If he's gonna be punching cars while moving then he shouldn't expect much sympathy from police. They can argue that punching a car while moving can make you lose your balance. I would never dream of punching a car while riding my ebike.
@yvonq.9346 They’re retarded mate. They’ll happily take them on hiking trails but can’t properly use the facilities provided. We not as lucky around where I live. We don’t have enough.
I drive a lbw van. I “picked up” a cyclist just after I let home today. He was riding quite swiftly, between 20 and 25mph. He seemed to be going the same way as me so I was happy to shadow him as the road was busy. I shadowed him for two miles before I deemed it safe to overtake him, safe being 6ft in my book. He was aware that I was there and probably realised I was holding back because of the length of my van. It cost me probably less than a minute in total lost time but better I lose a minute than lose him a lifetime.
@@dappa9996 Cars kill people, bicycles rarely if ever do. They are not required to follow the laws that cars are; for bicycles it is guidance, like how if a pedestrian crosses when it is safe to a cyclist can do the same Of course there are plenty of cyclists that aren't safe about it but then that only leads to trouble if both car and cyclist aren't safe about it. Put your ego to the side mate. Maybe it might be a slight inconvenience for you, which you can easily make up, for them there's far more on the line
Definitely not an accident. When you intentionally try and punch a moving vehicle that takes a degree of thought and planning. The resulting loss of balance from doing so and consequently falling of the bike is purely your own making. Anyone knows that a lateral punch will transfer your centre of gravity (not recommended on a bike) Nothing about this is accidental and the injuries and damages incurred are of his own making. The police came to the right conclusion.
@@BotheredNowUKAUDITS yep she provided her details was assertive but not aggressive. He threw the punches and verbally abused her. Yep she’s the policewoman alright.
Car driver 100% in the wrong, didn't even ask the bloke if he was ok after being run off the road, unbelievable! This is the old story of coppers sticking together which is a real problem in the police force, its actions like this when the police dont uphold the law and have a biased towards their colleagues that lead to problems. Sometimes huge problems, it was a sticking together mentality that let that Wayne Couzens remain an officer when he should of been dismissed a long time ago.
An old authoritarian trick: when you know you have done something wrong, go on the offensive and blame others for the wrong. Bet she learned this in the police force.
Yes. Victim-blaming at its finest on display. I expect she has no road awareness anyway (from what we've already seen, also with all those decals blocking vision through the rear windows. She just has no concern at all for his safety. With that attitude, the Guinness rugby shirt, and obvious lack of driving nous, she ought to have been breathalysed. It is well known that police officers are recruited for low IQ too - just to follow orders unquestioningly. I wonder why she felt it okay to park on double yellows and then conduct a conversation in the road instead of on the pavement. Actually, the cyclist was almost as bad but edges slightly ahead on his moral high horse. Whenever there is an accident I believe the accident is meant to be reported immediately to the police for them to attend. And usually it is stipulated on the insurance policy to notify them too. So her refusing to give her details shows contempt for the law no matter what her godforsaken point was she was trying to make. It's because of these types of road users that everyone's insurance premiums go up. She wouldn't have driven like that in a driving test or she'd have failed by major faults. It's time she should have her license revoked and ordered to take a re-test.
Yep, such as in this case, upload video evidence of blocking the road and deliberately smashing a bike into someone who infringes on the divine right to block the road after they overtake. And have the effing gall to commit slander by claiming it's something else.
Nope, it's as old as Adam and Eve in the Garden of Eden. "The woman YOU put here with me-she gave me some fruit from the tree, and I ate it.” “The serpent deceived me, and I ate.”
True. She’s guilty of assault, but also dangerous driving. Typical ex police behaviour. Typical police behaviour. Lying, protecting their own, and failing to uphold the law. The cyclist should get in touch with Iain Gould- Actions Against the Police Solicitor.
Cheshire Police Force should be ashamed of themselves..... that is not how to deal with this case..... but a police officer doesn't blow the whistle on another, right? Ex or not don't matter..... like in this example..... what a disgrace for a police force....
Cheshire Police endorse their officers committing serious perjuries to initiate baseless criminal prosecutions. As dishonest as any / the worst criminal gang. It has the same morals as a vet shooting local pets with an air-rifle to generate trade for their surgery.. Old police habits clearly die hard for this ex-officer. The ex-officer clearly believed that she had ownership of that bit of road, and was quite happy to enforce this.
She's an absolutely horrendous person. The cyclist did nothing wrong. She ran him off on purpose. And she completely incriminated herself, but police don't care.
go to specsavers............ Cyclist veered right slightly to punch the car and it was then that he was knocked off. . The cyclist could have moved nearer to pavement once cycle lane ended. The cyclist sped up to race past the car instead of slowing down or move over and not be dumb by risking what could have been a much more horrible chain reaction of accident by other motorists coming up the road. . Now that we pointed out the cyclists faults and options, lets start with one main thing not mentioned... HOW could the car driver have recorded cyclist on impact unless she had phone in hand whilst driving ??? but in reality all she had if there was dashcam would have been the cyclist using the road he was allowed to in front of her and the cam would show her veering over towards the pavement before getting by and being clear of the cyclist. . BOTH did wrong
I'm extremely confident she is an Ex-Police Officer. It's precisely why no action has been taken against her. I'm sorry to say. That when a Police Officer finds themselves in the wrong. It's often the standard procedure for their colleagues to close ranks and protect them. It's an unwritten code of the profession. Officer's who risk not complying with that code. Risk being alienated from their colleagues. The IOPC is also complicit in this unwritten code. And as a body that investigates the conduct of the Police, it's a joke. As there's that's actually very little about it that's independent of the Police. Given that the majority of complaints made to the IOPC are actually investigated by the Professional Standards Departments of the actual Police Forces the complaints are made against. With only very minimal oversight by the IOPC. In other words. It was almost certainly also Cheshire Police who investigated and ruled on his IOPC complaint against Cheshire Police. He rightfully succeeded in his insurance claim. Because that's the one part of this whole affair. Over which this Ex-Police Officer and her ex-colleagues at Cheshire Police had no influence or power over. He still has an option left available. If he's willing to finance it. He could seek a private prosecution of endangerment and assault against the woman. There's extremely little her ex-colleagues could do to protect her against that. She'd be on her own. As private prosecutions are conducted and decided upon entirely by a Magistrate. I'm not a lawyer. But with the evidence he has. I think he'd stand a good chance of succeeding in a private prosecution.
interestingly, I had a casual conversation with a local police officer recently in which I specifically asked the question of whether one person not perfectly following the law gives another person the right to run them off the road and he said it didn't. maybe the rules are different in the UK.
Probably is ex police, the words “you’re being difficult” is a classic police line when you don’t do what they want you to do. They are protecting their own, that’s why it went no further

If I collided with a cyclist, knocking him to the ground, I'm pretty sure my first reaction would be ' Is the cyclist OK ?', not 'I must immediately accuse the cyclist of being at fault, irrespective of how badly he might be injured'. But then I'm not a sociopath.
It all started with the driver seing the cyclist not in cycle lane he probably didn't know at this point the cycle lane ends. So he thinks he not in cycle lane n taking the piss
Then again, you've probably never had a dumb roadrager block you in, and then deliberately smash into your left side after overtaking them. Pretty sure if somene 100% deliberately caused you criminal damage, your first response would be 'This dumb criminal is at fautl' instead of 'Is the criminal okay?'.
If I where a cyclist there's no way I would ride in the gutter, alot of motorists don't notice how deep the sinks can be in the roads and how bad the sides of the roads in the UK actually are.. But saying that alot of cyclists don't help thselves and make all cyclists look bad
At the end of the day they have the same rights and guidance as cars and your driving lessons teach you to be careful around cyclists and to give them space, I always give them 1m minimal distance, if I can not get that distance I stay behind them.. This probably comes from my motorcycle days.
Over here (netherlands) that woman would be liable for ''article 5'', which is the revoking of her drivers license on the count of endangering other road users with reckless behaviour.

Quite I was driving Netherlands 25+ years ago with a Dutch passenger and she told me in no uncertain terms that if I hit a cyclist whatever they were doing the police would assume I was at fault until I could prove otherwise (same for pedestrians). The blue wall is a real problem, police officers should be held to the same standards as other people, if not more since they are public servants and should be setting an example.
There is no legal obligation to use a bike lane, they are often unfit for use and certainly if your matching the speed of traffic " owning the lane" is the correct thing to do !
When she says “you were being difficult” to me that is her admitting she decided to “teach the cyclist a lesson”. Essentially assaulting the cyclist with a weapon (her vehicle). She shouldn’t be allowed on the roads. Also, any “police officer” would know swapping details after an accident is a legal requirement.
Sorry, but you can't have it both ways. As you said the car driver decided to teach the cyclist a lesson by using her car. She can't then claim damages when she caused the damage by hitting the cyclist with her car. If I were the cyclist I would have given her a mouth full, and carried on my way. There's no accident here, she did it deliberately; so why swap insurance, not that the cyclist would have any.
Karens and muppets everywhere my wife would say. Ex policemen are the worst for calling their old mates on the force and getting it smoothed out under the table so-to-speak. There is a very powerful unwritten rule within the force where they will go to great lengths to defend their associates, even at the risk of being seen as wrong, or showing bias. This type of behaviour has to stop, in the real world when you make a mistake, regardless of who you are, or have been, we should all be prepared to admit that mistake and make amends.

All this is, is criminal damage from deliberately slamming into the car after she overtakes the roadrager and he's like "My blocking of the road failed! Revenge!!" Being Dutch and both a driver and cyclist it's so sad that something that looks more like a narrow gutter is seriously considered to be a "cycle lane".
@Craig McL That Sound like it's even more dangerous than drive between the cars. Cycle lanes here are very good and maintenance is too. But even on streets without cycle lanes it's safe for cyclists as all the cars are aware that the cyclists are there and they take cyclists into account as equal road users.
Most cycle lanes in the UK are awful, especially if you cycle on a road bike at around 20mph. Never mind that as soon as you enter one cars think they can pass by a few inches from your handlebars because the white line on the road says it is ok.
The whole UK Cycling initiative was badly thought out..it will always cause Friction and stress to Drivers and Cyclists...Cycle lanes are great when they are properly separated from Roads... and in those narrow Gutters there is often Leaves ,Manholes and Drains... and other Detritis which makes them unsafe to use .
You should see the size of the parking spaces. Try getting a large car in one without a) hitting one of the cars in the spaces to the left and right, or b) going over the lines of another space, and c) having enough room to open your door a decent amount without hitting the car to the right.
@@rogueuniversities6866 That problem exists here as well. New parking lots will probably designed to the sizes of todays cars but we have a lot of older parking spaces too. My neighbourhood was built in the early seventies and parking spaces remained the same but cars got bigger and bigger.

As soon as she refused to give me insurance details would be the second I was on the phone to the police as refusing to give insurance details IS a crime under Section 170 of the Road Traffic Act.
The road traffic acts aren't laws. Acts and statutes are only given the force of law with your consent. Remember, covid, when you said you was exempt from wearing masks, and they couldn't question you... this is the same principle😂
Unfortunately you are half right. It says where injury has occurred, an insurance certificate or proof of Insurance or exemption must be produced, IF NOT the accident must be reported to the Police Within 24 hours. She needs taking off the road before she kills someone. Wasn't aware the cycle lane had ended and doesn't seem to think that if a cyclist can punch your car it means you are too close. The response from the police is shocking but I can't say I am surprised.
why was she trying to get around him anyway when he was keeping up with the flow of traffic. She also have a massive case of "must overtake syndrome". If he was a motorbike going at the exact same speed she would never have bothered. Some people are crazy, they think them getting to their destination 10 seconds sooner is more important than someone else's health and wellbeing. I hope this video changes the police stance as it will reach lots of people and make them look very bad and very crooked protecting their own
The urgency to overtake has actually cost her more time having to pull over and try and justify her actions. Hopefully her premiums have now gone up significantly for the next 5 years.
It's also funny because at this traffic speed he would have quickly overtaken her. I ride a motorbike and it even happens with me that I overtake a cyclist and lo and behold 5-15 seconds later I'm overtaken either because of a red light of slow traffic that I can't pass.
Not true I have this happen on a motorcycle and seen it happen to another motorcyclist cars are fucking crazy. Car drivers just see anything less than a car shouldn't be in their way.
The traffic was indeed moving at the same speed of the cyclist. There was no real advantage in getting past him. This has also happened to me several times with drivers getting past me dangerously just to stop a couple of meters later at a traffic light. In these situations I just back off as I couldn't bother confronting such idiotic people and I could really get hurt if they got angry, as these kind of people often have anger management issues, and might try to hit me on purpose.
It's similar to learner cars, some drivers see them and make it a mission no matter what to get past quickly. Often leads to accidents. No thinking ahead of whether they even need to.
The root issue here is the car driver’s sense of superiority over the cyclist. The police comment that the cyclist should stay out of the way is just plain wrong. Fortunately the highway code has updated to address the fallacy that there is a hierarchy of road users. The car driver was absolutely in the wrong because she failed to show proper consideration for a more vulnerable road user. The lack of action by the police in this case is a serious failure. We all have a duty to protect each other on the roads.
The police response tells me she was a copper, they always close ranks even in retirement. The police IMO need a MASSIVE reform they are at this moment in mentality and reality just the biggest gang.
There's not a week that goes by that another police officer is in the papers for rape, murder, animal abuse or some other horrific crime. The cyclist really needs to take this much further. Get the press involved and make a complaint about the police officers involved. The actions of the insurance company should work well in his favour. I agree that this was, most likely, a deliberate act of assault. There is no way that she has 'nothing to answer for'. Personally, I feel that woman should both face jail time for her actions, and permanently lose her license. I also feel that the officers involved should be criminalised since this is, obviously, corruption.

Both are actions taken from a position of power, and this is why sociopaths have such a greed for power, and try getting to such a position at any price. To a sociopath, power is the road to always getting what they want. You bet 100% that this "accident" was done on purpose. Whenever a sociopath feels that they can hurt another person, whether it is emotionally or physically, regardless of whether the other person ever did anything to them, their secret anger issues come out, and the only reason she needed to deliberately strike the cyclist is the fact that she can. This rage was only aggravated by her sense of entitlement to think that she would have a right to claim the cyclist's place on the broad lane. But I have seen enough examples of rage where there wasn't even have a hint of provocation. It happens all too often, and too often it is sold off as "normal" when in fact, it isn't. Sociopathy is a *disorder*, and nobody should need be governed, commanded, or otherwise harassed by a disordered individual.

Whilst the manoeuvre itself was awful I have to admit I'm even more horrified by the complaints procedure afterwards. That's assault and on the face of it this looks like cronyism at its worst with the police complaints procedure as crooked as a banana republic. Unfortunately thats typical of the police. They love to protect their own. There are police who get off with written or verbal warnings for much more than this, and so I am genuinely not suprised by the result. If I was the cyclist, and I had the funds or could be bothered, I'd bring a private prosecution against that woman, which, in this case, I am sure with a decent lawyer or even a barrister, he would win easily.

Two traffic sergeants giving their opinion without an appeal route doesn’t seem that impartial to me. A formal review by another Police force or an independent Police body would be a way forward.
Insurance settles all the time. If one side is a bellend company and flat out refuses to pay despite the video proving it was criminal damage and the bellend roadrager deliberately slammed his bike into the car, there's not much your own insurance can do other than go to court, which costs a lot. So whenever court costs would outstrip the unfairness of the settlement, they settle. And a roadrager scratching one panel on a car like that, isn't very expensive. The problem is the police refusing to charge the cyclist with criminal damage, despite it clearly being an intentional crash because he felt his divine right to block the road had been infringed by the driver. Also for the cyclist. The next victim he decides to slam into may not be as levelheaded and decide to make some highspeed introductions between the bellend cyclist's head and the pavement to see if that can beat some common sense into him. It's that sort of entitled criminal behaviour how people really get hurt on the road, so the cyclist should be charged to unlearn this behaviour.
Those narrow cycle lanes in the gutter are a danger. They encourage cars to pass way to close to cyclists and lead to road rage, like this, when the cyclist take primary position. And for the record, I'm not a cyclist. It's just that I'm now at an age were I see a lot of stupid.

As a former traffic police officer in my opinion the alleged ex police officer is at fault for trying to cut into the cyclists traffic lane from the right when there was no space for her vehicle to do so. There wasn't any cycle lane as it had ended prior to her poor attempt. For me it's Section 3 careless/inconsiderate driving against her and the footage clearly shows the collision to be her fault. The investigating officer is wrong imo.
She was a police officer tells you a lot. What about the Highway Code 1.5m safe space when overtaking a cyclist. Maybe this doesn’t apply to police officers.
The way Cheshire police and iopc handled this case was appalling and makes me think that the old bint was X copper and just goes to show how the police can be corrupt when protecting their own.
I find it interesting that she says "There was a bike lane there that you weren't using" as if that's some kind of justification for knocking him off the bike. Whether there WAS a bike lane or not, and whether he SHOULD have used it or not, are irrelevant. Still doesn't excuse her.

sadly most people do this at cyclists, park up on curb's at traffic to prevent filtering. Swerving at them on overtakes to force them to stop. And some will flat out slip you and drive off. Speechless! I am a lifelong competitive cyclist, on flat roads my average speed exceeds 20mph, I am sick and tired of being told to get on the effing cycle lane or path. A lot of cycle lanes are not fit for purpose and there are lots of reasons to not want to use a cycle lane and often cycle lanes that are perhaps appropriate for leisurely cycling are not appropriate for a road cycle due to bumps, cracks, debris, obstacles, dropped kerbs or simply the end of the cycle lane coming up anyway. Late reply but as a hgv driver and car driver I have always disliked some cyclists attitude, that is, until recently I decided I would cycle to work, what an eye opener, I’m way more patient and allow more than the minimum safe distance, however I also try to make it easier for traffic to get around me. An example would be when there’s no way they could get around me safely rather than forcing them to sit behind me at 15mph ish, I will nip onto the path to allow traffic to safely pass then move back to the road, unless of course there are pedestrians. SOME cyclists cause themselves issues, MOST car drivers cause everyone issues and the occasional HGV driver should not be driving a HGV. He had an entire bike lane to himself. He was also incorrectly commanding the lane when the bike lane ended. He should have been in the middle, not to the side. Since he was at the side, he was indicating that cars can pass him, which is common practice. Once he noticed the car coming to his right he should have moved over to the left.

This has also happened to me several times with drivers getting past me dangerously just to stop a couple of meters later at a traffic light. All kinds of stupid :(
It's similar to learner cars, some drivers see them and make it a mission no matter what to get past quickly.

Why if the cyclist was in the wrong did the insurance company settle. Serious questions have to be asked and police officers held to account here.
'zactly
Unfortunately thats typical of the police. They love to protect their own. There are police who get off with written or verbal warnings for much more than this, and so I am genuinely not suprised by the result. If I was the cyclist, and I had the funds or could be bothered, I'd bring a private prosecution against that woman, which, in this case, I am sure with a decent lawyer or even a barrister, he would win easily.
@@brad7943 You constantly hear "you will always get one bad apple in the barrel" Aye perhaps, but that doesn't wash when every other apple covers up for it.
As a cyclist I agree, that bike lane looks way too small to be safe, it just shouldn’t be there

As a cyclist my view is driver did not give enough space. Also as a cyclist I see the car to my right and have enough room to move to the left to prevent an injury to myself.
I would not choose to thump the car which may then cause me to fall! If I have time to hit the vehicle I have time to move away from an inconsiderate driver. Newton’s third law of physics! As you hit the car, you will be pushed away and fall…
As a driver - it is unforgivable to get that close where the road actually became two lanes. Both to blame for injuries.
She was at fault! The cycling lane clearly ended and she continued trying to take over the lane even when the cyclist was not in the wrong. I got knocked off my bike over twenty years ago and was left by the driver and had to drag myself and my bike over a mile to work. I had a shoulder injury, muscle damage, and as I didn't know then a disk problem. The police were informed but nothing was done. I have had to stop work and walk on sticks due to a back injury. My job was as a teacher/lecturer which I loved doing every day! Its hard somedays to get out of bed and I am now on high doses of morphine and various other medicines I have to take now for the pain. The driver is probably died now!
Also as he said there's no loegal requirement to use painted bucycle gutters anyway. Which is a good thing because they aren't safe and prone to just suddenly disapear without warning anyway.
Sorry to hear that. Sounds like hell. I used to love cycling but I've been put off by some of the terrible driving I've seen. I reported a close pass with video evidence a couple of years ago but the police must be busy because they haven't got back to me yet.
If you really are a teacher / lecturer then surely you can spell "disc"
No wonder there's a poor standard of driving when the authorities do nothing.
it's because they are Lazy ..... Now if the Cyclist had been one of our Diverse friends ...the car driver would have been sent to prison for the rest of her life

It was indeed an assault using a car. I just can't believe it wasn't persecuted.
*prosecuted*
@@musography6958 Thanks! I threw there my spanglish, sorry.
"I've been driving for 35 years"
Then he says he's been riding for years, then she has the audacity to say: "It's not a competition!!" Right.. so why did you feel the need to state, first, that you've been driving for 35 years??
The prime example of a Karen, if she really is an ex police officer, that's concerning
Not for the police it ain’t.
Adam : In fact it could be construed as attempted murder !
She just ran someone over, and starts yapping that her car got a punch.
And her overtake was useless. The cyclist was keeping the speed of the traffic ahead. She wanted to hit him.
He wasn't even holding her back... there was nowhere for her to go. It's incredible to me people, when in their car, feel like they're blameless and somehow allowed it injure other people. This here was a deliberate assault with a deadly weapon and this woman should be banned from driving and in jail.
Nowhere for her to go? How about the whole unused lane to her right? But no. She drove straight at the cyclist just to do him over. I know it would be illegal, but I would have been very tempted to smack her in the mush if I'd been him, especially as she was approaching giving all that claptrap.
Absolutely right, she looks and sounds like the typical uneducated and selfish driver that we all despise!
Yeah there like you say no point in her even overtaking at that point with so many slow moving and stopped cars in front anyway, and the cycle lane had ended. This was an delibarate attack no question.
Even if I thought a pedestrian/cyclist/driver was in the wrong, I’d have to be a right nut job to drive into them.
Have they done this before ?
I as a cyclist was once harassed by a car for taking up space on the road. I got angry and followed the car and when i caught up with it i broke its mirror and threw a rock at the window
Too many idiots use on the road. I have more close encounters with fellow cyclists ignoring lights and rights of ways as I do with car drivers. Granted the latter are far more dangerous but we should call out all bad road uaers
The female driver pushed the cyclist off the road on purpose!
She had the cyclist in front of her car. Then she moved parallel next to him on the road and pushed him to the side!
100% intentional. She knew exactly what she was doing with her car during this whole incident.
She also timed her assault to take advantage of the ever so slight increase in road width at the intersection; but failed miserably trying to execute the manoeuvre.
Where I stand is attempted manslaughter, The cyclist might have died through her actions. He should sue her.
Wasn't even room to get between the bike and the car in front. It was a manoeuvre to nowhere even if she hadn't hit him.
