  • The plaintiff says her neighbor’s dog dug a hole through their shared fence and bit her canine. The plaintiff’s dog required surgery, so she is suing the defendant for the bill. The defendant denies owing because she says there is no way her dog could fit under the fence.

    Personally rather pay three grand on a fence that will keep my pets contained and safe , while keeping others out... you'll find yourself saving on expenses in the long run...

    There is a product called dig defence that comes in varying lengths and depths that helps prevent such as this. It is an easy install and a bit more expensive than chicken wire, but Just sayin’ 🤷‍♀️

      Crazy how this had been an on going problem and neither would fix it until one of the poor pups got hurt. I believe they are both responsible for what happened not just one of them.

      The plaintiff did witness the act and the only one responsible is the person who allows her dogs to dig over and over and over! Of course the other side should do something to prevent another bite but this is the nasty neighbors problem because it’s her dog

    Oftentimes, animal cases come down to negligence on the owners part. It's never on the animals! Always the owners fault because they bare the responsibility, care and control.

      I agree. Also since 2005 Cesar Milan has taught us the dogs primary sense is "smell". At the first sign of fence fighting the litigants should have taken the dogs for a walk together, let them smell each other and they becomes friends forever. Peace. love and harmony thru socialization. 😃

    I can't stand when a dog is attacked because of a known fence issue and the owner says, "It's their fence, why should I fix the problem". Grow up and PROTECT YOUR DOG! This could have been prevented so easily and both sides irritate the h3ll out of me.

    I feel like the defendant didn't try to defend herself enough. Im not a vet so I know I'm just talking out my ass, but that did NOT look like a bite wound. I really think both dogs dig and that one happened to snatch his paw on something and got hurt.

      True but I like them so I can post some easy solutions. Since 2005 Cesar Milan's shows have taught us how to solve every dog problem. Obviously not enough dog owners watch the show or some other free dog behavior tutorial online.

    At the first sign of "fence fighting" both litigants should have socialized their dogs together by walking them 20 minutes then drop the leashes and they sniff each other. Their nose is their primary sense so it's not necessary for them to "see" each other thru the fence. They know each other by scent and are friends forever. Cesar Milan teaches this since 2005. 😀

    I mean the dog could get injured by sticking the paw in the hole. My own dog just impaled her paw on our fence and I am not suing neighbours bcs their dog is the one irritating mine 🤷‍♀️

    I don't understand why she ran next door, leaving her dog bleeding heavily, if she's an EMT why the hell didn't she stop the bleeding FIRST! then go knock on the neighbours door... I mean her dog was already out of the danger,

    JM ruled wrong on this. She should have split the bill. Both dogs were to blame especially when they were doing what dogs do best…which is DIG! And the plaintiffs dog could have injured his nail by digging too and his nail got caught on something on the fence or bent backwards from a rock in the dirt.

      True, but being a responsible pet owner means knowing your specific pets quirks or issues and preventing others from having to deal with them. They’re your pet, not your neighbors pet.
      But I agree that JM ruled wrong in this case. Different if the other dog dug so deep he ended up in the neighbors yard and bite their dog then.

    The dog's snout doesn't fit underneath the fence when the hole is dug from the opposite side. When a dog digs a hole it has a curve/slope towards it, the opposite side of the hole is more straight down.

    The nasty neighbor whose dog digs and behaves so aggressive needs to fork over money for yard repair and forced to install something to keep her dogs head out! I hate crappy owners and I think they need harsh punishments because the problem is anyone can have a dog yet many refuse to be responsible adults when owning one. My neighbors husky malamute broke in 3-4x when my Aussie was a puppy. Scared the shit out of me the first time because he’s massive and she was tiny in comparison. I’d let her out for the morning since it was cool and nice, come home for lunch to let her in for the day and see I had a massive second dog hanging out with my baby. I love this dog and he didn’t hurt her, he just wanted to eat some fertilizer I had in the garage but really he wanted in my house to be with me. His owners aren’t the worst but they basically abandon him in the backyard and rarely interact so it’s understandable why he’d want to move in with me. One of the times I came home he was scratching at the door to get in. Thankfully he didn’t want to hurt her but that’s rare for these situations usually. He’s since calmed down and I pet him through the fence and share dog bones when my two get one. The newer issue is several ppl on my street all have pitbulls that they blatantly allow out to roam and harass neighbors, attack dogs, I’ve seen them chase kids into homes, one broke into my yard unannounced and lunged at me when I stepped outside… I hate owners, they need to be punished severely as in jailed, dog removed permanently and heavy fines not just ticketed especially when they are repeat offenders. It’s not the dogs fault it’s they’re crappy owners but unfortunately it’s the dog that’ll pay the ultimate price if it threatens or attacks someone

    Most of these dog cases , it’s really how the litigants present their case . Could be won by either side.
    Main thing is one has to show that the other party was negligent.
    In this case, one can say that they were both negligent , and one can say the neither was negligent.
    It’s just a matter of how one presents the case , and who the judge deems to be negligent and at fault.

      I think you must have seen another case or didn't pay attention.
      The plaintiff had testimony from her other neighbour that the hurt dog wasn't a digger. She showed that the dog was hurt and received medical treatment on the day she claimed the insident took place.
      The defendants own photos showed they were placing cider blocks in attempts cover up holes under the fence.
      Then the testimony (which was highly likely to have been dictated to him by the defendant)of the grandson didn't match the obvious facts of the case, asserting that the defendants dogs didn't interact with the hurt dog is plainly a lie.
      Remember these low level civil cases, its just a preponderance of evidence that a claim of fact has to meet, and the plaintiff easily was well over that standard, and in fact the very obvious hositlity the defendant shows towards her neighbour, showing she has a motive to lie, and she made no effort to try and mitigate problem in past clearly indicate she was the at fault party.

    What bread of dog are they? A mutt. That was an obvious give away that they have some type of pit bull in them and she was trying to avoid mentioning that bread. For this case, it didn't matter. It's just kinda interesting how most pit bull owners don't believe that bread can be an issue just by their natural instincts and or that it's also the owner's responsibility to make sure that they're under control 'cause of these natural instincts. It was like she wanted to avoid that topic by saying that it's a mutt. That obviously didn't work, but it kinda didn't matter in this situation.

      What instincts are you referring to? Pit bull breeds (American, Staffordshire, etc.) used to be considered the nanny breed in England.
      I think most people with these breeds don’t outright say the breed because of the bias they have.
      All dogs are capable of biting and attacking. Little dogs and other breeds can be just as aggressive or unpredictable. They’re all animals.

    Putting up cinder blocks does not contests that my dog is a digger. It could be that I’m putting them there to prevent my neighbors dog from coming in my yard who HAS A DIGGER.

    Both should be responsible for keeping their dogs away from the other. If you know the other dog gets out frequently why not put up your own fence and stop putting the blame solely on them.

    How about this ..If you own a pet, LIKE A DOG, one species known to dig aka BEHAVE IN ACCORDANCE WITH THEIR NATURE....Let's just be loving pet owners and UNDERSTAND this can happen.     Ummmmm...... Why wouldn't you CALL THE VET IMMEDIATELY after you noticed your dog was hurt??!! That makes no sense....
    Owner: "My dog is hurt and bleeding badly! I'm going to run over to the neighbors and confront them. Then call my daughter over to see what happened. Then wait a whole day or two to take my badly wounded dog to the vet!!"
    Just stupid people shouldn't have pets!!

    But wouldn't leaning over the fence on a ladder to take a picture technically be trespassing, just like you can cut the limbs off a tree that reaches over the fence from a neighbor's yard right up to the fence line?

      There's a difference between cutting someone's tree that hangs over and merely taking a pic by leaning over. They wouldn't be on their property so no, not trespassing.

      @@Catloudan But cutting the branch by leaning over the fence would also not be "on" their property, but it's prohibited. Judge Milian has said many times that you have property rights from your boundaries on the ground up to the heavens, so leaning over for any reason is trespassing.

      Pretty sure she meant to take a picture of the hole on their own sides. If the dog was digging enough to hurt the animal you would see the hole on either side. So you wouldn't need to trespass
