    AH's choice in attorneys was limited. In the beginning, the founder of the Times Up Legal Defense Fund, Roberta Kaplan, an attorney, took AH's case to represent her in the trial. But once the audio recordings were leaked to the public of AH verbally abusing JD, Kaplan and all of her team (total of four attorneys) suddenly withdrew as her counsel.

      Thanks for sharing. I did not know that. But I heard that Elaine was picked by the insurance company who pays for her legal fees. I would imagine Amber's choices are limited.

      @@jonfreeman9682 from my understanding, she refused her insurance’s free counsel and hired her own team. That’s one of the reasons her insurance company decided to sue her:
      1. Her actions were malicious.
      2. She refused their free legal help.

      Same here. I listen to everything he does now. If nothing else he has driven me to think about things more closely. I keep a close eye on any self-snitching I may do. Even if it is to show which side politically I am on. These days that comes in handy. Especially in my Trump lov'n state.

    I like this guy. I know most people have a negative view of lawyers in general, but defense lawyers are viewed as even worse, like all of them will do whatever it takes to win, justice be damned. This guy is one of the good ones

    I think clients may not understand that when they interview attorneys for their case the attorneys are interviewing them as well.
    JD might have been referred to the attorneys he chose, but there were certainly some preliminary steps before that indicated whether they could work together.
    There's an old saying, "Choose your experts carefully --- and follow their guidance exactly."
    JD and his counsel worked well together. They appeared to have a lot of respect and trust between them. JD engaged rational thought without lapsing into an emotional reaction.
    He has self-discipline.
    AH doesn't know what self-discipline is, period.

    Despite everything, no matter who the lawyer or what the style is, it should all boil down to the truth. Who is the abuser and who was abused? It was clear as day.

I have no respect for what they are doing to Johnny Depp. If they think AH is so great, hire her and make her a “spokesperson “ for their network. I gave up on them years ago.

    10:45 - I know of a case where something like this happened. A guy was charged with possession of child pornography, and it was a DVD of Lupe Fuentes, an award-winning adult film actress. Yet, the prosecution went to trial with this case, even bringing in a pediatrician to testify as an expert witness that the actress' body belonged to that of a minor. In the end, Lupe Fuentes herself had to testify that it was indeed her in the video and that she wasn't underage to get the charges dismissed.

    I think that Elaine thought they had the case in the "bag" so to speak and couldn't/wouldn't/didn't adapt to the situation around them. Camilla just keep pounding on AH and got her to crack having to written the Co-OP on JD. Enjoy you videos.

      That's true. Good lawyers often look at the facts and then decide if it's worth taking the client on or not. They can afford to be selective with clients. Not all lawyers can.

    I would have thought that Amber’s legal team would have hired someone who specializes in preparing the defendant for testifying and cross-examination to “hold Amber’s hand” every minute of the trial. I think if she had dressed differently, changed her hair style, & appeared somewhat meek, she would have fared better. She reminded me of an old lady that ran a boarding school in the 1950s.

    You mentioned organization in your work and in reference to the JD/AH case, I noticed (and know others did as well) that AH's lawyers were not as organized as they might have been whereas JD's team was on top of everything.

    I doubt if Amber, no matter how well prepared by her team, was amiable to their suggestions. I think she is so narcissistic, that she went her way when on the stand. She seemed so combative, that she forced herself into an emotional corner. She was ripe for being "set up" by Camille Vazquez. What I mean by being "set up" is that she was predictable and the Depp team knew just what she would say and how she would say it. They had "read" her long before she was on the stand. They knew, and she had no idea, were the questions would lead. She was their most important evidence.

      It's a great format for Bruce. Some people don't understand how to do the short answer format, but it really works well here. 3:45 - "Russia"? Sounds like any inner city court.
      --Love defense lawyers. Bruce is entirely right. Without defense lawyers, even for people we believe are guilty (or 'incredibly guilty' as in The Producers), who is going to insist that the state restrict its prosecution to Constitutionally permitted behaviors and acts?

    If Amber chose Elaine over the insurance company lawyers, how did Ben Rottenborn get sucked into the mix? He's clearly superior to Elaine in litigation skills, but he's an asshole. He was rude, and that made him very unlikable to jury.
    Amber's testimony downfall:
    15% lack of preparation
    85% arrogance

    There are two big things that make the change in lawyers not mean much. 1: There is no real evidence supporting Amber. 2: No one can hide a 5 alarm dumpster fire like her no matter how good they are. Amber was going to talk and she was going to bury herself in BS.
    But here is a subquestion to that. What if Ben and Camille used the same tactics as Elaine and Rotten? We assume they would conduct themselves ethically. What if they defended Amber without Ethics like Elaine did. They wouldn't have had clowns as experts. They wouldn't have let Amber testify. They wouldn't have clowned their way through photoshopped pictures easily proven fraudulent.
    As for Elaine and Rotten they wouldn't have to work that hard and rookie lawyers can present Depp. All they'd have to do is prove Amber's lies and call it a day.

      Most domestic violence victims don’t have evidence , doesn’t mean the violence didn’t happen . They always protect the abuser by not going to doctor or taking pics .

      @@Charmander009 The issue was she did have evidence, evidence enough to make him look bad, i.e. him passed out but none of the physical damage to the extent she claimed. She was willing to take pictures and mock her "abuser" but not document her injuries which is an incongruence

      "There is no real evidence supporting Amber" A straight defendant in a defamation suit doesn't need evidence to support them. Heard's problem was always her counterclaim which forced them to present their "evidence" which was clearly fabricated (the identical photos submitted, where one was saturated to make the "bruise" more visible) or reused for different reports (the wine bottle on the floor used for two different fights days apart). If she hadn't of countersued, Heard probably would have never testified, and, so long as Heard's story (as told by her lawyers, now Ben and Camille) stayed consistent, there would have only been Johnny's word against Heard's witnesses, who were much more believable than she was. Even with the most damning evidence against Heard, the audio of "You're not punched, I was hitting you, I didn't deck you...." still wouldn't have overcome the claims of self-defense and sexual assault and friend's testimonies, and Whitney's testimony of almost being pushed down the stairs. None of these critical testimonies in Amber's favor would have ever been questioned by the jury had Heard never opened her mouth on the stand.
      "What if Ben and Camille used the same tactics as Elaine and Rotten?" Well that means that they would have still countersued Depp, which I don't think Ben and Camille would have ever done because it served no benefit to Heard other than pettiness that every lawyer other than Elaine saw coming. Heard's countersuit is exactly why Heard HAD TO testify because her testimony was supposed to be the best evidence to prove her allegations were not "a hoax", which was the core element of her countersuit - and we know how that went.
      Furthermore, even if Heard were still called to the stand, she would always be a rebuttal witness which has a very narrow scope to counter the main witness's testimony. This means that Heard's questions would be less open-ended, more to the point, and have less chance of her introducing her damning "personality" to the jury.

    And. What if any action could the Judge have done to AH when she brazenly stomped out of the courtroom when the judge told her to take a seat next to her attorney. If I was a Jurist I would have chalked her arrogance as a huge mark against her. It is a real truth teller of sho she really is! Don’t you think?

    I was part of a what-if conversation asking this very question. There were two Attorneys in the room. Both Virginia Attorneys. Both were clear that Brown Rudnick would NOT have defended AH. They might have consulted with AH in the beginning, but once they saw AH had no case they would have advised a settlement. Another point. When you compare Brown Rudnick to Elaine's law firm you will see it is like comparing Kroger to some local small grocery store. Brown Rudnick is big time, Elaine IS NOT! To me a key point in the trial that shows this clearly was when Elaine made a snide comment to Morgan Tremaine about his 15 minutes of fame. He returned fire and all Elaine could do was smile. If Elaine et al had been on Johnny's side I honestly don't know what would have happened. Johnny had a case, but to be honest I have a feeling Elaine would have found a way to f it up!

    I think it's interesting to speculate on one particular aspect of Amber's preparation for her testimony. She clearly approached it as an acting gig, and I wonder if it was more about rehearsing it from that standpoint, rather than focusing on the facts themselves. The ultimate example was her disastrous attempt to act out a complete breakdown on the stand, building to a crescendo with her shoulders heaving, and with her swaying from side to side, fake crying. But disastrously, she never shed a single tear. It was so obvious to the jury all the way through. As she built up to the big breakdown, she would use her hand to wipe away tears, although there obviously were none. She brought out her kleenex to blow her nose, but of course, the nose was as dry as her eyes. In a movie, a good editor would have used that footage to make it appear believable, but in the courtroom, it flopped. The most bizarre moment came later in the breakdown when she was adding her audible "sobs". She again brought out a tissue, this time to wipe away her imaginary tears, but if you watch the video closely, she brought her hand, and the tissue/cloth, directly to the middle of her forehead. What person has ever brought a tissue to the middle of their forehead to wipe away tears?????? She later did exactly the same thing a second time, bringing her hand to the middle of her forehead to wipe away imaginary tears. There is speculation, and I think it's worth considering, that what was happening was that there was something on the tissue (or cloth) which was supposed to bring tears to her eyes, because she knew she couldn't actually make them happen on cue. This is something that could, in fact, have been used in a film to aid an actor with a limited skill set like Amber. She was sort of shielding the tissue/cloth from sight as she tried desperately to get enough of a whiff of the substance to get the tears flowing. Didn't work. That was some really bad preparation.

      lol, yes, and I would say even with their first witness Isaac Berouch (Sp?) when she talked about kissing on the cheek, the pressure of the kiss, etc. Then she asked him about Amica cream (it's actually called arnica, so Elaine had that wrong) and so many questions about that cream that Isaac was lol'ing at her idiotic questions. I've seen those clips a few times now and continue to lol at some of his responses and facial expressions towards her questions. How on earth she became a high paying lawyer is just non-explainable!

      It wasn't much of a deposition. Her lawyer shut down nearly every question. If you were a true victim you wouldn't do that.

      @@jonfreeman9682 yep. Having had to bring my own case several years ago and that included giving a deposition. It truly takes a narcissist to sit there and not take it seriously particularly to the extreme like she did. I answered questions honestly, even if that answer was “I don’t know” or “I can’t remember.” Depositions are a big part of discovery…the objections are supposed to be just for the record, you’re still supposed to answer them. If the depo gets used in court later then the judge will rule on the objections and the tape will be trimmed appropriately for the jury.
      Ain’t no good reason to fuck around and be all secretive and doublespeak when it’s just you and all the lawyers in the deposition. They’re gonna get all your answers and info eventually - that’s the whole point of discovery - might as well give them the info from your own mouth and perspective. Her lawyer was being a massive douche canoe just to gas her up and make her think he was ride or die on her side… the other lawyers and the judge being annoyed and frustrated at him be damned!

She's not behaving like a normal victim would behave. A real victim would be pouring her heart and soul about all the details of the abuse and pain and suffering and wants every juicy bit on record. That is unless she's no victim and knows she's going to trip up over her web of lies. She's not on trial and is the victim but behaves like the guilty and the lawyer shutting everything down tells me he's in on it and knows it's a hoax too. This deposition alone tells me she's guilty of lies and perjury.

      It was so ironic that she taped Johnny in their arguments, which includes her literally taunting Johnny...a MAN!...and stating that no one would believe him. That is a blatant lie. Then on her tapes, Johnny was clearly trying to be alone to calm down, think, etc. And she was merciless, trying to make him say something out of anger, that she could then use in court.
      No true victim of sexual abuse would act this way. My ex was a lot like Amber Heard, and I was terrified to oppose him.
      Eventually, after 30 years of his abuse (mostly mental, but also sexual and physical), after seeing my therapist for 7 years, in the beginning I was seeing him every day), I finally got brave enough to divorce my ex.
      He was FLOORED when the sheriff deputy served him with MY divorce papers, after all his years of threats to divorce me!

    I have been watching your videos for a few months now and I really have enjoyed them. I don’t always agree with everything you say but usually you bring me around ha ha. But for the most part I think you are probably a kick ass lawyer.
    This certain episode I was kind of thinking well I may turn it off now and find something else but you started talking about how you learn from everyone in your life.
    I just want to commend you for that because I think the only way for people to heal is to be humble. The only way people can grow is to be humble. And the only way someone can be their best version is to be humble. So when you said that… As I’m thinking how I always laugh at your introduction to the show and how full of yourself you seem… 😉
    And how you know you’re a good lawyer… But then to hear the humble side of you just really demands commendation. I wish you were licensed in my state just in case I ever need you… God forbid ha ha
    Honestly, my entire life I wanted to work in law. I never thought I could really do it so instead received a bachelor’s in business and then a masters in counseling. Now I’m almost 50 and I think what the heck. I can always go back to school. But to work for someone like you to get knowledge and even start at the bottom and work up would be a dream. OK , I’ll shut up now. Keep making those videos my man. 😉

    If you want a good example of false confession made because of law enforcement, Riley Fox's case is the best one. Law enforcement automatically focused on the dad and openly threatened as they refused to record most if not all of the 'interview' thankfully he sued them and won. RUclipsr Kimberly Flower covered it recently, going into great detail about the crimes law enforcement committed.

    If Ben & Co. had taken on Amber Heard (*IF*!!), I wonder if they would've tried to keep her off the stand? Ultimately, my non-lawyer brain thinks that would be the best bet. But said brain also has the knowledge of hindsight. Not sure anyone, even Elaine, could see the train wreck coming that Amber would cause.

    Great point about how in a he-said she-said case, if one testifies the other one pretty much has to. AH's testimony was disastrous for her case imo. I feel she would have insisted on taking the stand anyways, but I'm super curious about how her team viewed it. Imo, she had clearly been coached and prepared to an extreme extent, and she still performed awfully lol. So true that no matter how much prep they do, once they're up there it's their show. I can only imagine how much anxiety her team must have felt around her testifying 😅

    I agree with everything you say Bruce, yes JD never became 'rattled' despite repeated attempts by Rottenborn's back street questioning and this calmness only worked in JD's favour to show he was telling the truth because he had unshakable belief in his own recollection of events, he just didn't care a sh%t if anyone believed him or not.
    Nice video and summation with some excellent questions from viewers.
    Respect to you Mr Rivers for remaining open to learning lessons every day of your life and from just about anybody, not that's being grounded. Also, heart warming to hear this venture is a labour of love between you and your son Michael and yeah he is handsome, but then who does he take after huh!😎

      AH is a perfect example.
      I think she might have interviewed a few attorneys -- and told them HOW she wants them to defend her ---- a big Red Flag.
      At the initial interview, the attorney is checking out the client, too. If they discover the client lies, witholds information, or interferes with their ability to do their job, they can fire the client.
      AH chose her attorney --- perhaps based on how willing they were to kiss her behind
      ----- or maybe based on her own crazy priorities.

    Maybe this has been answered before but do you have advice for picking a good civil case lawyer when your funds are limited? (Tldr: Neighbor cut our sewer line that's been there before we arrived. ) My family has been seriously struggling the last few years with us almost losing our house multiple times. A few weeks ago, someone bought the property behind us and cut our sewer line that's been under there since before my parents bought the place. My mother and father have been so stressed about the fact we haven't had running water or sewage for 4 weeks that my dad backed off his truck driving jobs for safety reasons and my mother ALMOST failed her nursing exams (she passed today and I'm so proud of her but she's so stressed that I don't know if she's properly celebrated.) With my family's financial situation already dire, it was hard for my dad to take himself off the job but he was making some very rookie mistakes while getting a truck ready and might have hurt someone if he hadn't noticed in time. My mother is a refugee from the Khmer Rouge era from 1970s Cambodia and she's distressed that the person behind her home is making her essentially camp with the potential of filth in her own backyard years after she escape a horrific situation. She started crying and almost threw up while telling us how the Khmer Rouge made her move human feces for fertilizer when she was 12 years old with no protective gear. I can't do much to help because I'm broke too and studying for the summer. My parents have a lawyer but my parents are losing hope because there has not been much movement, potentially because the neighbor has more money and hired the biggest law firm in town. I don't know all the details so I don't know if the lawyer is just preparing, but my mom is worried there isn't enough urgency and is considering taking the story to social media but I think she's scared and embarrassed. Im partially venting about a bad situation but if you have any advice, it would be appreciated. Great video with good answers.

      I’d just make sure it’s a Real Estate attorney. Is there a record of an easement on the deed? I’d look into if the properties were ever owned by one owner. There are some exceptions to the written requirement but very few. Different states have different laws.
      HOWEVER, the neighbor cutting and capping the line was not smart on there part. Did they provide something in writing prior to doing this as a warning? Is there sewage now leaking on the property. The city/county would most likely at quickly if this is the case. Were the lines connected? Unfortunately they are in need of a lawyer and definitely look into getting one who knows the ins and outs of this specific area.

    It's really tough for me to imagine Chew and Camille wanting to represent AH. I could be wrong but just imo. I feel lawyers often reflect their clients. I really feel Elaine and Amber are birds of a feather, and naturally go together. I would also hope, hope* that many lawyers, JD's team being some of them, would have declined to represent Heard once they saw the different signs of dishonesty and manipulation. It's honestly tough for me to imagine JD's team agreeing to represent Heard, bc if their character which I felt was apparent. I could be wrong tho. I def feel like JD's lawyers were better overall. I feel Rottenborn is the one person from AH's team that is on the same level as JD's lawyers in terms of skill and intelligence, but he came across as a prick and a jerk when he was representing AH. I feel the fact that he still represented her may imply some moral flexibility on his behalf, which I don't think Depp's have. I prob sound overly flattering towards JD's team, but imo, I feel they are both super sharp and skilled, and have good character. So they were superior to AH's in every way. And it's tough for me to envision them defending her in the face of her obvious lies. I could be a bit biased tho and maybe over generous, but just imo.

    I enjoy all of your vidoes but this type, with you answering submitted questions, is by far my favorite. I really like the way you break legal things down so anyone watching can easily understand. Keep up the great work!!
