    As a homeowner, why would you ever hand over the keys to your home before you have the funds. You have to be smarter than that.

    The closing is your last chance to not hand over the keys. The owner failed in his responsibility to protect his asset. If it looks like a scam, it is one.

      I don't think they were too concerned about getting caught. I think they wanted to claim "squatters rights" and drag the case through the courts while living in the house for free.

      The issue with this is that they can't be charged with theft or acquiring the property under false pretenses due to the perception of the seller. Now that they possess the house they would need to pay for the house. It's really that simple, just making an arrest before they have been given time to pay for the house or even resell the house shows they dont' respect these people's rights. This is common practice with investment firms forced into liquidity, and they would have to prove that the buyers of the house were bankrupt and could under no means meet the financial obligations which in this case, a single house, hard to do even if it's worth a million dollars.

    "I completely understand," the seller should have started, "as soon as you get it straightened out, have your realtor contact mine and we will reschedule the closing. However, you need to understand that in the interim, the house will be back on the market. Good luck ..." No instrument of payment in full, no closing and no turning over the keys.

    Im just amazed that those two people somehow thought that scam would work.

    As soon as they said "For sale by owner", I physically cringed. Realtors are valuable, even if no one else realizes it right now.

      Too bad that they are greedy A holes. If they were honest, they would charge a flat fee and not a commission based off of the price of the home. They don't do more work on a $200K home that they do on a $700K home but get tens of thousands more in commission. It is a racket.

    Surprised they did not declare they are squatters and therefore allowed to stay for years before you can get them out. Likely there ploy was to stay at least a year believing rightful owners would take them to court for eviction which can take a year or more.

    If the buyer does not have the funds at closing, then delay the closing. If the funds have not been put into escrow before closing (and are collected funds at the time of closing), then delay the closing.
    PERIOD!!!

    I am fortunate to have a friend who is a realtor so I never have to worry about any kind of scam. She crosses all the t-s and dots all the i-s. This couple of perps were not too bright to think they were going to just live there and nobody was going to come after them for not every paying for the place…I hope the rightful owners of the home learned a valuable lesson.

    We bought a house and the closing was on a Friday before Labor Day. We had proof from the bank that funds on our end were available, and they had proof on their end, so they let us get the keys early. Money transferred the day after Labor Day.

    This couple needs to go to jail for at least a year. This is felony grand theft. Never let anyone move into a house before closing. If renting, never let them move in before paying the entire 1st month's rent and security deposit.

    a very elaborate way to squat in a home, while providing the proof that they are there illegally. most squatters just fake a contract and move into a home, making the whole process drag out in court and without any real proof of a crime being committed which usually results in 6 months free rent and no charges filed. these people will be going to jail, and in much less time than typical squatters get evicted.
