"A bill making its way through California’s legislature would stifle free speech on public university and college campuses, specifically around protests against Israel’s war in Gaza and its occupation of Palestine, according to civil rights advocates.
As state lawmakers head back to Sacramento for the final stretch of the year’s legislative session, which often ends in a flurry of last-minute votes in mid-September, the American Civil Liberties Union in California is ringing the alarm bell on Senate Bill 1287, saying that it will “set a dangerous precedent of chilling speech on campuses across the state.”"

Any restriction of the 1st Amendment is illegal: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."

Everyone has the right to protest peacefully but these protests were getting out of hand. I’m not surprised this bill came into being. They have abuse the freedom to protest not all Palestinian protest were bad, but they had a lot of bad actor actors who were doing stupid things and causing a lot of pain, anguish and destruction. I’m not surprised a bill like this was drawn up.

I read the text of the bill. It really comes down to how each college is going to interpret and apply definitions to certain concepts. This could be a nothing issue, or it could be disastrous for free speech. I think that's why the ACLU is concerned. It has the potential to be disastrous, and very likely will be applied unevenly at the whim of administrators across colleges and universities.
This is so reminiscent of Supreme Court justice Potter Stewart.
In one of his more well-known opinions in the obscenity case Jacobellis v. Ohio (1964), Justice Stewart famously said that while he could not readily define the term “hard-core” pornography, “I know it when I see it.”

Wouldn't creating "safe spaces" be creating a hostile environment against whatever activity it was designed to provide "relief" from? I think this bill will be found unconstitutional if it passes, but something must be done to prevent the kinds of harassment that, in this case, Jewish students faced after Israel was attacked by the Hamas terrorists and then responded to the attack as an act of war. American Jewish students had nothing to do with the decisions of the government of Israel and should not have been attacked on their campuses.

Maybe you should ease on the apartheid Kool-Aid. The protestors (which include many Jewish students) set up encampments to call attention to a humanitarian crisis funded by our tax dollars similar to what was done during the South African Apartheid and the Vietnam war.

Its their campus so it should be private property. So their rules apply, and if you break them you will be scored out of campus. Having a space for learning without people shouting or causing trouble is a good goal. But what is the cost? There are already laws against trespassing, vandalizing, kidnapping, holding someone against their will et. etc. Peaceful protest is seldom peaceful, especially if there is a counter protest. But these bills goes both ways. this could stop anything that could potentially have political meaning. Speakers could be stopped if what they said would be deem as controversial. Conservatives like Shapiro Matt Walsh could be barred. Abortion events (pro or against) could be stopped. Its a very flexible rule and could be used against anything.

The question is whether free speech applies as much on school grounds as everywhere else. The left has its own limitations on speech through speech codes, as the P&T:BS episode about college pointed out. So neither side is on solid ground to pretend colleges can’t punish you for saying on campus what you couldn’t be prosecuted for saying off campus.
Mind you, I have my own objections to this policy; namely that it tells you how weak the case against these protesters’ message is when their detractors resort to stifling them instead of welcoming it as an opportunity to refute them; but to pretend free speech protects your right to an education no matter what you say on campus as to your right not to be arrested for what you say off campus is preposterous.
