    The 3-meter legal easement were intended for promenade(consists of sidewalk, a leisurely walk in a public place for recreation), maybe they were asking for another 7mts is because they will develop the area to esplanade (it is also intended for a leisure walk but it also include large boulevards or avenues that is accessible by a vehicle). And if this is the case, wala talaga silang magagawa kundi ibenta yun sa gobyerno (the power of eminent domain)

    Dear sir, yong nakabeli ng lupa nasa tabi ng dagat na pinapa alis ang mga bahay na sakop sa 20 meters easement, kasi nag apply siya ng foreshoreless, ano po ang ligality niyan.

    Good am atty saan po tayo mag petition sa project na itinayo sa lgu which is may spring ng tubig na natamaan sa ginawang bakod at hindi sila nag bigay og legal easement which is ayon sa batas may allowance both side na 3 to 6 meters?

      Base po sa DENR Administrative Order No. 99-21, nakasaad po sa Section 6 Measurement of Legal Easement.
      6.2. Banks of rivers and streams with channels at least five (5) meters wide or continuously flowing rivers and streams even with less than five (5) meters width, creeks, arroyos or esteros shall subjected to legal easement of "three (3) meters in urban areas, twenty (20) meters in agricultural lands and forty (40) meters in forest lands, measured landward from the edge of the normal high waterline.
