This happened to me at my grandmother's house that I inherited, I caught it at the last minute. I just happened to go to the County Assessers Office to make a payment for the taxes, they told me my name was not on the house and someone else owned my house. I was wondering why I was not getting any correspondence about my house in over two years, they told me they were sending it to someone in Vegas! I was floored, I sat there in disbelief with tears rolling down my face because it was the only thing I had left of my mother's and grandmother, ( they both had passed away ) and it was my childhood home. This nice African American lady was working there and saw how defeated I was and came from behind the counter and hugged me, she told me to wait until she was on break and she would help me. She sat down with me and walked me through everything I needed to do so I wouldn't loose the house. This happened to me about 10 years ago. This taught me that even though there is some bad folks out there preying on people, there is also still good people.

Any sort of a quit claim deed, if being notarized, should require both parties to be there with several forms of IDs. That's absolutely ridiculous this criminal was able to do that.
So, to cash even a $1 check ID is required at the bank, but you can quitclaim a property deed with no ID required as long as the signature looks okay. Incredible. And there's no effort being made to change the procedures.
This is the issue with this problem. The notary should be charged too because they make the documents legal with their stamp. The notary is the key to this criminal act to make this possible. FedEx has an individual that will notarized documents at most of their branch offices. It certainly seemed like a business transaction that involved a service fee rather than a legal document making it authentic. I had to show my driver's license as an ID but nowadays anyone can counterfeit an ID. The title of home ownership is so flawed and unsupervised that it now another vulnerable way for criminals to prey on victims. Just like counterfeiting a vehicle, plane or boat title to sell something of value.

I am a notary. The notary only certifies that the signor signed the signature in their presence and presented valid picture id. Kansas has a fraud alert for when documents changes are made.

All of these things require ID. BUT a fraudster gets all that covered by Forgery, ID theft, and Criminal impersonation, and the luck of getting an inexperienced employee. I'm still wondering how/why people can move in/squatt in a house and the homeowner just can't call the police and say they are trespassing on my property, show the deed/title and have them removed. Got to go through court processes and I've heard stories where that didn't even work or it took months to get them evicted.

I am a mobile notary I get lots of calls for Quit Claim Deeds from general public. I never accept the assignment. I only take on these assignments directly from an attorney or title company. I fear this exact thing happen to individuals when called.
The city office should be more strict to protect the public by requiring the applicant proof of ownership like mortgage loan documents, monthly payment statements, property titles and insurance, not solely on an i.d. The protection of its citizens is foremost .

That should be scary as hell for home owners. They should implement a department that makes a call to ALL home owners at the number on file any time these type changes are made to property deeds. All home owners should be required to have a phone number associated with the deed on file.
In Florida there is a mailing address required. However, if they let anyone just fill out a change of address that is simply overcome. Scammers find the loop in any step and exploit it. Many people go to prison for real estate fraud unfortunately the sentences aren't any good if you ask me.

In Florida a quit claim deed form removes an entity from the deed while leaving them financially responsible for it if they are a borrower on the bank loan, provided if a loan exists. Had a friend do it back in 1995 because Some inexperienced lawyer told her to do a quit claim deed after breaking up with the bf with whom she purchased the house. He couldn't/wouldn't get it refinanced in his name alone so this is the advice an attorney gave her. The result was she was still responsible for a home she would not own after it's paid off.

This can and does happen but as soon as the legal owner informs the county and shows proof that they are the legal owner the county must transfer the property back to their name. The onus is on the county to prevent fraud, not the property owner.

It happens everywhere, around the country. But, many counties now have alerts you can add to your property tax accounts. Or, you can go through a private company. I'm sure you have seen the infomercial on tv.

This right here is reason number 1 why I hate quit claim deeds. I am a civil law notary in Louisiana. I wont even do quit. Claim deeds unless it's like spouse to spouse or a sibling wants to drop out of a huge multi sibling inheritance. They are a RIP off and not a safe way to transfer property. I work as a Superior Court Deputy Clerk processing real estate and lien documents, and this is more common than you would think. It's especially rampant with people taking advantage of elderly family members. Our county has always required original paperwork only, but we're moving to online processing this year. The forgery is going to be insane.

So let's think about this. If you don't have your driver's license on you when you get pulled over, you can go, depending on the situation, go to jail. You need ID to buy alcohol, cigarettes, and even get your meds. But if a quit deed claim looks legit, LOOKS legit, they can't/don't ask for ID? It's the lazy county public servants that don't check, they just stamp anything. What's so hard about attaching identity checks onto procedures when they give notary stamp to just about anybody less buy a fake one. Thus why do we pay their salaries? It's family and friends type of workplace, you taxpayer pay regardless.

This scam is similar to the heffa with the credit repair business. She found the loophole in what it took to get a creditor to remove debts from a person's liability thereby improving their credit. A POLICE REPORT CLAIMING IDENTITY THEFT. So she COPIED legitimate police reports on her clients' behalf (unbeknownst to the client) and submitted it to their creditors. Creditors removed the debts and reported it to the credit bureaus. Clients were Happy UNTIL 1 creditor became suspicious and called the police dept to verify the report. Blowed her entire business up like a volcano. One county had over 135 fake police reports on file from her. Fraudsters will get around any type of required paperwork.

Apparently, anybody can open a credit repair business and start collecting SSN and birthdates. Twenty years ago Credit Bureaus began warning people that there was no quick way to improve credit. That anyone claiming to improve credit score more than like 50 points in less than 3 months was suspicious and probably a scam. I remember them and other agencies discouraging people from paying for that service from anyone.
If you have a mortgage,.this is less. likely to happen. But make sure you signed up and have an online account with your property tax assessor. If they have the option to notify you of any legal documents, sign up for it. People who have a paid off home are more likely to be targeted.

This is happening all over the country. People have homes paid off, not occupanied, not lived in for awhile, left in a Will after a family member death. Always have a small loan on your home, alarm system, notify neighbors if anyone is viewing the property. Ring camera can easily be installed., motion detectors. Having a loan on a home will prevent quick claim deed thefts.
Having a "small loan" is also a way to lose a home to foreclosure once a benefactor passes. Happened to my grandpas home. He became ill and passed away and when we went to claim the property the bank had already foreclosed and the grace period to reclaim the property had passed. 😡

A quit claim just says that "I give up any claim that I might have (not that I'm claiming to have any legal ownership)." It's often a valid and useful thing, for example in settling probate estates, or any other case where there are potentially multiple owners. OTOH, it's illegal to forge a signature on a quit claim, I expect that's what happened here. And forging a notary signature, that's a even worst violation.
This happened to me! I been trying to find a lawyer to take my case in Duval, Florida! My dad's ex gf stole his home which is on over a hundred acres of land, my dad was in hospice dying, and the notary was her new boyfriend she left my dad for!

A quit claim deed doesn't necessarily transfer real property, and everyone should know it. Always get an attorney involved when transacting for real estate.
It so bad in Philly there’s now a task force ! Two family properties but by family members. Seniors were left without resources as as they put the houses in Section 8 and to this date they are collecting money from the government. The Philadelphia DA office said they would have prosecuted them but too much time had passed. I looked at a civil suit but now i just warn other to watch out for this kind of fraud.

My county requires that both parties are present and the notaries are in the office with you. then both parties sign. If a llc is selling or buying you need representation present to sign the documents. And property had to be free of taxes and lien We had to jump through hoops then wait for the state to authorize the transfer and send me the deed

That should be scary as hell for home owners. They should implement a department that makes a call to ALL home owners at the number on file any time these type changes are made to property deeds. All home owners should be required to have a phone number associated with the deed on file.
In Florida there is a mailing address required. However, if they let anyone just fill out a change of address that is simply overcome. Scammers find the loop in any step and exploit it. Many people go to prison for real estate fraud unfortunately the sentences aren't any good if you ask me.
Title Monitoring Services are the best defense! These thieves use your 🏡 home as collateral for loans, then you are expected to pay or move 🏠! Or you have to check your Title Office monthly for any change because they will NOT alert YOU!

State law should change to that a quit claim deed shouldn't be allowed, only a lawyer signature and notarized is allowed to transfer property that has a city property tax value of $100 or More. This kind of fraud is becoming to common in digital age. States senator should act to fix it.

I think we are saying the same thing. Voluntarily Giving up claims to a property would be the same as your name being removed. In Florida a quit claim deed form removes an entity from the deed while leaving them financially responsible for it if they are a borrower on the bank loan, provided if a loan exists. It cannot be reversed unless person 1/person 2 consent to another quit claim and transfer it back.
Had a friend do it back in 1995 because Some inexperienced lawyer told her to do a quit claim deed after breaking up with the bf with whom she purchased the house. He couldn't/wouldn't get it refinanced in his name alone so this is the advice an attorney gave her. The result was she was still responsible for a home she would not own after it's paid off.

Same thing with purchasing a car from a private seller. It only takes a ride down to the local mva to verify if a title is clean and the person trying to sell it has the legal right to do so.

This can and does happen but as soon as the legal owner informs the county and shows proof that they are the legal owner the county must transfer the property back to their name. The onus is on the county to prevent fraud, not the property owner.
This is how it should work for squatters too - show your legal documentation to a sheriff and have him kick them out.

It happens everywhere, around the country. But, many counties now have alerts you can add to your property tax accounts. Or, you can go through a private company. I'm sure you have seen the infomercial on tv.

Claim deeds unless it's like spouse to spouse or a sibling wants to drop out of a huge multi sibling inheritance. They are a RIP off and not a safe way to transfer property. I work as a Superior Court Deputy Clerk processing real estate and lien documents, and this is more common than you would think. It's especially rampant with people taking advantage of elderly family members. Our county has always required original paperwork only, but we're moving to online processing this year. The forgery is going to be insane.

So let's think about this. If you don't have your driver's license on you when you get pulled over, you can go, depending on the situation, go to jail. You need ID to buy alcohol, cigarettes, and even get your meds. But if a quit deed claim looks legit, LOOKS legit, they can't/don't ask for ID? ABOVE anything else, they SHOULD be asking for IDs for this. They need to change how they do business. This is contributing to fraud.

It's the lazy county public servants that don't check, they just stamp anything. What's so hard about attaching identity checks onto procedures when they give notary stamp to just about anybody less buy a fake one. Thus why do we pay their salaries? It's family and friends type of workplace, you taxpayer pay regardless.
I said similar things. Fraudsters luck up on getting inexperienced employees and I know they are not hard to pick out. It really takes this happening to the wrong person and they will cause all legal h*ll to break loose on the county. This made the news but I bet most people in that county didn't even see it cause the local media probably ran the story once. The county probably tried to get them not to run it at all.

This scam is similar to the heffa with the credit repair business. She found the loophole in what it took to get a creditor to remove debts from a person's liability thereby improving their credit. A POLICE REPORT CLAIMING IDENTITY THEFT. So she COPIED legitimate police reports on her clients' behalf (unbeknownst to the client) and submitted it to their creditors. Creditors removed the debts and reported it to the credit bureaus. Clients were Happy UNTIL 1 creditor became suspicious and called the police dept to verify the report. Blowed her entire business up like a volcano. One county had over 135 fake police reports on file from her. Fraudsters will get around any type of required paperwork.

Apparently, anybody can open a credit repair business and start collecting SSN and birthdates. Twenty years ago Credit Bureaus began warning people that there was no quick way to improve credit. That anyone claiming to improve credit score more than like 50 points in less than 3 months was suspicious and probably a scam. I remember them and other agencies discouraging people from paying for that service from anyone.

There are companies that will protect your title for about 100 a year. Home title lock is one that I know of.

If you have a mortgage,.this is less. likely to happen. But make sure you signed up and have an online account with your property tax assessor. If they have the option to notify you of any legal documents, sign up for it. People who have a paid off home are more likely to be targeted.

This is happening all over the country. People have homes paid off, not occupanied, not lived in for awhile, left in a Will after a family member death.
Always have a small loan on your home, alarm system, notify neighbors if anyone is viewing the property. Ring camera can easily be installed., motion detectors. Having a loan on a home will prevent quick claim deed thefts.

Having a "small loan" is also a way to lose a home to foreclosure once a benefactor passes. Happened to my grandpas home. He became ill and passed away and when we went to claim the property the bank had already foreclosed and the grace period to reclaim the property had passed. 😡

TIL: you can use a quit claim deed to transfer ownership? ... I don't think so, there's something else here. A quit claim just says that "I give up any claim that I might have (not that I'm claiming to have any legal ownership)." It's often a valid and useful thing, for example in settling probate estates, or any other case where there are potentially multiple owners. OTOH, it's illegal to forge a signature on a quit claim, I expect that's what happened here. And forging a notary signature, that's a even worst violation.

Anyone doing this needs to be locked up and charges made on them thief’s to the fullest extent. You mentioned squatters just like I did. Fraudsters find the loophole in any system and exploit it. You don't even know you ain't got no rights until you try to enforce sumthin. Requiring a person to be present for property transfers is only going to inform the fraudster that they need a FULL power of attorney. Convenience is where fraudsters find the loopholes.

A quit claim deed doesn't necessarily transfer real property, and everyone should know it. Always get an attorney involved when transacting for real estate.
It so bad in Philly there’s now a task force ! Two family properties but by family members. Seniors were left without resources as as they put the houses in Section 8 and to this date they are collecting money from the government. The Philadelphia DA office said they would have prosecuted them but too much time had passed. I looked at a civil suit but now i just warn other to watch out for this kind of fraud.

My county requires that both parties are present and the notaries are in the office with you. then both parties sign. If a llc is selling or buying you need representation present to sign the documents. And property had to be free of taxes and lien We had to jump through hoops then wait for the state to authorize the transfer and send me the deed
