- California’s Employment Development Department is accusing some pandemic-era claimants of fraud and demanding repayment, years after their applications were approved.

I wish this foolish department would do that to me! These fools contacted me regarding a 2 year ago claim as well but I recorded ALL calls, saved ALL documents (online and paper) and dared them to do this with their incompetent selves. They called to inquire 2 (probably longer) years later why I was let go from my previous employer. I ALREADY TOLD THEM during the interview!!! Additionally, I sued my employer and we settled, THOSE were my responses via online through the messaging system. I encourage people to DOCUMENT and SAVE your documentation via PDF or screenshots and place in a file folder on your computer and disk drive. Download a phone recording app and do the same for calls as well. I informed them that because I currently work, I will NOT take time out of my schedule to do ANYTHING with them to confirm ANYTHING over a 2 hour window. They are a HOT mess!
They need to go after those folks who stole $7 billion from EDD who never lived or worked in California. The FBI and Feds need to get involved to get every penny back. The EDD employees and Bank of America employees are at the root of this mess.

i paid into socal security until age 40 when o became a teacher. So im retired and its a small pension. I didn't know that the gov thinks its double dipping so if i take SS they take 2/3 of my pension, so it will be end up better for me to just not take it, and fingers crossed they get rid if the WEP.

This happened to my dad he believes he was over paid $6000 during Covid times and he tried to return the money MANY TIMES but they would not take the money back. It’s been three years and my dad still has that money saved because he has a feeling that they’re going to charge him for it. What a nightmare.
I'm calling that BS, there is no reason they should not take the money back, that doesn't make any sense, I think you're making that part up!
If she wasnt eligible she shouldnt have received it in the first place this is EDDs fault they are not compitent. Same with the government giving PPP loans with non matching socials. These agencies are either intentionally doing this to indebt americans or the people working there should have never been hired and are shifting blame.
This is what happens when EDD hired box checkers instead of qualified people.

I was overpaid last year. I left the funds for a while and then used it because I needed it and they didn't ask for it back.
Late last year I went on unemployment again and they garnished and penalized me while on unemployment. They should've asked for the money back when I was employed not while I was receiving the direly needed funds. I'm employed again. I'm just going to mail a check back to them WHEN I get over paid again cuz it's not worth the hassle. I didn't ask to be overpaid.

@@sfbayarea209-fish-n-missio6 Same here, I took a remote teaching job in California (where I;m credentialed) from Ohio (current residence) because it was remote. 2 months later they decided to go in person, the day after I submitted request to continue working from home they laid me off and somehow gave EDD the impression that I was there the full year. SO of course they accused me of fraud, making me ineligible to the the transfer waiver for folks on very limited income. Scam.
I appealed but the both times I appealed, they wouldn't even read the appeal cause it was too late for me to file an appeal
I was separated from my job. Filed for EDD was approved. Payments were delayed 6 months. Emailed Legislators they helped me to receive my EDD claim. I was paid 1829 total in EDD funds. Eight months later EDD sends letters that say I was ineligible for EDD after they paid me. So frustrating. Then EDD accuses me of Insurance Fraud. Unbelievable hell with EDD. Who may I turn to an attorney that is passionate for us low-income Americans. On top of all this I am low-income and have worked with Special Education children and I have disabilities myself. I prefer to work and earn instead of not working. The system is against the low income and the people of America.
EDD is going after LAUSD Sunstitutes 3 years after the fact! I am one of them. I was on a list for SUmmer school work in 2020 but no calls as schools were closed. Thus, I could not work. I filed and was given EDD. Now based on Reasonable Assurance of Work after a recess or break and Reasonable Assurance to return in Fall of 2020; no EDD. but it was COVID times and we were uncertain if schools would open, do Zoom, etc. Teachers were trained on Zoom in April, May. Subs were not. No Reasonable Assurance of work in Fall. Subs were denied work in Summer. No Reasonable Assurance. My Fall assignment fell through. No Reasonable Assurance. etc. Yet, myself and substitutes who were paid in 2020 are investigated and have to file Appeals. I will keep this attorney's information. There should be a class action lawsuit against EDD. They made mistakes. They do not getthe real fraudsters and ocme after substitutes.

You have a lawyers you will be compensated with interest. Sue them in court.
I am currently being accused of fraud. My appeal appointment is on 3/9. Before sending my appeal. I spoke to someone over the phone with EDD and the employee told me that I had all the right information and my appeal will easily be forgave. Do you know how long I have been stressed about this? An employee at the EDD told me I was in the clear, but it’s all up to who I talk to tomorrow. 😢

I reported to the EDD how someone that I know was doing fraud during the covid pandemic and the didn't do shit 🤦🏻♂️ I made the fraud report and told them I had screen shots of how the person I know was offering 500 dollars per claim just so she can use address and receive the EDD mail , she made thousands of dollars, did plastic surgery, went on vacations, bought a new dodge charger, bought designer clothes, jewelry and she doesn't even have a job 🤦🏻♂️and the EDD didn't do shit 😂😂😂
EDD is awful; it is outdated, and needs huge reform. The idea is great but their practices and they way they handle cases is not up to standards. For a State that is the richest of all the States, EDD CA should be top notch.

I ended up homeless and moved out of state. I got a letter from EDD saying I could get unemployment so I called them up. The guy who helped me was nice (which should have been my first red flag. No one in California state government is nice especially when you fall on hard times.) I told him, I didn't think I qualified for unemployment. He said I did so he helped me get pay that helped me get on my feet. 7,000. I used that money to pay my bills and fix my car so i could go back to school. Later I get a letter saying that I am a fraud and had an interview with a lady that wasn't as nice. Long story short, I now owe 15,000 dollars to the state of California to repay what they gave me and then some. OH and that amount goes up every month I don't pay it. You dangle a carrot before a starving person, they are going to eat the carrot. That money did exactly what it was supposed to do. It helped me in my darkest hour, now, 15,000 and growing is my darkest hour. California is so corrupt. I've never been in trouble with the law in my entire life. I've always followed the rules. I think EDD wants you to take the money so they can claim you fraudulent and gain even more money.

EDD sent me 100 mail envelopes saying I am qualified and I need to cerity asap. after certifying, they paid me. After 2 weeks they called me and told me that I was over payed. I was like, why did you approved it in the first place and sent me 100 mails? I told them to get their money back just don't charge me 30%.
it's 30% plus money every month until you pay it off. They make more money if they can claim you as a fraud.

Watching this makes me feel very very worried now. I've been waiting on my paperwork to come for months since they sent me the same info I just listened to here. Telling me I didn't qualify and I know I did because I had 2 jobs and I went down to one . That happened to me during the pandemic and they made me pay back over $10000. That was a huge hardship for me as a single parent. Every call I ever tried to call into the EDD office was never answered. They took my entire tax check.
Same shit happened to me, I called and they just said, we will mail you. We will mail you. And I confirmed my address and nothing was done. Now they are charging me 30% interest. Wtf?
Kept all my paperwork. When I applied they Audited me in 2020, I had to fax in a ton of paperwork., took 7 months to get approved.
My job is seasonal and after 20 seasons this year when I called to open a claim “which took a week of calling to get through”
The EDD worker explained how they were going to send me some papers regarding the identity info I had to provide. Took about 3 days. Sent a copy of my Driver's license and a copy of a paystub. The letter asked to write SS # on each of the copies.. Sent it in an envelope that was provided by edd.. After a week got a letter and said notice of determination. You have failed to provide edd with your identity we asked so for you have been determined to getting benefits??

Last year when I got laid off I was denied benefits and then billed for 2020, accused of fraud, and I have to make monthly payments plus they intercepted my tax refunds and denied me the waiver process due to my "fraud" and they said they can take my pension anytime with no warning. And having to prove your'e not a scumbag? Isn't just not being a scumbag enough?
Man I’m so sorry. That’s sounds awful. I was going to apply for disability insurance through them because I injured my foot recently and am out of work for a couple months, but I had unemployment insurance back in 2020. I’m afraid if I apply for disability, they are going to come up with some bs excuse and bill me for 2020 of something. I’d rather not use them again.

This happens with Florida (DEO) as well. My thing is if someone isn't eligible then why accept them in the first place if they didn't falsify any documents? People with power always abuse it I guess

i thought i was alone but they did send me someone info and i let them know and i was honest but they are not honest they messed up and now i have to pay for it.

To be fair, You lost your second part-time job, and still have your primary job, then you collected unemployment benefits. Yes, you’re a fraud. You need to pay it back. They did it right, but sent a wrong file is wrong.

Starbucks used to take EDD from food stamps until very recently. You would be amazed at these people. I want a quad shot soy vanilla latte with vanilla sweet cold foam. Soy milk $0.80, vanilla cold foam $1.25, add shots $1.00, and $5.25 for the latte. Comes out to a total of $8.30. Thtas a whole chicken and some potatoes with veggies. Or chicken and pasta.

My fiancé was over paid through edd , garnished her wages and she fought in court with edd not showing up and the judge told her she didn’t have to pay because edd never showed up and they have 30 days to appeal. Today we got the mail 8/22/23 and edd is now saying she owes the amount again plus interest . All because her job said she quit ( Kaiser) ,which is false . Anyone hear are know of any situation like this that went our way ? We’d appreciate any help thank you blessings
Yes I'm going thru the same thing now. Received an overpayment notice today for employment in 2022. Said I quit for no good reason but didn't specify which employer. I'm sick to my stomach and seeking an attorney
