Biden, Kamala Harris, & ATF Just Criminalized Anyone Who Sells Their Gun For A Profit

  • The White House just issued a new rule to expand background checks by using the ATF to circumvent Congress.
    In doing so, Jow Biden's ATF objective is trying to get as close to so-called “universal background checks” for firearm sales as possible.
    Previously, an individual only needed a federal license to sell firearms when engaged in “a course of trade or business “involving “repetitive” buying and reselling of firearms with the “principal objective” of “livelihood and profit.” The Bipartisan Safer Communities Act that Texas Republican Senator John Cornyn helped pass removed the “livelihood” element so that profit-seeking alone would fulfill the required objective of the sales.
    This means anyone who makes a profit off of selling their own firearms.
    Attorney General Merrick Garland offered details on the new rule, saying, "Anyone who sells a firearm predominantly for profit must be federally registered and conduct a background check on the customer."

      Less inflation? You say that like anyone has the power to control inflation. It's got a mind if it's own and is the result of countless factors, most of which are outside of the government's control. Governments don't control inflation so much as inflation dictates what the government does.
      Also the government can do two things at once. If they wanted to tighten border security they would.
      Also close the borders? Completely? Do you realize that America's economy and growth is reliant on immigration? With such a low birth rate, much like here in Canada, without immigration our countries would see population decline and that would be economic suicide.

    If you buy at a gun show, you go through a background check, if you buy online, it ships to an FFL and you get a background check..... This is ludicrous and asinine..

      Only if u buy from a licensed vendor there are private sellers at least in Texas I’ve been to a few with friends most booths are real gun stores but about 10 percent are private sellers usually old guys with like 20 guns usually older stuff and u just pay cash and if there “strict” u flash them your ID real quick I was with my buddy and word for word the guy said “just flash me your ID real quick in case anyone is looking I won’t look at it really I just have to make it look I checked” then like all sellers do they make some joke about atf being somewhere undercover in the crowed and then my buddy hands over some cash and handed a box with a pistol in it no paper work nothing but not all states allow that so for a gun show u need a to pay a few bucks to get in show ID they don’t write anything down and then u roam most vendors do require background checks because there actually gun stores but again private citizens can sell there stuff there to do yes u definitely can buy a gun without background check and even thru those meet in person websites kinda like Craigslist for guns I don’t know anyone who has do that but it’s the same thing as long as it’s a Private sale legally u don’t have the requirement to check according to most interpretations and they even say in some lawyer videos I’ve watched that u shouldn’t even ask if there a felon because then that opens up the window for u to have be more certain or some legal jargon anyway u can look it up I’m mostly accurate I’m sure with what I said

      You can do private sales here in Indiana too if you aren't a licensed FFL dealer selling your own personal guns or collection. It has to be face to face though and can't be shipped or cross State lines. MOST private sellers ask for a valid drivers license and or a Indiana License to Carry. You STILL are required to not "knowingly" sell to a prohibited person even though it's a private sale and without a FFL.

      Look up gun show loophole. Condense version is so long as you don’t suspect they live in a different state or are a criminal you can sell them a firearm. The government wants to make people who make there living selling firearms at gun shows do actual background checks.

    I made an online purchase several years ago, and STILL had to do a background check as it was sent to a local FFL. So this whole online loophole thing is BS.

Correct me if I'm wrong, are gun shows (I never been) selling firearms without an FFL and required back ground check, is that what this is about?

Do not be beholden to _any_ political affiliation someone may claim but check that their viewpoints are what align. People set too much personal identity on the color identity of the groups who lie to them so that those groups can be put in a position of power.       @@steveharper5368That wasn’t the same scenario, what he did was buy several firearms at a gun shop which flagged him and then he sold them immediately after which flagged him again when his guns were recovered from crime scenes shortly after the fact which proved he was straw purchasing. Not saying they were right in any capacity but it’s not the same context. Most private sales happen between people you know and the ones that don’t would be like a game of fishing and wouldn’t likely be able to yield anything of substance cause there’s too many variables for them to have to prove. Did you make a “profit”, what is considered “valuable”, when did you buy it, when did you sell it, what if you’re trading it? How many have you bought, sold, traded? It’s impossible.

The fact that this bill passed in less than 48 hours shows that we are no longer represented by our elected officials. They usually pass these bills late at night, like some backroom poker game.     Never been to a single gun show where the vendors didnt do back ground checks. There are literally tables spread around with the forms on them to pre fill so your ready…. What a joke.

      It is intentionally deceptive. At any gun show, there are dealers (stores that set up tables, generally FFLs already), collectors (private individuals selling private collections, generally NOT FFLs), and buyers (attendees who wander around and buy or sell, generally NOT FFLs). Gun show organizers CAN pass rules to be a vendor at their show saying that in order to sell you must be an FFL, but not all gun shows do this. The "gun show loophole" is deceptively named because it makes it sound like anyone can just walk into any gun show and walk out with a machine gun, when in reality the venue isn't directly related. A individual can sell a firearm in a private transaction, without needing to have an FFL, or conduct a background check, just about anywhere. Garage sales, estate sales, the Walmart parking lot, etc. When the anti-gun crowd talks about the "gun show loophole" what they are describing is the fact that individuals have a right to buy and sell firearms from private sellers, and they are trying to make it sound like criminals are going to gun shows by the thousands and buying up firearms by the millions.
      There are a few flaws with this line of reasoning.
      First, criminals aren't going to gun shows to obtain firearms. Firearms sold at gun shows are usually expensive, and criminals don't want to spend a lot of money on a gun they are going to use to commit a crime, and then likely dispose of. They are buying their guns on the black market, or by stealing them.
      Second, background checks aren't the panacea that the left wants to make them out to be. Many of the perpetrators of recent high profile events obtained their firearms legally, including getting a background check. A background check isn't going to magically stop crime.
      As usual, the anti-gun proponents are trying to solve a problem by focusing on the wrong thing. Despite what the organizations supporting these new rules says, this will NOT save lives in any appreciable capacity. This will do virtually nothing to stop criminals from committing crimes and will only burden law abiding citizens.
