When a litigant questions the relevance of information we want to hear it! The defendant is a nice lady and agreed with the judge’s ruling. Although by the plaintiff taking her to court the plaintiff breached the agreement. JM took the convenient way out by enforcing the written agreement.
judge shouldve award $800 of the $1000 back to the defendant. $500 for not keeping up half of her part of the deal, which was leave AND not sue the defendant. she left, and renegged on the sue part. and $300 as punitive damages for having the nerve and gall to cross out part of the settlement note RIGHT in front of the defendant and the police who were present during the signing of the note AND then trying to blatantly lie to the judge that she didnt read the entire thing.
The only thing the plaintiff had a legitimate complaint about was the air conditioner. I’m in a townhome and the upstairs is like an oven while the downstairs is cool and comfy. And why is she not allowed to have one when the other renter had one?? I once rented an old carriage house that had been renovated into a studio apartment. I asked for an air conditioner and they gave me a cheap portable that had to be filled with ice. It didn’t help at all. When I mentioned it to the landlady she took it to her room in the house to try out. The next day, I had a window unit that cooled like a dream. I was a bit wary at first because it seemed she didn’t believe me about the first AC, but she showed she was a fair person by providing me with a decent AC in the end.
Who could live in an upstars room in summer in NY without an air conditioner For me, that is a deal breaker. That said, I think it was the car accident that cooked her goose.
plaintiff is a nightmare. and defendant is lucky she left. that being said: if you're a landlord and don't allow your tenant to have ac - then clearly state it in the lease and discuss it beforehand. Its a really mean thing to do to not mention it. (a judge might also not side with you over this of course on the flip side : if you're a prospective tenant - discuss this with the landlord ahead of time (I would never assume it because an AC unit EATS electricity and so there needs to be a clear understanding as to who is responsible for that electricity)
There was something in writing and that settled issues - or should have. It was a good thing that the landlady said the plaintiff could not have an a/c unit. It would have blown fuses all the time. The house is wired for a single family - not room renters. So all the bedrooms are powered by one fuse of 15 amps. Most air conditioners use about 10 to 12 amps. So renting rooms in a single family residence is risky. You might flow fuses or trip a breaker all the time. The plaintiff hoped to squeeze another $500 from the defendant. It was a blessing that the plaintiff moved out willingly. She would have been troublesome to rent to.

airing your problems in front of tv cameras and airing your entire name and company name are 2 different things. nobody can look you up or write bad reviews about your company based on your problems alone. but if everyone on the internet knew your government name and company name, people can easily look you up and harrass you or write reviews for your company. most of the time, when either a plaintiff or a defendent does this, i know theyre most likely going to lose the case and they do. its usually almost always the defendant that does this. most of the times thats because they know they done wrong and dont want it connected to their full name and business.
