FYI - Kody Brown is listed on the birth certificates of all of Janelle's Kids.
The military life insurance policy does pay out for suicide. it's a massive misconception that life insurance policies are void due to suicide.

I was in the military. I had to designate who I wanted to be my beneficiary. I named my mom and not my dad. That is perfectly legal and there's nothing The Kodster or Sobyn can do about it. I swear, the nerve of those 2. It's staggering.
Exactly. Retired military here--- it doesn't matter who is on the birth certificate. It matters who Garrison listed as his military life insurance beneficiary-- and because the flag was given to his mom and not Kody, it would seem that SHE was listed first, and possibly as the only. He could have done percentage based beneficiaries, where one person is primary and another person or people are listed in varying percentages, but the family absolutely knows who he listed-- if it's 50/50 between his mom and dad or 100% his mom alone. Now the mortgage is a different story, that is based on civilian rules, but the life insurance doesn't fall under those same regulations.

💯 … when I joined the Army I had to dictate who my beneficiaries were. Husband is active duty AF and am the sole beneficiary. I beg of all of you… please get a life policy even if it’s only a term. It can make or break your family after an untimely death. Ideally get a universal index whole life.

Hey there! Gold Star Widow here. When my husband died, I received a large sum of $ from the VA in a few days without the DC. If Janelle is listed on the DD1300 Casualty Report she would have received this and may be using that to pay Garrisons bills.
Kody can try but he will not succeed. It does not matter if he is on Garrisons birth cert. The military paperwork will override all of that.

Az law says without a beneficiary or a will the parents are his heirs. If his parents aren't alive then his siblings are equally the next in line heirs
Spiritual marriages w a ceremony and document actually are legal marriage. You can legally take on your husband's last name.. Be on his work insurance etc Shacking up w no ceremony you have no rights to name change insurance etc.
Spiritual marriages w/ceremony and documentation may be considered legal WHEN THEY ARE THE ONLY MARRIAGE. Second, third, etc are not eligible. They are NOT legal. Janelle has NEVER been a legal wife. I do not know of a single employer who allows an employee to have multiple spouses on their insurance. One, yes. Four? Absolutely not.

Every member of the military is required to have a very specific will. I would assume his legal will would stipulate the beneficiaries.

Actually that is not true. They cannot make them have a will. Just the life insurance paperwork and beneficiary paper work....along with documentation that if the ultimate sacrifice happens, what their last wishes are.

My son who has been in the military for 25 years says all military have to have an updated will at all times.
That makes perfect sense being they could be in danger at anytime even during a training excercise things can go wrong . The military likes to have their affairs in order because it is a huge operation and they probably don’t want any confusion about anything concerning them . They like everything tied in a nice bow so when something does happen it’s easier on them and the family. They don’t need nor want drama . I just know the way he loved his mother and the contemp he felt for his father . I bet he set his mother up quite nicely and apparently was having thoughts about suicide and battles dealing with it . He was very smart in business and accomplished much in his short life . He had it together I just know it .

Whoever he has listed as his next of kin is the one that gets the flag so i am sure his mom is listed as next of kin on all of his stuff since she is the one that received the flag.
Incorrect. They can not make them have a will. After what I went through, when the guys came back from deployment, they heard the issues I had and got wills. It was a big discussion between myself and the commander

I know when I asked him about it yesterday, he told me what was most important that they have to keep up to date is their life insurance information. I hope everything worked out for you.

My mother passed away with no will. She had eight kids. My sister who worked in a law office doing just this, handled everything and we split it eight ways. Done. It was settled in less than a month.

I have been through this..Whoever is the beneficiary on his LIFE INSURANCE policy , gets 100% of THAT money .

I second this. My dad forgot to remove his ex-wife as his beneficiary. So when he passed since the divorce papers remove her eligibility of being the executor of his will It was passed to me. However that doesn't apply to life insurance and she received all of it and I got nothing. I had to pay for all his cremation out of pocket because she took it all and I had to wait for probate court to be able to sell his house to even recover any of it.

Yep absolutely.....I went thru something similar when my grandmother died in 97. She left my grandfather (eventho they were divorced) a small life insurance settlement that was meant for my college fund ....She had Leukemia and wasn't thinking about an older policy she took out with his name still on it. Eventho they were separated etc my grandfather got the policy and never gave me a penny of the measly $25k....Needless to say ppl get weird when $$$ is involved....and I never could afford to go to pre-med school or any college for that matter....😢

True... But without a will that can contested. And usually it's them PD out according to state law concerning heirs. Which is AZ are his parents. He prob would get half thru the civil court if he contests it. States usually veer in favor of what the state law says because contested probate issues are messy lengthy and unnecessary actually.. We can't put a dollar AMT on it kids lives.. It's blood money basically so arguing over it seemsc senseless
@@kaydeedid the military ensures your will is updated at all times. There are no exceptions to who is going to get what the military holds for you. Items of the estate can be contested like the home.
@@kaydeedidno. Military insurance goes to the listed beneficiary. No will is required. A will is for his assets. If there is no will, probate court will determine who gets his house and other assets. SGLV insurance goes straight to the listed beneficiary. I was in the militarybforn28 years and the last half I worked in personnel and processed many, many updates of these forms when processing soldiers for deployment.

I can hear Janelle's attorney to the Judge. Janelle, was an unwed mother, who never received child support for this Young man or any children. At one point the mother had to live in a travel trailer with a biological sister. This dad also ignored and publicly humiliated his son and threatened him. Too the point he even demanded that the mother kick his son out of his mother's home during COVID, a home that he did not live in, and made no financial contribution to. Further more when the father was contacted by the young mans family to come to the scene he refused. I find it despicable that now that there are assets he wants his rightful share. PLEASE consider this when making you decision. I rest my case😊.
I've feared since shortly after the news broke that a contribution to Garrison deciding to end his life was Janelle crying on the show that she's in her 50's and has nothing, no assets, no property, and is "stupid" for getting herself into the mess. I know there was probably many other reasons, but Garrison admitted that he has a savior complex (like his dad), so he may have wanted to help Janelle out of the financial hole. If so, that proves that this show does real harm to these people, the money isn't worth it, I hope they wake up and save their next generation of kids from this TLC exposure. 🥺

It’s no secret how distraught Garrison was about the downfall and destruction of the family. He even openly discussed his belief that Kody’s actions contributed to such. If he were to fight this, in my opinion it would be unforgivable, undignified and offensive. I’d say, how could he that callous? But we all know…. He is utterly lacking sensitivity. RIP Garrison. 🕊️❤
Being in the military I’m sure he has a will & he would have declared who he wanted to be his beneficiary of his death benefits.
For life insurance, if he selected the full amount it would go the beneficiary specified. However the military cannot make the members have a will.

@karismakris is true, but he may have a super low interest rate since he bought it during that 2.5% era. To me, it's just a matter of morals, Cotex cut the boys off and insisted that Janelle throw them out as soon as they turned 18. Truth be told, the way he treated his wives and children had a lot to do with Garrison's depression and his state of mind. The idea that he profit off of his son's death when he did him like he did, is repulsive to me.

I hope Garrison chose LOGAN. The true "Man of the House" and surrogate parent to many siblings. Janelle can get her head messed with by Kody and is emotionally vulnerable right now.
I think that Janelle can easily prove that Kody is the last person that Garrison would list as the beneficiary. He stated where things stood on National television. It’s in the police report that Kody and Garrison were estranged. It would make my heart happy if Kody doesn’t get a dime and loses a lot of money trying to fight this. Most insurance companies pay for suicide but the waiting period is usually one to two years.
I swear to God if Kody even glanced sideways at ANY money, property, that Garrison had that would be grounds for murder. And I am so damned serious about that!!! That would be the ULTIMATE betrayal to the memory of his son that I feel Kody was the last straw to this poor man's demise. Anything that belonged to Garrison now belongs to Janelle and no sane person, knowing the circumstance, would dispute that not even KODY!! RIP Garrison.

Whoever is the beneficiary of the insurance get a everything from that policy. NO ONE can touch it, but them. With or without a will. The beneficiary is not required to pay any debts of his or anything else. The house can be foreclosed because it would stand for itself. The insurance benefits can not be probated either.
That is true. I recently met with my attorney to go over my will. I also had banks issue a pay on death clause for my accounts to keep them out of probate.

Thank you for clarifying that the policy does cover these circumstances. There are a lot of insurance policies out there that limit suicide. In some cases, it is a period of time to prevent someone from taking out a huge policy with suicide as the intention. I have also seen it listed in other policies. I'm glad his covers it. I think its a terrible practice to have families left with nothing.

Since he was military related, he most likely has a power of attorney, and some kind of will drawn up through them. We had to update ours anytime we did training or deployment.
Power of attorney is null and void upon death. Also will are not required. They cannot make them have one.
In my opinion, Cody doesn’t care about Family. He cares about being the boss over everyone. That’s his motivation and he’s losing.
I would be surprised if Garrison didn't take care of all this. He was a smart man.

Hopefully, when Garrison filled out the beneficiary for his life insurance policy, he named his mother. Considering that he had been s*icidal, it would not surprise me if he made sure that Janelle was listed and not Kody.

OMG! This is so .... "legal"!! I begged my son to "put a name on it, any name, I'll honor it" never thinking my Alex would pass before I did. My son lived with me, but anything not labeled with a beneficiary had to be split with X. I'll spare the details, but God love Janelle, THIS is too hard!! Too much to expect of a mom, who KNOWS how things were with paternal dna, sigh. One true thing; take a picture, it WILL last longer and be ultimately more important to your soul.
