend on the judge.

    I've had 4 different public defenders for a case that happened in 2020. Although in 2021 it was dismissed, it was refiled just a few days later. I've had 4 different PD and 6 pre-trial and preliminary hearing that only lasted for two minutes top, the it's scheduled for another court date that usually being within 60 days from that day. My case is in California and I have questioned them on things that should know but I get just the opposite. Example,. I asked my PD to request the dozen plus 911 calls I made in 2021. His response was " they only keep 911 calls for 6 months" Yeah,. this is what I'm dealing with and since it's a felony I can't work or even get paid for taking care of my mom because of this case that hasn't closed, and it's going to be 2 years in October. WTF is going on ? Victim refused to testify and told DA and police that he was the aggressor. But they continue with this nonsense and won't let it go . Any advice on what I should do?

      Robert . There are so many garbage lawyers out there that out weigh good lawyers .
      I would only hire a lawyer that he or she themselves have been victimized by the system .
      I was falsely charged and had surveillance video exonerating me .
      I was still charged because of a malicious detective and fake victim . That falsified a police report to establish probable cause .
      My first lawyer said he was a criminal lawyer then I learned he is actually a family law lawyer . My second lawyer said I was a problem because I was wanting to be too involved ?? U know my life was on the line for something that never happened and wasn’t born . But I shouldn’t be worried about it or proactive .
      The Third lawyer said we should not show the smoking gun video that exonerated me because he doesn’t want to show his cards until they show all their cards , and it will be a big deal when he pulls it out as impeachment evidence at a trial if we ever need to get to a trial . So he is holding to his evidence in his pockets .Then he quit because he said the judge is corrupt and it’s a judge trial so he won’t be able to get me the verdict I want . And abandoned the case yet still covering his ass with getting the judge to release him .
      The
      The 4 Th lawyer was a personal injury lawyer , that I hired because no one else wanted to take my case me ankh criminal lawyer . He then sent me an email 2 days later after hiring him that he can’t continue due to a family emergency, this emergency happened after he spoke with the third lawyer .
      The 5th lawyer was a loud mouth crazy lawyer that Fought with all the lawyers and judges . I said no one can talk him into not taking my case . He listened and said this is BS u should have never been charged .
      And said he knows the judge , had the judge dismiss it with prejudice on a Brady violation for the state saying they lost the surveillance that I already had from my own personal dash cam .
      This was 2 years and 20
      Hearings later . Precious Years I for ever will never get back . As u know your life is on hold when u r caught up in the system .
      I was able to afford lawyers . And it took the 5th and only because he knew the judge .
      The fact that I was innocent meant nothing .
      What about all those people locked up and can’t afford a lawyer ??
      They will plea bargain even as innocent people to just get the hell out of there and on with their lives . It’s not a Justice system it’s a legal system . I used to believe where there is smoke there is fire . Everyone is guilty .
      Today I know better .
      There are bad people out there that lie .
      And detectives and police that will push a charge just because why not ?
      Never doing a real investigation .
      Had they investigated the fake victim he was already convicted of filing false police reports and false testimony In the superior court . Would have saved me 2 years and trauma that till today I’ve never recovered from .

    Public defenders are fine to use if you have a federal case. Not a state level one. The issue is that state and local PDs have heavy caseloads and aren’t very experienced since they are paid poorly. Federal ones are no however.

    depends on the case at hand. Some cases you should go private and some cases public defender is okay. Some private attorneys are worse than public defenders and vice versa.

      If you used a public defender it usually depends on what the judge ordered in your case whether you had to reimburse them or not.

      If they have experience with similar cases to you. There are places you can call that will find you the right lawyer. Many lawyers will represent you, but not all of them will have the right experience

    I’m a taxi driver in nyc and a girl passenger accused me of assault by faking bruises on her arms, I was arrested and released on the same day with A D ticket and I’m confused between a public defender and private attorney since I can’t afford money in same time I’m scared to go to jail.

      If you can’t afford private counsel you will need to make use of the public defender. Make sure you do what you need to with the court to have the public defender assigned. Where I practice that means filling out certain papers to show your income level meets the state requirements for appointment of the public defender. Then be sure to get in and stay in touch with them concerning your case.

      Bro so sorry to hear that happened to u . And I actually do believe u .
      U will get out of it as long as u push for a trial don’t plea bargain if u r innocent . Her story won’t hold water when she is lying . And make sure they do an investigation on her character . Did she file false complaints before ? Is she crazy ? Is she notorious for filing law suits ? Like she is probably trying to do now against the TLC and nyc .
      A public defender will have resources to check all these for u .
      A paid lawyer unless u pay a lot won’t hire investigators for free.
      If u are working to survive . Just use a public defender tell them u have no money to appoint U one .
      And u will be ok . Just don’t give up and don’t be scared . Remember u did nothing wrong .
      U r just being accused .

      Like anything some are good some aren’t. It has so much to do with perception and expectations. Our job of course is not to make it go away every time. That’s just not realistic or possible. Hire someone you like that explains things and has your back.

    Can we request the court to replace the assigned attorney if they are not returning your calls, emails, is not filing any motions on your behalf, talking to the county prosecutor and not informing you of what was discussed, not giving you copies of discoveries from the State, declining a face to face meeting. If we can request a replacement, how do we go about doing that. Also has very bad reviews. Can we report them to the State BAR so another poor person does not get a bad attorney.

      So typically your not entitled to your choice of assigned counsel. But yea there is usually a mechanism by way of filing a motion with the court to remove the assigned counsel and appoint substitute counsel if certain circumstances exist. I can’t give specific advice on here though.

    Henry county Alabama they charge $500 for a court appointed attorney if you cannot afford a real one, i know firsthand, as a matter of fact before my case was over they charged me $1000 for two attorneys for my case, ended up i had to get my case dismissed by myself because the court appointed attorney's threw me under the bus, yet the courts charged me $2,000 for my attorneys and court costs.

    I just wanted to know I’ve never got arrested before or have a criminal history and I have a second degree assault. Wich i was just protecting myself wich Maryland doesn’t have the law. How would that be for me? I’m honestly really scared

      Same her but in California. My case git dismissed but it was refiled on just days later. It's going on two years in October for me fighting this case. All I can say is pray that the truth will set you and me free. Good luck

      Well the constitution doesn’t guarantee you an attorney for civil issues like it does when being accused of a crime. However, many places have state subsidized organizations that can provide counsel for domestic issues. You might want to call your local courthouse and ask about what resources might be available in your jurisdiction.

    Hi, my daughter, chose to go with a PD on a misdemeanor criminal case, she was taken in on a failure to appear. She got her next court date, and ORd out. She was 1 1/2 hours late, but we got there, we went to court services, told them she was late and that she was supposed to be there at 1:30 they gave her a business card and told her to contact her PO. Now how we found out that her request was approved for a public defender: a colleague of mine and I went on to public access to take a look at her court case and realized that a bench warrant was placed on her case just a few days after we were late to court not to mention that she had a public defender that showed up to her court case and she didn't go because she didn't even know she was being represented yet her public defender never contacted her at all and come to find out she was appointed to my daughters case on April 16th of this year she had just gone to jail 2 days before on the 14th this woman are public defender showed up in court on the 22nd that dayzunique didn't even know she had a public defender moving forward. That was April 22nd moving forward from April 22nd to May what is today I believe today is the 17th so May 14th my daughter gets arrested when she goes in for Traffic Court come to find out that bench warrant was not only never removed but my daughter still hasn't spoken to her public defender her public defender goes on to tell me quote it is her responsibility to reach out to her attorney if she knows she had one in quote however my daughter didn't even know she had one but she knew she was appointed to her case and never contacted her so now my daughter is sitting in a jail with no bond she's already missed one day of work she's going to lose her job is going to pose a lot of other problems cuz she is a single mom I need help to get her out of jail to get this woman I don't know to do her job I don't know what to do because I know for a fact that my daughter's rights are I have my my criminal justice degree you know I can apply to be a crime scene investigator right now I can do these things and now I'm just pushing it to go further and I'm going to have to go to become an attorney cuz I'm really tired of how people are getting railroaded and I know this woman is wrong but yet she's making it throwing it all on my daughter because my daughter is the one that's being looked down and negatively upon right now and it's easier to do that and I just don't appreciate it I apologize for this being so long please you can call me my number is 919-709-7603 I think you very much for your time and posting us and that's one of the reasons why I reached out to you is cuz I need some kind of clarity on what to do because my next step is the disciplinary board thanks

    I would say public defenders can be as good if not better than private attorneys if the politicians would actually care about the public defender system. Sadly, that's not the case, and so the system still remains broken, with staggering caseloads and not enough pay. If Gideon was alive, he would feel ashamed that the country forgot about his Supreme Court case.

      In my experience, public defenders are way overworked and terribly under paid. In most cases you will barely talk to your attorney before trial, and about the only thing you can expect from a public defender is a quick plea bargain, which you better take because you will loose at trial. It doesn't matter if you are guilty or not, they just work to put these cases to rest. This is why many innocent people take a plea because they don't stand a chance in court.

      That shouldn’t happen. Generally, for any offense that carries potential jail time you are constitutionally guaranteed the right to counsel.

    Where does court appointed counsel get off lying to and obviously defending the state v defending its client? How is it not a conflict of interest that every significant member of the court, minus the human being, is a member of the bar? How is the court able to pull off admiralty/maritime jurisdiction even though a man or woman has submitted an affidavit of status? If my status as a woman wasn’t rebutted how do they proceed without an international contract? I realize cqv/fide commissary/foreign situs trust (canon, law of nations) is what allows, unlawfully, the federal govt to set up a military court to hear “citizens” but if living status has been submitted how do they rationalise further prosecute over traffic offences? Is it not true that all contracts have five elements? The validity of a contract is based upon a man knowingly and voluntarily signing a contract, correct? Fundamental law of the constitution is the law of the land and as discussed by Hamilton in #78 of the federalists papers states that fundamental law of the constitution trumps statutory law. A judge’s job is to determine the constitutionality of congressional laws and to interpret the constitution, not play judge, jury and executioner.

    is it practical or even possible for me to request a public defender, my dumbas* just got caught driving no license no insurance expired tags..which r also registered to 1 of my other vehicles so theres that also.. the trucks not even registered in my name or even somebody with the same last name yet he never questioned that, i just bought it from my uncle n its in his wifes name, nothing sketchy.. i live close enough to most things n when i do need a ride somewhere, i have so many friends that basically live here n love going on rides so thats never been a problem, but this one Fn day middle of the workday so nobodies available n the backup emergency person i have was even busy, so i had no choice but to take my truck 2 miles on sideroads to my docs office, i couldnt miss this appointment i needed to give bloodwork n other stuff, im having some serious issues in my back, not the crushed vertebrae, its something to do with the kidneys we think. sry for writing so much, i didnt want to leave out any important details

      You should absolutely request the court appoint counsel. They will typically address with you whether you want to apply for that or hire your own attorney. Where I’m from those are bailable offenses and you are guaranteed the right to counsel. Court appointed if you can’t afford to hire your attorney of choice.

      Perhaps most importantly you get to choose who represents you. The reason attorneys are licensed and do continuing legal education is to, in theory, provide a comparable level of legal service. Then it comes down to who you think gives you your best odds at a favorable outcome and someone you trust has your back.

    I was mainly watching this video to find out on average, if anyone really trusts an appointed lawyer.
    My first thought when hearing the accusing side of the situation tell you they will appoint a lawyer for you, it instantly makes me assume you are screwed and will be sided against.
    Maybe that's weird, but that's the overall feeling I get when I hear the rights being read to people, which I should also point out, are only in RUclips videos...
    Anyway, was just watching one again, and figured I would look around to get an overall idea of how people in that sort of situation feel about it.
    I didn't really get that here, other than a little from the comments where people are annoyed with their PD for seeming like they don't really care to go out of their way to try to help, but seem to if it's blatantly obvious.
    I could be totally wrong though.

      ​@@easyeyoSometimes you can be arrested for something EXTREMELY minor, petty, trivial, and totally inconsequential, like cursing out your former boss in an email for an unfair dismissal based on gossip, rumours, and wild accusations. The cops will always side with the person who's rich, powerful, and influential, especially in a suburban town or rural community. Cops are total scumbags whose only real job is to protect the property and interests of the rich, to preserve public order, and to maintain the status quo. The police should not be defunded, it should be totally abolished!!! 😠😡🤬

      This is way too complex to unpack but our system definitely has issues. I will also say that at times the loudest complaints about appointed attorneys come from the most obviously guilty.

      @@mendoblendo321 probably because he has a case load that he could never actually serve well. I hear to often that they just choose what is easiest not really fight. Not excusing the behavior but I understand it. One is better off defending oneself.

      I get what you’re saying and many people sow distrust for defenders based on where their funding comes from but they do not work for the state in the context of their representation of a client. All attorneys are regulated by the same rules of conduct and those dictate operating in the best interest of the client. Defendants have the ability to request change of counsel even of appointed counsel if the attorney client relationship breaks down. Obviously not all attorneys function the same some are more engaged or know more than others, not all are equally skilled. However in my experience we all want to do a good job for our clients regardless of how the representation is funded. Also, many public defenders go on to private practice and doing a good job is important for future opportunity. Public defenders can even be some of the best at what they do because they do it day in and day out, deal with the same players constantly and build relationships that are beneficial to their clients. Often the bad wrap they get are based on people that don’t like the outcome regardless of the evidence against them.

    Kinda a legal question , what can I do asked defence for dash cam footage ,it will prove my whole case and police officer is lieing , did a discovery, motion to compel judge denied . any other motion or act to get dash cam . its footage defence DOES NOT WANT ME TO SEE, requested under 2 FOIA denied.

      Are you suing them? You said the defense doesn’t want you to have it. I typically am the defense so just clarify for me what your position in the case is.

      @@easyeyo in a way I am the defence . police keep Manufacturing charges against me . lost job , property . months latter prosecutor dismisses charges .u walk out of jail then. Only way I can think of is did a civil 1983 against police . need dash cam to prove they violated my rights . 3times charges dismissed total year in county jail spent

    First off, it's not a yes or no question, it depends. If you 100% know your innocent and truly didn't shoot him and have evidence u was in school during the Murder and cab prove it but the Detectives wouldn't listen to you then save your money get a public defender. Don't go spend 70k for a lawyer just to have it thrown out soon. If shit dramatically changes for a special reason you can always attain a paid lawyer later. 2nd, if it's a Federal Case and you know u are guilty as hell and you left ton of evidence and have been reckless with your evidence rather than spend 100k to a Federal lawyer just to take the deal they would have gave you with the public defender. Better to use the money for your family and on your books in prison that your lawyers dinner table. Federal lawyers are not much help than Public defenders on cases that have statutory miminums. If your case is identity theft with a mandatory 2 years and you know they have mountains of evidence on you do not pay a lawyer 30k to represent you as mandatory sentences will not be reduced if u are solo in the case. Now, if you are damn guilty but want to take that risk because you have nothing to loose your old and this is your last chance at life freedom on a Murder then absolutely paid lawyer. Their are to many things to consider both are good depending on wt you know u did. If you know hey I'll be guilty if all my evidence that I'm innocent don't get in then go with a judge but if you know your guilty go with a jury. A judge will hear all evidence and suppress nothing but a jury only hears what attorneys wants them to hear that can help and hurt your case.

    All situations in court should be evaluated, Ruled and should be deliberated based on truth nothing more... I've seen excellent public defenders but several of them are in hope of bargaining your case away... and defendants out of pain fear will plead guilty even if they are not..85% will agree to take some stupid unjust deal .... major break down within the Justice system and judges and clerks will play along regardless of any constitutional rights or anything being violated..all a judge has to say is ( are you aware that you are pleading guilty and my ruling will be final ) and once an individual pleads guilty an appeal cannot be filed in most case's it over.... sincerely.     It depends on the crime. If the max fine is $1000 for the offense, then why pay a lawyer $300 per hour to take the case, when it might cost $10k plus. If your truly innocent, fight the case with a court appointed lawyer, or fight it yourself. 😊

      Not wrong. Sometimes the conviction means more than the fine. I’ve had clients where any conviction would mean they lose their job or professional license so it was all in regardless of the severity level of the crime or potential fine.

    I had a public defender one time. Walked into court and he was talking to the prosecutor about how did his sons bar mitzvah go. It was my second time speaking to him and first time actually seeing him. He knew everyone in the courthouse on a buddy buddy level. Long story short i pleaded out and they threw in lost of gun rights in there during verdict. This fool whispers to me "i didnt know they were going to do that". Found out later this guy was a tax attorney......FML!!!!

      Thank you. Pro Bono is a thing. I’ve done cases over the years for people that couldn’t afford counsel in civil situations and family law. I’d say it’s pretty rare in the criminal context because of the constitutional right to counsel. That’s why if you can’t afford an attorney on criminal charges one is provided and they still get paid through state funding. As to interns they can’t represent clients in court. There are very specific exceptions such as student prosecutors but they are law students and are supervised by licensed attorneys.

      @@thomasjust2663 - Yep, many private attorneys suck too. It also depends on “expectations and perceptions”, as the moderator says here. Attorneys are all different and some are good and some are not so good. Sadly most public defenders do have heavy case loads and practice as best they can. Contact and communication suffers as a result.

      Options when your PD(or attorney) fails to communicate: 1) write or call him(her); 2). If PD or appointed write your judge; 3) write the State Bar Association which licenses your attorney. If you hired a private attorney and no contact after attempting above hire another one and ask for refund.

      The lawyer may be very good, but with so many cases on their workload, they just don't have the time to each case, they only have 24 hours like everyone else, go private if you can, if not, well go and pray

    Do you know how difficult it is to be a public defender in a big city? First you're competing with other lawyers nation wide who are passionate about indigent defense. Second, you must pass at least 2 or 3 rounds of intensive examinations, a guantlet of legal hypos to weed out the weak. Third, there is at most 15 spots usually open for that "class" out of hundreds competing. Joey this isn't your tell me about yourself interview hiring process, you go through war to get the job. These guys are top notch and do better handling multiple cases than a private attorney handling a few. You think money can buy you competence? Public defender's do crim defense only, nothing else, day in day out in court. They are trained extensively and continuously throughout their careers. They are also well paid in big cities earning 6 figures after a year or two.
