In the situation where the prosecutor manipulates a defendant by negotiating the resolution of one charged crime, but then turns around and pursues another crime, what legal principle applies to require the prosecutor to reveal all possible crimes he might be considering pursuit of. I mean certainly the obligation to reveal exculpatory evidence is firmly established and well known. But what principle requires disclosure of all investigations that are ongoing and prosecutor attitudes as each of them? Also, isn't it the defense lawyer's obligation to negotiate any settlement to be fully encompassing of all crimes that might be related to the facts of the circumstances underpinning the original charge?
My lawyer has been trying for a year to get the footage of body cameras and dash cam. They only released arrival of second officer dash cam. No other footage how is that right for a discovery.
But now, LEOs are making it harder to get BWC evidence. As of late, many LEOs have implemented high premiums to obtain footage. This has happened in many jurisdictions. So……the question arises, if I can not get the footage? Therein is the conundrum. Now what?
