  • Today I explain what happens when you have 12 points on your license. This is known as "totting" or "totting up".
    When you reach 12 points within a short period of time, the court is obliged to ban you unless you can show exceptional hardship. Today, I talk about what this means for you and how you might avoid a driving bank

    Hi there, not sure if you can advise on this but two days ago I was involved in a car accident where I hit a vehicle that braked late for a junction. I have 6 points on my license currently and will likely face losing my license due to exceeding 6 points as a new driver. However my mother (whom I live with) is disabled and depends solely on me for appointments, food shopping etc. Could this be deemed as exceptional hardship? Thanks for this video, helped a lot!

      That happened to me, car went into me as she didn't leave a safe distance. Her car was mashed up as I had a tow bar. I think she got away with it though at the time as there was no personal injury. She had to pay the costs to get a new car. I gather they are tightening the rules on this and BBB will do a vid on this

    Hi weird one i can’t find a answer too if you had your license for say 1 and a half years, you are given a 12 month disqualification then had it back for 2 years, does that mean you have had your license for 3 or 2 years?

    I still don't know how that guy in the news was legally able to drive with (IIRC) 36 points on his license. Surly there comes a point when a ban is inevitable?

    Wow your videos have changed a lot. I’ve just got 12 points. First 6 I was trying to appeal as I was driving my van domestically and it had domestic insurance as the insurance messed up. They put commercial insurance on my car and domestic on the van. Luckily I wasn’t working that day and was on my way to an appointment. I started to appeal but covid hit and that got stopped. Second 6 points my insurance had run out however the insurance company broke gdpr and uploaded someone else’s documents and emailed me. I thought this was a scam and ignored it. I want to appeal both. What are the chances? I also am the sole bread winner, have a baby under 2 years old and a 7 year old. I’m a disabled self employed electrician by trade and will really struggle to make ends meat. I don’t know what to do

      @@hardcoretam they didn’t care and wanted to make example out of me. 6 month ban but good news was it took so long from the date of offence that my licence is clean and offence is over a year and a half so insurance hasn’t changed

      @@hardcoretam yes & no. The first one expired a short time after I was stopped the second time. The second one I declare. But the court case too a year after I was stopped plus the 6 month ban, so the second offence happened about a year and a half ago. So I still have to declare it for another 4 years. But I found after 1 year the insurance came back down for me at least. Maybe try to appeal or delay your case, it was a disaster travelling in the winter

    If I get 3 points on my license for going 2mph over the limit, will those 3 points be active for the next 3 years but on my record for the next 4 years?

    So can you no longer get someone else to take your points if its extreme hardship and courts may not give a crap only choice is bribery and risk it right anyone experienced this please reply

    I have just been banned from driving and even though I had told the court that I will be evicted from my home as a result of having the only job they still didnt give two hoots!

    I seem to remember the sequence of commission and conviction also plays a part , back in 79 ish I ended up near double , a barrister set the magistrates straight and the ban was lifted

    Can anyone answer this I have received a summons to a magistrate court to answer a charge of battery there was no phisycal contact involved was more of an verbal dispute but in my court summons they have asked me to bring my provisional licence as they may need to put points on my licence or suspend I've never owned a car no vehicle was involved this incident was with a train station ticket office manager and I was interviewed by British transport police but I cannot work out why they want my licence

    Hi great video I have court next Tuesday but I don’t have barrister as I can not afford one I’ve just had six points taken away this august I also did a speed awareness course about three weeks ago for the court case I was doing 95 mph in a 60 mph I need my license for work also my apprentice can not drive and I live in the middle of nowhere miles from anywhere without my licence I’ll be jobless and homeless as will my apprentice have any you advice 😊

    I read that points stay valid for 3 years but stay on for 4 , could you clarify what that means , I got 3 points just under 2 years ago , am I back to zero and in the clear in 1 year then ? And the extra year is just for idk visibility purposes and nothing to worry about in terms of the number I have

      @Harry Mason never found out bro. I think if have 9 points and one of the 3 points is past it’s 3rd year but not past it’s 4th year - you’re ok to get another 3 and won’t be banned.

      It’ll only cost you £3000 in solicitors fees and you’ll still be banned !! Consider that too

    I gather they are tightening up the rules, to stop excessive hardship excuses, so many motorists were driving well over 30 points and they were a danger on the road. I don't know the exact date when this is happening, but hopefully if you know, you can do a video of the new changes.

    If you have a relative that relies on you to drive them to life preserving hospital appointments and you tot up and hit 12 points... you obviously didn't give a flying ferret about them anyway. It's about time exceptional hardship excuses were removed or at least only allowed once. Full stop.

    ​if someone has committed no crime is not wanted, or on bail etc, under what circumstances can the police perform a PNC check? So say for example they were provided with intelligence (even thought all paper records were whittled away/destroyed) which turned out to be a court mistake/cover up where a 13yr old unissued order (never ever found on numerous PNC searches over the previous 13yrs) comes to light, could/can that error be enforced without a court hearing, explanation or apology?
