I'm South African filmmaker, busy writing a courtroom drama/crime film - and two of my attorney friends have never heard of torts. Apparently SA don't classify assault and battery as well as trespass to chattel. I do like this explanation however, it seems more logical defined. Thanks!

Thank you for the exciting video teaching the differences between torts and criminal procedures. I've been trying to litigate a tort claim against a certain municipal police officer and department and city. At the end of this video, you discussed the topic of sovereign immunity. Then you went on to express that these government officials and police officers somehow have some buffer to their liability. After filing previous torts as well as the current case that I've been consumed with for a few years, I have discovered and examined these ideas of "qualified immunity", "diplomatic immunity", and "sovereign immunity". I think I am not alone in my frustration over this concept of the worst people in a society trying to hide behind some "principle" especially when it is essentially a made-up doctrine. It is my firm belief and understanding that "We the People" are the TRUE sovereigns in America. We shook off the yoke of corruption and unjust leadership and purposed to establish a "more perfect union" consisting of a "government by the people, for the people, and of the people". So, what dirty politicians decided that "they" get to stratify our society and elevate themselves to a position of "sovereignty" over and above the rest of our society. Anyone who gets themselves into a public office of trust should expect to be held liable... unless we DO NOT have the rule of law governing our society. "Good enough for one, good enough for all". So, essentially, would you agree that just like these lying, conniving, corrupt civic leaders get to claim some degree of sovereignty...that I and everyone else in our great nation are entitled to the same protections from liability? In fact, this evil separation of the government from the people and the development of a ruling class are the only enemies that can destroy the foundational pillars of a law-abiding society. Is this not evidence that the intent of ANYONE that chooses to hide behind these FAKE legal constructs knows that they are violating the good faith and trust of their appointed position...they are the opposite of immune. The immunity they imagine can only be an imagined immunity, because if it is real then WE THE PEOPLE have already found for ourselves our new kings and queens that like to put on costumes and play their games in OUR courthouses. As a SOVEREIGN, I declare, "NO MORE FAKE GOVERNMENT!!!" These treasonous usurpers of our rights, freedoms, and liberty should not only be deprived of the pretend protections that these 'immunities' might have afforded them, they should not enter into offices of public service without an expected assumption that their behavior and performance of their duties shall be above reproach from all possible violations of personal and official conduct. The people, in no manner, can or should ever be held up to a higher degree of scrutiny than the people our society has put into positions of trust. Any violation of the public trust while in a public office should be rooted out and burnt upon the altar of democracy. The people should fight back against this and any other form of tyranny that affronts our freedom and good senses. The only obligation of a civilian is to ensure that the citizens are doing their official duties rightly and true. When we cease to enforce the LAW on the government employees, then we have lost everything that is worth fighting for and the experiment is over. The American experiment looks mostly dead to me already. Most of the idiots here still believe in rights, freedoms, and democracy. I think that it only is as real as each individual can muster for themselves an undying adherence and accord to put the pressure on anyone that would deprive US of any protection only to deter the liability of their sociopathic tendencies. Pressure up to the point of death, if they do not concede and correct their foul course. 2nd amendment. And, if anyone intends to block me on social media for expressing the purpose and intent of the 2nd amendment of the Constitution of the United States of America, just know that you are simultaneously painting a bull's eye on yourself because YOU are an enemy of me and fellow Americans. This unfortunately is war. The war that some greedy minority of power-hungry, grown children have decided to wage against the people that constitute our American society. Stop conceding to their presumed authority, most of them hiding behind these immunities are the ones that we must target and eliminate from public influence as quickly and concisely as possible. Wake up, people!!!

What is the difference between suing someone in their "official capacity" vs their "individual capacity" vs suing under both. I'm reading all these case with all different people doing one of the above or sometimes both. I also understand that in many states, suing under state Tort Claims Act, there is really no remedy vs Suing in Federal court, if there is a federal question involved, punitive damages, etc apply.
