  • The Government of Samoa has been heavily criticised by legal experts in Samoa, New Zealand and Australia over proposed law changes to three bills currently before a Parliament select committee. There are concerns that the changes will impact the legal rights of all Samoans to their customary lands and chiefly titles. Renee Kahukura Iosefa has this story.

China poor there hard earned into building an airport... There is no God its all Fake, 80-90% of the people that goes to church here in South Auckland are either in debt or just surviving... they care more about speakers and loud bass, with a bottle of beer than really helping in Samoa there mother land....     The current law is fine. Keep Sāmoa lands in Sāmoa hands. And only Sāmoa hands that are vowed to stay loyal to Sāmoa, not China, or NZ, USA or any other possible neocolonial powers. Its sad how people are so shallow and greedy and think that somehow things will turn out differently when history shows repeatedly the results of inside betrayal, and sabotage. It will not be good for Sāmoa. Take care and love the land and ocean and they are our family and our inheritance and birthright.

If these lands are taken away, or if the government is given the ability to, at will, or even worse, at the will of the CCP, take the customary land. Our people will forever lose their ability to feed, clothe and simply care for themselves. How do I know, I too am Samoan. Born and raised, in Samoa by a Samoan Mum who taught me the importance Fa'a Samoa, the importance of the price our ancestors paid so that we today, so that our children tomorrow will have their land, and with it, the ability to care for themselves.

Please do not mistake nz interest in the Pacific islands, it has always been for the land and minerals. They are looking to build an airstrip in Tokelau?? Why would nz need a airstrip in Tokelau? And changed traditional customary land rights. When any world leader borrows money there are conditions that need to be met, nz has been throwing money at the Pacific Islands, and we all know things in this world do not come for free.

However, China too, has been in Samoa, sitting still for many years. Its only been in the last 10 to 15 years that's they've started to make their move, both in Samoa as well as many other Polynesian countries. China has no good intent other than for themselves. They will bribe any willing government official who is willing to participate. Know this, Samoa or any other small Pacific island nation will be hurt by the touch of China's hand.

    Dear Prime Minister of Samoa,
    I understand that you borrowed a large sum from a foreign government with the best intentions by pouring it into the deteriorating Samoan infrastructure modernising the hospitals, fixing the roads and schools. This I am greatful on behalf of myself and agiá. But it saddens me to see my PM being pressured into such a desperate position as to commit property theft by means of legislation to satisfy debaters. It's not easy being a small country with no real means of defense, while even your allies look at your country with hungry eyes. We all understand. But that's what makes us unique amongst nations is that even under pressure, even without any help, we continue forward AND passing this legislation will ultimately hinder that progress and our people, your people will become beholden to a foreign country who has no care, understanding nor any sense of the culture and even less for it's people. Have faith in your people, cultivate their minds, support local businesses to trade internationally and offer international services. And your legacy will be an inspiration to many generations to come. Thank you, and stay safe.

    Samoa is in debt, so what's the alternative and solutions to pay off the debt? Making Samoa look good on the outside, but broken and struggling on the inside? So Government sold its soul to the devil, now the grim reaper coming to collect, at the expense of its own people they took a gamble and sadly I can see it was to elevate Samoa to new level of self preservation but unfortunately they played right into the hands of one of the most powerful savage nations on earth, if they don't give a damn about their own people's human rights, for decades upon decades they have murdered and silenced and oppressed their own, why the hell would they care about Samoan peoples, Samoan Government, you let money blind your senses, so you better play the game right and see exactly who you dealing with and buy your soul back and save Samoa!!!!

    This is not looking good at all I can tell that something bad is coming out of this. I heard time and time again Samoan my own people complained about pm and his corruptions and then over the years he's still the pm and he continues to change the country some good but I think theres more bad and this is one of them. Its getting outta hand he has too much power this needs to stop and its gotta be now.

      it is fair. it partially be call debt repay to the CCP. Samoa rack up toooo much debt with CCP. NOW LOOK WHAT HAPPEN! Our own Samoan government is willing to sell the land to foreign and CCP investor, all because we like to rack up toooo much debt eh!     Part Three
    Samoa’s PM Malielegaoi crowns himself Sa’o of all Aiga and Fanua using the three new Laws.
    First, he appoints judges, who will do exactly what he wants.
    Secondly, he uses his political party to pass laws to separate the Lands and Titles Court from any supervision or appeal to the Supreme Court or Court of Appeal.
    Thirdly, he frees his judges from the duty of fairness, as understood in English law, giving them a complete discretion to do what they think is right.
    Fourthly, he bypasses parliament and public opinion by empowering judge made law relating to Lands and titles, which cannot be appealed.
    Fifthly, he creates a system whereby he can ask for rulings on issues affecting lands and titles. Their answers will be binding on all aiga thus becoming law, which has bypassed parliament or any duty to consult those affected or any opportunity for disagreement. As he is a dictator, he will use these pet judges to rule all aiga and crush all aiga who oppose him. Section 11 of Article 104C. Land and Titles Court of Appeal and Review (as inserted by section 7 of the Constitution Amendment Bill 2020)
    The Judicature Act, Judicature means administration of Justice or Judiciary, is used to set up the independent Land and Titles Court structures.
    Under the new court structure of an independent Land and Titles Court decisions will be made using the following principles:
    Article 104A. Land and Titles Court as inserted by section 7 of the Constitution Amendment Bill 2020:
    (5) In particular the Land and Titles Court shall have jurisdiction:
    in all matters relating to Samoan names and titles;
    to make orders or declarations in respect of Samoan names and titles as may be necessary to preserve or define the same, or the rights or obligations attaching to those names and titles in accordance with the customs and usages of the Samoan race and all laws in force in Samoa with reference to customs and usages;
    all claims and disputes between Samoans relating to customary land, and the right of succession to property held in accordance with the customs and usages of the Samoan race;
    in all the powers that are inherent in a Court of record; and
    as may be conferred by Act.
    (6) In all matters before it, the Court shall apply:
    custom and usage of the Samoan people;
    the law relating to custom and usage;
    this Act and any other enactment expressed to apply to the Court.
    (7) The Court shall decide all matters in accordance with what it considers to be fair and just between the parties.
    (8) The English common law and equity of England does not apply in the Land and Titles Court.
    104C. Land and Titles Court of Appeal and Review:
    (11)The Head of State, acting on the advice of the Prime Minister, may refer to the Land and Titles Court of Appeal and Review for its opinion any question as to the interpretation on the effect of any provision of this Part which has arisen or appears likely to arise, and the Land and Titles Court of Appeal and Review Court shall pronounce its opinion on any question so referred to it.
    Remember that there has been no consultation with our people or explanation as to why the removal of fairness or equity is required. Fairness is excluded in the decision making process by the statement that equity is excluded. Instead the warped views of pet judges will destroy the land rights of Aiga in favour of government puppets. Discretion without fairness will result in new depths of corruption.
    Once again such laws are a breach of the Westminster model of democracy and allow corruption through discretion of the judges and the demands of corrupt politicians with no independent standards to prevent abuse.
    Nepotism and Corruption have led to the appointment of government puppets in all government positions and the appointment of pet judges to produce desirable results and crush opponents and deny them justice.

    You see how Hawaii suffered and in return they are spat on and left angry? *NOT TU-DAY SAMOA... NOPE... NOT TU-DAY... mm mm NOPE.* We need to stand up and do something and I mean *LITERALLY.* Samoa needs to wake all the way up, take advantage of any knowledge and education we got to fight against these changes for the worse.     Like everything in Samoa that has the govts hand in it, it all comes down to money and greed. Only to find out the hard way in the end when you’re broke and left to look like a fool but it’s too late because our lands have already been sold out families forced into modern slavery and debt becomes a slow death for our people. We take care of our land not destroy cut it up and sell it. Our land has always been good to us it feeds us and gives us a physical foundation to build homes business and churches for our people. China has already influenced our motherland let’s not have them take it any further. Samoan lands for Samoan hands. Our ancestors fought and died to protect this land many moons ago against colonizers and now we stand amounts these lands today only to give it up. We must look and learn from our pacific brothers and sisters. Hawaii and Mauna Kea current day is being forced. They have been overthrown by the US decades ago. Aotearoa has been stolen from our Maori cousins and now they want ihumatao. Our own blood in American Samoa is a territory of the US and now they want to become a state and have citizenship. We must hold our own in this world. We’ve been thru hell and back measles, tsunamis, tropical storms etc. SAMOA ALA MAI. Look our own Rugby team was being robbed in front of our own eyes. We raised so much money but non of it went into the hands of our brothers, sons, nephews, cousins that play for the team. Pls Samoa we need to do better. If our sister island Tonga can do it, why not us? We are the power houses of the pacific not the govt. we never need the government we already had one. THE MATAI SYSTEM. Now being a Matai doesn’t hold as much weight as it did before.
