Copyright laws needs to reformed bug time. The big companies are clearly misusing the laws to shut down those who talk about alternatives and criticism of their products, policies etc.
Its not a problem with the law, the problem is that RUclips automatically sides with the big corpos, if you were to hire lawyers you would eventually win but in most cases its not worth it.

Gabe was absolutely correct and his point wasn't just proven by steam but throughout the media landscape as music and movie piracy plummeted with the proliferation of legal streaming services. Inversely, movie and TV piracy is back on the rise with the partitioning of content across many different paid services, regressively restricting access. When you ease access to content, and make it available at a reasonable price, people buy it. When you're like Nintendo and keep your first party games near MSRP for nearly a decade, the people who can't comfortably afford $50-60 games aren't going to patiently wait for a sale that will never come, they're just going to pirate.
Ever since I've made my steam account I've never pirated a PC game. They've actually been so successful that not only have they massively reduced PC game piracy but also turned it around into surplus sales. Just look at your backlog of unplayed steam games :v

Nintendo CANNOT legally prevent you from making dumps of our games. And if they refuse to offer a first party app to do it, they can't legally complain about people using a 3rd party. The courts didn't shut down Nintendo, because the courts don't evaluate the veracity of a claim before a case is put in front of them. Hell, Bleem WON its case against Sony because they did everything correctly. But Sony bankrupted them with legal fees. Compaq broke IBM's back in the PC space by reverse engineering the bios. And they also won the lawsuit that IBM brought against them.
I got a video taken down featuring EmuDeck a couple of years ago... with no showing of downloading roms or anything piracy related. I appealed it and Google/YT still said nope, it violates guidelines. Meanwhile every other channel makes multiple EmuDeck videos. In a way, I'm glad it happened to large channels to finally talk about this problem to a larger audience.

@@Dracossaint not really. copyright was always a tool to censor, not support artists. the reason for it's existence (at least historically) was so that the queen Mary the first of England in 1557 could ban books that were politically against her while also having "good" books kept to pacify the masses... it was also noted that when parliament asked why a copyright board [Worshipful Company of Stationers and Newspaper Makers of 1557] was needed they had the infamous line "to protect the artist" set up to ensure their existence as label-makers stayed... and control maintained. Intellectual property law desperately needs major reforms. There are two huge changes I think would help: 1. Make copyrights expire after 10 years. Long enough for creators to get paid, but short enough for works to enter public domain while they can still benefit society. 2. Make mandatory DRM/TPM illegal. It should be opt-in only, used only by people who understand what it is and made a conscious explicit decision to use it. Also, we really need to break up big tech corporations.
I agree bit i have two stange. 1. The exeption on this is if the work transform between work in a commercial sends (e.g. book to a movie) and plagiarism both right can be life time. 2. I agree 1000%, the only exception is to access a broadcast stream from a cable/satelite/terestal/IPTV/OTT provider (scramble channels) but the user can do anything with the stream with out any limits (number of device/number of streams/can be record by the user/etc by the provider/tv station/radio station by any device/software that the user have.
thats was the copyright law before 10 years are the maximum allowance for media. Because some big media corporations and politicians at the time extend the called Digital Millennium Copyright Act gives Corporations and companies more power.
Make rule 3 after copyright expires if original company made the game then should be noted so let's say GTA now not copyright make your own GTA game still credits to original founders of game/company. That way still give credit where credit do. Or consider this idea for rule. Agreed though I'd be willing to allow for a single extension of another 10 years if needed. You get 1 per copyright, forever, and you have to prove you are actively working on something within the IP that will require the extension.

Old media and abandonware (things that are no longer made and sold by the companies that produced them like consoles or old games) can not be considered piracy from a logical perspective because it is not impacting their finances, emulation is about art preservation the DMCA laws must be remade because companies like the big (N) or maybe we might vote with our wallets to make them understand that we don't like what they are doing.
People tend to forget that the point of an ad is selling a product TO SOMEONE THAT ALREADY HAS INTEREST IN IT or create interest or awareness at the very least, if you force 100 people to see an ad they aren't interested just to reach 1 person that may want it, you are doing it badly, in mass is profitable but inefficient.

Veritasium handles sponsors very well. He simply says "This video is sponsored by Some Company. More on them at the *end* of the video." And then it's at the end of the video. It's so brief, that it's not even worth trying to skip because the beginning disclaimer will likely be over before you reach your keyboard to hit your right arrow. Technicals and Internet Historian also do what Wulff does and make REALLY funny sponsor skits that feel like extensions to their videos. However, this still isn't as good as Veritasium because most people still will realized "no matter how dressed up this is, you are still trying to sell me something and that's bad no matter how funny".
I don't think "downloading" in an "unauthorized" manner exists. Just to watch the video YT has to stream it to my computer... they are already storing the video in MY ram... I have already "downloaded" the video just by watching it. You don't control what I do with my storage. This is just how the tech works RUclips.
not true. a youtube stream is encrypted and cannot be recovered in your Cache/temp folder unless you are using an extension or browser that "captures" the stream like Firefox. ...which is a download. it isn't 2003 anymore

I mean "piracy" is a legal term with a very clear definition. It, like fair use, determined by a court not Internet opinions. Saying something is "clearly fair use" only makes sense if a court has determined as much. It remind me of a convo I had with someone was talking about EDP445 being guilty. "by that definition, EDP445 is innocent" and I replied "Well yeah, that is what not being charge of a crime means" we might not like it but is true.
From my point of view as someone who stopped buying Nintendo consoles and games some time ago now. Their constant bullying and weirdly selective what can and can’t be shown that changes all the time, all their medling in tournaments and just about everything really makes it very easy for me to write them off as a company I don’t want to support. I am just one person at the end of the day but I am doing my part to show that there is a consumer breaking point where the brands toxicity outweigh whatever quality their product might have.
In the last couple of years, it's been easier for me to make sense of their actions, by labeling them as a law firm, that also has an active game Development section, likely located in the basement 😂
This is a natural outcome. Small businesses need their customers to survive, corporations like this make it so customers need them or think they need them to survive. They can do anything because most people will just do anything to keep giving them their money and data. The current cultural and political climate will not allow for anything different, and people have been addled to consumerism so as not to even know how to take action, let alone have the guts to take it.

I have to say that after YT blogged ad bloggers they started sparsely showing ads to YT Premium subscribers too. And I myself have paid for Premium so I don't have to see ads, but if ads become a more common phenomenon for Premium users, I will cancel the subscription because of this.
RUclips's service problem with ads is much bigger than the lack of interest in the ads being served to you. They used to only have one ad at the start and end of the video. Then they started pairing them up. All the while you can get anything from a 5 second ad, to a 2 hour ad. And ads that are just some random RUclipsrs videos. Add to that the fact that advertisers can select the target audience, and will target ads at groups that want nothing to do with those ads, not like no interest, but stuff they would go out of their way to actively avoid. The intentionally mistargeted ads could be an attack on a particular chanel they don't like, an attack on the audience of that chanel, or some other reason, mayne yhey just like making people suffer.
I don't pay anything and use ad blockers and revanced to get around them :3 you can't even download videos with premium btw, because it "saves them for later" and you have to refresh the download every few days. you don't get actual video files of videos and that's by design.
Nintendo could make so much more money if they would just make a PC store like steam but for nintendo games. I would buy that store for 300 dollars and on top of that pay 60 bucks per game, to get Nintendo games to play natively on windows or linux.
You brought up VHS in this video. But it should be noted that even back when VHS and VCRs were a thing, measures were taken to prevent copying of VHS movies as provided from movie retailers. A special extra was added that would corrupt the video signal if the VCR detected that it's signal was going to another VCR, instead of a television. This could be circumvented by making both VCRs the exact same brand and model, which would confuse the first one into thinking that the signal was passing through itself. Later models would retain the second VCR detection, but include a another special addition where if the two were the same brand and model, they would tell each other when the other was recording. Allowing the first one to again, corrupt the video signal if you pressed record. I believe the very last VCRs manufactured, went so far as to detect if it was connected to a computer(because at that time, that was the new method for backing up videos, and torrenting was taking off). In short, they've been against 'backing up your own media' since they had the ability to fight against it. And the argument has always been "But someone might pirate it!" 9:56 GOG provides stand alone, offline installers for every game they sell. Statistically GOG games are the easiest to pirate because you don't need to go hunting for a shady modified EXE or DLL that has had it's checks removed(and pray that you got the right one for the right version). Get the installer, put it on a thumb drive, install it where ever, whenever you wish. Strange though, GOG doesn't seem to be hurting for cash. Might it be because us gamers have been right all this time? That people really do want to pay for their products if provided a decent service for them? (that was sarcasm meant for the likes of Nintendo, who will probably never read this comment any way)

The other issue with many games now is there's no way to backup your save files. If a game doesn't allow for cloud saves and something happens to your Switch, your save is gone. Tools like the Mig Switch allow you to back up those saves to your computer.
The only problem I have with grey area tech is how flagrant many people are about using it for piracy. This is being a "heat score" and just attracts the attention of companies who are legally obligated to defend their copyrights. For example, making updates to your emulator so that it can play a leaked copy of a Zelda game a month before it was set to release is a major heat score. One youtuber did a video about how the dumper could ruin used games by getting people inadvertently banned if Nintendo sees two copies of a game with the same UUID on different accounts. He was shocked when several people in his comments said that buying, dumping and returning games was exactly what they planned to do. I want grey area tech to continue because we need things like open source replacements for Mario Kart servers that have since gone offline or ways to play Dreamcast games after the laser has died on our consoles.
I think this is more of a response to economic and social factors that affect our entire lives, not just videogames. People are hurting out there. Rent is 14x-23x what it used to be, food is getting increasingly expensive and people are depressed, ailed with traumas they can’t afford to get help for, so they look for escapes. Some become alcoholics but that requires money. Some play videogames which requires money. But it is a lot easier to steal games than booze so many people resort to that to get that escape from life they need. Companies don’t want their stuff pirated? Let’s stop pricing out your consumers. Piracy is a service issue, as Gabe Newell said. And he is right. Massive steam sales enables people who otherwise couldn’t afford to buy your game to purchase it, all in one easy to use platform with its own in built non invasive DRM, no invasive anticheat, no consumer hostile practices. Valve is no saint, obviously they do this because it makes money, but it makes money because consumers who would otherwise pirate content purchase it due to convenience

There are no Fair Use laws in Japan. Nintendo can come after you if you put a few seconds of Mario if they want. They mostly choose not to, as it is a bad look, but they can and have done it.
The last thing anyone should consider is whether something will draw the ire of a corporation. Corporations don't make the law. Something is either legal or it is not. What corporations do, though, is take advantage of their infinitely deeper pockets to manipulate the law to their own ends. The only way to combat that is for individual consumers to vote with their wallets. The ire of a corporation can only be countered by the ire of the consumer en masse. Anything else perpetuates the ever increasing stanglehold corporations have over every aspect of our lives. They will back down if they think it's in their economic advantage to do so. Make it more costly to fight game backups than they lose to piracy and they will find a way to embrace and faciliate game backups. We've seen this before.
Nintendo has all the resources they need to preserve their games, make their own "emulation" handhelds or home consoles like they've done with NES and SNES mini and yet they don't go full scale just because. But no. You're better off a lawyer for Nintendo rather than a game developer.
I think the number of people who would be equally able to and equally happy to have a career path as a lawyer and as a game developer, is probably pretty small (other than people who couldn’t do either I guess. I mean people who would be happy doing either)
I've heard conjecture that Nintendo doesn't want to compete with their own backlog. They'd much rather bury it if they think playing the old will prevent you from buying the new full-price offerings. It sounds ludicrous but I could honestly see that kind of twisted logic being a driving force behind gating off their back catalog and aggressively fighting emulation. If they see their own games as a threat then that paints a super bleak picture on their stance towards preservation.

All the cable TV DVRs we've had have had the ability to record any TV content you wanted to the device. As more advanced TV services came out, multiple simultaneous recordings were a big selling point. Of course, they make it difficult to take those recordings off device to keep or watch on something else, but it's still a thing (in Europe at least).
It's a hard concept for some people to grasp, backups themselves are not piracy, it's only if you are using them without a valid licence. If you read this and are still struggling, consider driving a car, most places it's illegal to drive without a "drivers" licence, but not all drivers are unlicenced. You can drive unlicenced, but that's illegal and you shouldn't. This isn't a perfect comparison, but the similarity is qualified permission, for driving you earn and pay for a licence for a limited time, for software you simply pay once for a licence in perpetuity (mostly). Once you have a licence, you're able to drive, you're able to run the software.
I refuse to pay for YTP simply due to Google's entire use of ads. They already make money by selling my data without consent, I refuse to give them MORE money so that they can make more money off of me. Copyright laws are insanely outdated, and were always designed to screw people and empower massive corporations to bully the little guy. When music copyrights went through in the 70's, artists were wildly outspoken about it, but still corporations forced it through because their corrupt laws benefited them. Nintendo loves hiding behind the fact that Japan doesn't have fair use laws, but that only extends to Japan, internationally they should be losing that power, but everybody is terrified to fight them due to their insane financial portfolio. It's why I'm never buying another Nintendo product as long as I live, even though I LOVE pokemon and the old Zelda games

I for one now know about the MIG dumper and want one. Not even really because I want to backup my games, but because Nintendo doesn't want me to have one. As for RUclips. I pay for Premium because my family uses RUclips Music. That said, I still use add blockers especially on devices I don't bother to log into youtube with. It's not as easy to get away, but slowly I find viable alternatives.
there's also the issue that there's so many scam ads that show one thing but are offering an entirely different product such as the mobile game ads for "hero wars" and shit like that, google needs to take a stand on cracking down on false ads that scam you into buying one thing when you're advertised another

How many of us have been purchasing games online and physically for years across multiple systems, I certainly have! Well, corpos have been blocking us from copying and replaying our own games for years! That should be illegal unless I can call 1800 Sony and request them to mail me physically or digitally playable copies of every online and physical games I ever purchased, including the ones I've downloaded to my systems.

We still know nothing of the patents. Additionally it's guessed by lawyers this is gonna take like 5 years average and not something that'll be one and done. I only notice that Nintendo striked once Pocketpair became a member of Sony. Which even then I know the kind of company Pocketpair is and I'm not that hyped for it. But I know there was apparently some tweets of an ex-Pocketpair employee who worked on Palworld practically outing the game as Pokémon plagiarism enforced by the CEO? But I don't know how much merit that runs. There were also some statements that Nintendo was looking to sue Palworld before it even released, which if that turns out true, makes me wonder "what exactly did they do that the other monster catching games didn't do?"
I think Nintendo acted fast to prevent the dumper becoming too popular. Now LTT on the other hand is so popular already that people often blindly take words of Linus and his crew for granted. So the damage is done on Google's side, Nintendo however does well fighting their issue. The Mig Flash and dumper being hard to obtain doesn't help.
The issue is that, by stating in the ToS that you don't OWN the software, you're only indefinitely licensing it for an unspecificied time until they decide you will no longer use that software. They want to monopolize and gatekeep. Nintendo is famous for this. Linus, and I can only extrapolate given his historical position, COULD be very tentatively poking the bear in an attempt to start the war to change the outdated boomer legislation of the 1980s and corporate monopolization.
Linus also needs to be really careful since a big part of his income is from RUclips. Sure he has Floatplane to fallback on but would all his viewers on RUclips really head over there and subscribe? That'd cause him to lose sponsors as well because he wouldn't have such a big audience. Hell if everyone did just move to Floatplane would they be prepared to handle the massive increase in bandwidth required?

Current or not in many jurisdictions you have a right to backup software in case of original media (disc/sd card/cartridge) is damaged. For digital goods it still as far as I know also applies. For example one might have a backup HDD with digital installers but this drive will not last forever and for redundancy one might clone such a drive.
The problem with saying that adblocking is piracy comes from the fact that I can GET UP AND WALK AWAY FROM THE AD AND NOT PAY ATTENTION TO IT! Until the day comes that people are strapped down and forced to watch ads whenever they come on adblocking is not piracy. You aren't getting my money regardless so why is this even being argued?

I skipped over Linus' video because there were other videos on my subscription page that I chose to watch over his, and it was taken down before I got to watch it, and TBH I didn't even realize it. BUT after his "apology" video showed up, I clicked on it and watched, and THEN I remembered skipping over it and it just not ever showing up again.... BUT like you said, his video was right there in my suggestions, but from someone else, so I watched it. Streisand Effect, indeed. I wasn't particularly interested in the MIG Switch when it came out, I thought it was a bit janky and more likely to wear my cartridge slot out with constantly jacking it off to change titles. Plus, I have an unpatched system that I can boot into CFW whenever I please, but I never copy my games, and I have virtually no interest in pirating them. I have great love for the Big Red N, and want to support them. However, what they have done here has pissed me off so much that I am going to buy a MIG Flash and a Dumper purely to spite them.
just a slight correction or clarification: making VHS copies of copyrighted releases was and is illegal and always has been. we aren't talking about making backups of home movies.
Btw, is it illegal in US? It's always wild for me when people say piracy is illegal, because here in Poland it's not. I can copy/download any software I want, as long as I don't distribute it. So torrenting copyrighted work is illegal as I also distribute it. But other than that, it's fair game.

I treat The High Seas like a way to demo a game/software because if I'm paying 30,40,50+ moneys on a software I want to make sure it's worth it and if it is, I am happy to pay and get the benefit of updates, online play, supporting the Devs and much more.
Corparations are a higher issue than countries themselves. They have more power and no regulations than countries because countries are scared of making something. If European Union, where I live, makes a law on something, companies will continue their things elsewhere in the world. That's why I fear that even our countries are weaker than corporations. If we fine them, they'll continue their business because it's just a low price compared to what they can have in one month. For example, if they have 10 trillion and the fine is 15 million USD, it's like they lost 1.5 cents if I had 10 thousand USD on my account, it's nothing. They are just higher than countries, and if we fight them, it would be a potential financial loss. That's the geopolitical side of the thing. If even countries can't do that much, we as consumers are just tiny electrons in the grand scheme of things and nobody could help you.
I personally was already using adblocks just because of how bad the ad situation has become on RUclips. I am sick and tired of Google thinking they can serve me the dumbest ads and now make longer ads unskippable. I also love the fact that now instead of skipping all of the ads they serve you at once, they now make it to where they will let you "skip ahead" of the current ad and move on to the next one. I will always block ads from now on.
I wonder why I constantly get targeted by Christian ads trying to get me to go to church and love Jesus. I literally never talk about religion because it doesn't interest me at all, but almost every RUclips ad has some religious connotation wtf.. of course I skipped them.
It's okay to criticize Nintendo. The only problem is some people would go out of their way to Harass/Send Nintendo Death Threats and sometimes being up Satora Iwata to criticize Nintendo which I'll say is morally wrong.

The problem in the internet is that we are very devided! We all shouldn't allowed RUclips shovel ads in our throats as they see fit! We all should use ad block, but more the all, we all should never have payed YT premium!!! Google is the most anti consumer company that exists!

This fits the saying I have been hearing lately "Play stupid games, win stupid prizes". Or in other words, pissing of customers and possible customers makes your point of view and company less attractive, with all the negative consequences that implies.
I ended subbing to youtube premium just because the sheer amount of ads sometimes was ridiculous. I use youtube sometimes at work and a couple of weeks ago I watched an 11 minute video that had no less than 5 ads. It was honestly infuriating.
There's also a gray area for abandonware. Take the Alien vs. Predator arcade game for instance, it was a bad ass beat em up made by CAPCOM that apparently, can't be brought back because of all the trademark ownerships it has behind, added to it being not so popular. So the only way you can experience this game, as far as I know, is via emulation.
I love RUclips premium! The ad-free part is great, but I also like the bundled music service. I mix and match corporations so that Google and Microsoft don't own all of my data. Maybe that just means that more corporations can now dig into my data...

Copyright laws needs to reformed bug time. The big companies are clearly misusing the laws to shut down those who talk about alternatives and criticism of their products, policies etc.
Its not a problem with the law, the problem is that RUclips automatically sides with the big corpos, if you were to hire lawyers you would eventually win but in most cases its not worth it.

@@FanTheDeckyeah that's a lot more worrisome than people think it is too. Because unfortunately there is a significantly more burden of proof on proving innocence. It's also a lot harder to get a judge to even hear a case. In fact, a judge has to approve the lawsuit before it even starts.
The bright side is that they do not take precedence into account. So regardless of the outcome it will not do anything for or against other cases

@@Dracossaint not really. copyright was always a tool to censor, not support artists. the reason for it's existence (at least historically) was so that the queen Mary the first of England in 1557 could ban books that were politically against her while also having "good" books kept to pacify the masses... it was also noted that when parliament asked why a copyright board [Worshipful Company of Stationers and Newspaper Makers of 1557] was needed they had the infamous line "to protect the artist" set up to ensure their existence as label-makers stayed... and control maintained. Intellectual property law desperately needs major reforms. There are two huge changes I think would help:
1. Make copyrights expire after 10 years. Long enough for creators to get paid, but short enough for works to enter public domain while they can still benefit society.
2. Make mandatory DRM/TPM illegal. It should be opt-in only, used only by people who understand what it is and made a conscious explicit decision to use it.
Also, we really need to break up big tech corporations.

thats was the copyright law before 10 years are the maximum allowance for media. Because some big media corporations and politicians at the time extend the called Digital Millennium Copyright Act gives Corporations and companies more power.
Make rule 3 after copyright expires if original company made the game then should be noted so let's say GTA now not copyright make your own GTA game still credits to original founders of game/company. That way still give credit where credit do. Or consider this idea for rule.

Old media and abandonware (things that are no longer made and sold by the companies that produced them like consoles or old games) can not be considered piracy from a logical perspective because it is not impacting their finances, emulation is about art preservation the DMCA laws must be remade because companies like the big (N) or maybe we might vote with our wallets to make them understand that we don't like what they are doing.
People tend to forget that the point of an ad is selling a product TO SOMEONE THAT ALREADY HAS INTEREST IN IT or create interest or awareness at the very least, if you force 100 people to see an ad they aren't interested just to reach 1 person that may want it, you are doing it badly, in mass is profitable but inefficient.
I like that you brought up Bob's ads, because thats exactly the kind of ads that YT doesnt like because they dont get a cut. They much prefer pre and midroll ads.
Veritasium handles sponsors very well. He simply says "This video is sponsored by Some Company. More on them at the *end* of the video." And then it's at the end of the video. It's so brief, that it's not even worth trying to skip because the beginning disclaimer will likely be over before you reach your keyboard to hit your right arrow.
Technicals and Internet Historian also do what Wulff does and make REALLY funny sponsor skits that feel like extensions to their videos. However, this still isn't as good as Veritasium because most people still will realized "no matter how dressed up this is, you are still trying to sell me something and that's bad no matter how funny".

not true. a youtube stream is encrypted and cannot be recovered in your Cache/temp folder unless you are using an extension or browser that "captures" the stream like Firefox. ...which is a download. it isn't 2003 anymore

From my point of view as someone who stopped buying Nintendo consoles and games some time ago now.
Their constant bullying and weirdly selective what can and can’t be shown that changes all the time, all their medling in tournaments and just about everything really makes it very easy for me to write them off as a company I don’t want to support.
I am just one person at the end of the day but I am doing my part to show that there is a consumer breaking point where the brands toxicity outweigh whatever quality their product might have.
In the last couple of years, it's been easier for me to make sense of their actions, by labeling them as a law firm, that also has an active game Development section, likely located in the basement 😂

This is a natural outcome. Small businesses need their customers to survive, corporations like this make it so customers need them or think they need them to survive. They can do anything because most people will just do anything to keep giving them their money and data. The current cultural and political climate will not allow for anything different, and people have been addled to consumerism so as not to even know how to take action, let alone have the guts to take it.

I have to say that after YT blogged ad bloggers they started sparsely showing ads to YT Premium subscribers too. And I myself have paid for Premium so I don't have to see ads, but if ads become a more common phenomenon for Premium users, I will cancel the subscription because of this.
RUclips's service problem with ads is much bigger than the lack of interest in the ads being served to you. They used to only have one ad at the start and end of the video. Then they started pairing them up. All the while you can get anything from a 5 second ad, to a 2 hour ad. And ads that are just some random RUclipsrs videos. Add to that the fact that advertisers can select the target audience, and will target ads at groups that want nothing to do with those ads, not like no interest, but stuff they would go out of their way to actively avoid. The intentionally mistargeted ads could be an attack on a particular chanel they don't like, an attack on the audience of that chanel, or some other reason, mayne yhey just like making people suffer.
This is getting too much we emulation fans should start a Petition to stop Cooperate for taking down emulators

I don't pay anything and use ad blockers and revanced to get around them :3 you can't even download videos with premium btw, because it "saves them for later" and you have to refresh the download every few days. you don't get actual video files of videos and that's by design.

Nintendo could make so much more money if they would just make a PC store like steam but for nintendo games. I would buy that store for 300 dollars and on top of that pay 60 bucks per game, to get Nintendo games to play natively on windows or linux.
You brought up VHS in this video. But it should be noted that even back when VHS and VCRs were a thing, measures were taken to prevent copying of VHS movies as provided from movie retailers. A special extra was added that would corrupt the video signal if the VCR detected that it's signal was going to another VCR, instead of a television. This could be circumvented by making both VCRs the exact same brand and model, which would confuse the first one into thinking that the signal was passing through itself. Later models would retain the second VCR detection, but include a another special addition where if the two were the same brand and model, they would tell each other when the other was recording. Allowing the first one to again, corrupt the video signal if you pressed record. I believe the very last VCRs manufactured, went so far as to detect if it was connected to a computer(because at that time, that was the new method for backing up videos, and torrenting was taking off).
In short, they've been against 'backing up your own media' since they had the ability to fight against it. And the argument has always been "But someone might pirate it!"
9:56 GOG provides stand alone, offline installers for every game they sell. Statistically GOG games are the easiest to pirate because you don't need to go hunting for a shady modified EXE or DLL that has had it's checks removed(and pray that you got the right one for the right version). Get the installer, put it on a thumb drive, install it where ever, whenever you wish. Strange though, GOG doesn't seem to be hurting for cash. Might it be because us gamers have been right all this time? That people really do want to pay for their products if provided a decent service for them?

SponsorBlock uses community submitted timestamps to skip several kinds of video segments, you can choose the behavior for each type as well as whitelist specific channels. Highly recommend.
The other issue with many games now is there's no way to backup your save files. If a game doesn't allow for cloud saves and something happens to your Switch, your save is gone. Tools like the Mig Switch allow you to back up those saves to your computer.
The only problem I have with grey area tech is how flagrant many people are about using it for piracy. This is being a "heat score" and just attracts the attention of companies who are legally obligated to defend their copyrights. For example, making updates to your emulator so that it can play a leaked copy of a Zelda game a month before it was set to release is a major heat score. One youtuber did a video about how the dumper could ruin used games by getting people inadvertently banned if Nintendo sees two copies of a game with the same UUID on different accounts. He was shocked when several people in his comments said that buying, dumping and returning games was exactly what they planned to do.
I want grey area tech to continue because we need things like open source replacements for Mario Kart servers that have since gone offline or ways to play Dreamcast games after the laser has died on our consoles.
I think this is more of a response to economic and social factors that affect our entire lives, not just videogames. People are hurting out there. Rent is 14x-23x what it used to be, food is getting increasingly expensive and people are depressed, ailed with traumas they can’t afford to get help for, so they look for escapes. Some become alcoholics but that requires money. Some play videogames which requires money. Piracy is a service issue, as Gabe Newell said. And he is right. Massive steam sales enables people who otherwise couldn’t afford to buy your game to purchase it, all in one easy to use platform with its own in built non invasive DRM, no invasive anticheat, no consumer hostile practices.
Valve is no saint, obviously they do this because it makes money, but it makes money because consumers who would otherwise pirate content purchase it due to convenience

There are no Fair Use laws in Japan. Nintendo can come after you if you put a few seconds of Mario if they want. They mostly choose not to, as it is a bad look, but they can and have done it.

The only way to combat that is for individual consumers to vote with their wallets. The ire of a corporation can only be countered by the ire of the consumer en masse. Make it more costly to fight game backups than they lose to piracy and they will find a way to embrace and faciliate game backups. We've seen this before.

Nintendo has all the resources they need to preserve their games, make their own "emulation" handhelds or home consoles like they've done with NES and SNES mini and yet they don't go full scale just because. But no. You're better off a lawyer for Nintendo rather than a game developer.
I think the number of people who would be equally able to and equally happy to have a career path as a lawyer and as a game developer, is probably pretty small (other than people who couldn’t do either I guess. I mean people who would be happy doing either)
I've heard conjecture that Nintendo doesn't want to compete with their own backlog. They'd much rather bury it if they think playing the old will prevent you from buying the new full-price offerings. It sounds ludicrous but I could honestly see that kind of twisted logic being a driving force behind gating off their back catalog and aggressively fighting emulation. If they see their own games as a threat then that paints a super bleak picture on their stance towards preservation.

All the cable TV DVRs we've had have had the ability to record any TV content you wanted to the device. As more advanced TV services came out, multiple simultaneous recordings were a big selling point. Of course, they make it difficult to take those recordings off device to keep or watch on something else, but it's still a thing (in Europe at least).

It's a hard concept for some people to grasp, backups themselves are not piracy, it's only if you are using them without a valid licence. If you read this and are still struggling, consider driving a car, most places it's illegal to drive without a "drivers" licence, but not all drivers are unlicenced. You can drive unlicenced, but that's illegal and you shouldn't. This isn't a perfect comparison, but the similarity is qualified permission, for driving you earn and pay for a licence for a limited time, for software you simply pay once for a licence in perpetuity (mostly). Once you have a licence, you're able to drive, you're able to run the software.
It's a hard concept for a lot of people to grasp.
I refuse to pay for YTP simply due to Google's entire use of ads. They already make money by selling my data without consent, I refuse to give them MORE money so that they can make more money off of me. Copyright laws are insanely outdated, and were always designed to screw people and empower massive corporations to bully the little guy. When music copyrights went through in the 70's, artists were wildly outspoken about it, but still corporations forced it through because their corrupt laws benefited them. Nintendo loves hiding behind the fact that Japan doesn't have fair use laws, but that only extends to Japan, internationally they should be losing that power, but everybody is terrified to fight them due to their insane financial portfolio. It's why I'm never buying another Nintendo product as long as I live, even though I LOVE pokemon and the old Zelda games

I for one now know about the MIG dumper and want one. Not even really because I want to backup my games, but because Nintendo doesn't want me to have one.
As for RUclips. I pay for Premium because my family uses RUclips Music. That said, I still use add blockers especially on devices I don't bother to log into youtube with.
It's not as easy to get away, but slowly I find viable alternatives.

How many of us have been purchasing games online and physically for years across multiple systems, I certainly have! Well, corpos have been blocking us from copying and replaying our own games for years! That should be illegal unless I can call 1800 Sony and request them to mail me physically or digitally playable copies of every online and physical games I ever purchased, including the ones I've downloaded to my systems.

Which even then I know the kind of company Pocketpair is and I'm not that hyped for it. But I know there was apparently some tweets of an ex-Pocketpair employee who worked on Palworld practically outing the game as Pokémon plagiarism enforced by the CEO? But I don't know how much merit that runs.
There were also some statements that Nintendo was looking to sue Palworld before it even released, which if that turns out true, makes me wonder "what exactly did they do that the other monster catching games didn't do?"

The issue is that, by stating in the ToS that you don't OWN the software, you're only indefinitely licensing it for an unspecificied time until they decide you will no longer use that software. They want to monopolize and gatekeep. Nintendo is famous for this. Linus, and I can only extrapolate given his historical position, COULD be very tentatively poking the bear in an attempt to start the war to change the outdated boomer legislation of the 1980s and corporate monopolization.
Linus also needs to be really careful since a big part of his income is from RUclips. Sure he has Floatplane to fallback on but would all his viewers on RUclips really head over there and subscribe? That'd cause him to lose sponsors as well because he wouldn't have such a big audience. Hell if everyone did just move to Floatplane would they be prepared to handle the massive increase in bandwidth required?

Current or not in many jurisdictions you have a right to backup software in case of original media (disc/sd card/cartridge) is damaged.
For digital goods it still as far as I know also applies. For example one might have a backup HDD with digital installers but this drive will not last forever and for redundancy one might clone such a drive.

The problem with saying that adblocking is piracy comes from the fact that I can GET UP AND WALK AWAY FROM THE AD AND NOT PAY ATTENTION TO IT! VERY WELL DONE!! I skipped over Linus' video because there were other videos on my subscription page that I chose to watch over his, and it was taken down before I got to watch it, and TBH I didn't even realize it.
BUT after his "apology" video showed up, I clicked on it and watched, and THEN I remembered skipping over it and it just not ever showing up again.... BUT like you said, his video was right there in my suggestions, but from someone else, so I watched it. AND I learned some things... some very useful things :)- THANKS LINUS AND RANDOM RE-UPLOADER!!!!!!!!!!! Now I don't have to go through some sketchy website to download things that just "randomly" disappear :)
Streisand Effect, indeed. I wasn't particularly interested in the MIG Switch when it came out, I thought it was a bit janky and more likely to wear my cartridge slot out with constantly jacking it off to change titles. Plus, I have an unpatched system that I can boot into CFW whenever I please, but I never copy my games, and I have virtually no interest in pirating them. I have great love for the Big Red N, and want to support them. However, what they have done here has pissed me off so much that I am going to buy a MIG Flash and a Dumper purely to spite them.

It's always wild for me when people say piracy is illegal, because here in Poland it's not. I can copy/download any software I want, as long as I don't distribute it. So torrenting copyrighted work is illegal as I also distribute it. But other than that, it's fair game.

I treat The High Seas like a way to demo a game/software because if I'm paying 30,40,50+ moneys on a software I want to make sure it's worth it and if it is, I am happy to pay and get the benefit of updates, online play, supporting the Devs and much more.
Corparations are a higher issue than countries themselves. They have more power and no regulations than countries because countries are scared of making something. If European Union, where I live, makes a law on something, companies will continue their things elsewhere in the world. That's why I fear that even our countries are weaker than corporations. If we fine them, they'll continue their business because it's just a low price compared to what they can have in one month. For example, if they have 10 trillion and the fine is 15 million USD, it's like they lost 1.5 cents if I had 10 thousand USD on my account, it's nothing. They are just higher than countries, and if we fight them, it would be a potential financial loss. That's the geopolitical side of the thing. If even countries can't do that much, we as consumers are just tiny electrons in the grand scheme of things and nobody could help you.

I personally was already using adblocks just because of how bad the ad situation has become on RUclips. I am sick and tired of Google thinking they can serve me the dumbest ads and now make longer ads unskippable. I also love the fact that now instead of skipping all of the ads they serve you at once, they now make it to where they will let you "skip ahead" of the current ad and move on to the next one. I will always block ads from now on.

I ended subbing to youtube premium just because the sheer amount of ads sometimes was ridiculous. I use youtube sometimes at work and a couple of weeks ago I watched an 11 minute video that had no less than 5 ads. It was honestly infuriating.
There's also a gray area for abandonware. Take the Alien vs. Predator arcade game for instance, it was a bad ass beat em up made by CAPCOM that apparently, can't be brought back because of all the trademark ownerships it has behind, added to it being not so popular.
So the only way you can experience this game, as far as I know, is via emulation.
Some people would just stop and wait for people after ads so they won't miss things like on live stream
