So obviously the police must hv taken away the gun used to commit the murder and never returned it to Jane since he wasn't the registered owner. But we see in 6.06 that he took this 'Max Winter gifted' gun out of his safe and later killed Red John with it. Oh God I love the Mentalist!!!!!
Jane put the gun that he killed Carter with onto the table that he'd just been sitting at. It was Carter's gun that went missing, which was one of the major issues in the subsequent court case
I agree a different gun for Carter killing. If you watched 6.06 you know Jane kept this gun and box in his safe at his house and took it out in that episode and shot RJ with it in 6.08. I LOVE THESE DETAILS.. I knew he had to use Max's gun. Full circle

Whether this is same gun or not don't matter so much . Jane is kind of person who can have a rocket to kill Red John if he want. The gun in here I think indicate that Jane will seek revenge as same as Carter . There is no way Jane give up revenging and bring Red John to justice

He is the one, that understands him and even he is only a character in the background he made jane believe, that revenge will help and he gave him a way to do it

If you're walking home and thugs approach you, the routine is to just bend over and take it. Reminds me of an incident, a terrorist took some people in a cafe hostage in Australia. In the end, the police ended up going in after he shot a man who was a bachelor because he didn't realize he was too weak to wrestle him for the gun. Anyway, so the heroes came in, guns a blazing, shooting before they could see, and more than they needed to. They shot a woman in the leg, and oh, they also shot a working mother of three. They blew her heart out. Hah. Never let the media think for you.
I hope the show ends the way it should; not with another sappy and ultimately pointless redemption story, but dramatically, with Lisbon dying because she got too close to the "flame" of Jane (we all know what happens to people who either get between RJ and Jane, or people whom RJ thinks are precious to Jane), and with Jane finally exacting his revenge on RJ. Because, let's face it: if the child and wife that had been murdered had been yours, would you be satisfied with a trial? I wouldn't.

He does that to reassure himself that his anger was justified and what he was going to do is justified.
