What is so crazy about this is that I know Drake’s lawyer. I couldn’t believe it when I saw his name attached to this case. Michael Gotlieb is one of the best litigators in the nation. He does important work, such as representing the election workers in Georgia Giuliani smeared and national security. This case is beneath him and Wilkie’s crisis team, so they must really believe in Drake and his cause to take this on. Their crisis team deals with very large and complex cases for clients, usually corporations, who are facing total destruction because they are facing fights on multiple fronts in multiple jurisdictions, some of them in different stages of litigation. I know people say that anyone will take a case if offered enough money but, if that were true, Drake doesn’t have it.
There is something fishy going on here. This lawsuit looks like it was written by a 1L student who failed Civil Procedure, Contracts, and Torts. Everything about this is incorrect. The lawsuit is one big unprofessionally written motion to dismiss and an invitation to an anti-SLAPP suit. It’s as if they laid landmines for themselves to blow up their case so that it never makes it to trial. Not only that, it appears that they are trying to make Drake look bad with the specious claims of antisemitism to targeting only black streamers. This has to have been done on purpose; perhaps with the intention of damaging Drake’s relationship with UMG so badly that they no longer want to deal with him. Whatever the reason, I’m never letting him live this down.
Why are you not letting him live this down? What did he do wrong by suing UMG? Also, if you have such admiration for the lawyer why question his reasonings of why he wrote that document? You are not a professional and don't have any expertise on the matter so why would you think your opinion on the document is valid over this lawyer. Makes no sense
@@vexthegreat9167 🎯🎯 an anti SLAPP is something that someone I watch explain, recently. They are going through a defamation trial, atm...but they are the ones suing though. Another RUclipsr made some unverified (read, false) accusations about them and then repeatedly doubled down on those accusations after receiving a cease & desist. The claimant lost out on job opportunities and other hardships from those remarks. It's all kind of other stuff to that story, but my thoughts immediately went there with this UMG thing. Like, wouldn't they be able to do that and place Drake in an inconvenienced limbo? Because the RUclipsr being sued, used that very thing to try and wait out the person that they defamed in the first place. It didn't hold and then original suit was able to continue. But it was costly amd time consuming for the person who was defamed to have to navigate and deal with.

he wont let him live this down because it's an objectively silly case to take as a renowned lawyer known to work on important national issues, now working on a case for a butthurt artist who lost a rap battle.
What drake is doing wrong by suing UMG is destroying his reputation, destroying his public image, and destroying his relationship with UMG. This is a frivolous and hypocritical lawsuit that really shouldn't be tried in the same court as sex predators and financial thieves and deviants, it really shouldn't be tried at all because an artist deserves the freedom of expression through their art and music. Drake said terrible lies about Kendrick as well, Drake started the beef, and Drake begged Kendrick to drop and to talk about him liking kids.
You answered your own question within the third question: He has so much admiration for the lawyer, because of which, he is questioning the reasoning for the UMG lawsuit because he's clearly familiar enough with his work to know when something is off. As he mentioned in the second paragraph, "This lawsuit looks like it was written by a 1L student who failed Civil Procedure, Contracts, and Torts" which honestly, even I, not a lawyer or anything close to one, can agree with because when I first read it, it seemed like Drake himself wrote it, not some professional lawyer. It sounded so whiny and cringe.
Finally, this person is using his critical thinking skills. Each one of us could have googled the lawyers and made these connections, but this person did it for us. We KNOW in the past that labels have sent lawyers to an artist actually help PLACE BLAME on that same artist. for example, to get diddy out of trouble way back when, the label sent lawyers to one of the other people who was there the night of a shooting, and the lawyers purposely did a terrible job defending him, and that guy got in trouble and jailtime instead of diddy. There is reason to think critically here because labels can be powerful and 10 steps ahead, as we have evidence of that in the past. basically just speculating that something weird might be going on.
The simple answer could be that he wants to build up his "portfolio" with a high profile celeb case. celeb lawyers eat good. the non simple answer could go much deeper and potentially enter the realm of conspiracy

With regards to the commercial communications exception, I believe the speaker would be UMG because they are the ones publishing the material. UMG is saying, that exception does not apply to us because the exception has been determined by other courts to only include speech that is ABOUT the product they are selling. In other words if UMG had board meeting about their strategies for making sales, that would be subject to the exception. But their "speech" of publishing songs is protected

Yes, exactly. If UMG had issued promotional material about Not Like Us that was like "check out the song that exposes Drake as a pdf", and drake sued them for *that statement* rather than the song, they couldn't use this law to say "it's our free speech", because the statement here is about their goods, so the commercial exception to the law would apply, making them a valid target for a defamation claim.
@@ADVBCAT Which doesn't make sense because Kendrick, without warning, dropped Not Like Us with no promotional material or marketing at all. And even in the case of "Meet the Grahams, considering it dropped literally 30 minutes after "Family Matters", there would have been no time to promote or market the song.
DRAKE on the other hand, literally promoted "Family Matters" by telling streamers to "stay on stream", marketed the "red button" on instagram, and shot a whole fucking music video for it. If anything, the commercial speech exception applies more to Drake. Which when you think about it is hilariously hypocritical and near sighted.

Not a lawyer but my reading is that UMG reasons that them bringing the song to market doesn’t qualify as commercial speech. Commercial speech would be them publishing posters and ads/commercials saying “Stream KDot’s NLU, his epic takedown of Drake, the PDF! Distributed by UMG under license from pgLang.”

The petition will be dismissed since Drake is indeed violating two parties freedom of speech: UMG and Kendrick. And exactly as I’ve been saying from the beginning: if Drake cared about getting out of his contract or cared about the little guy, the only thing that matters is the bot usage and payola and if he has proof, bring it to the table now. Deformation would not have been a part of his claims at all, even how bots were concerned. All he needed to say was “yo, UMG used bots to push NLU and here’s the proof”. That’s it.
Using these arguments both the petition and the lawsuit will get dropped. The only thing to change that is Drake providing evidence, and as I’ve been calling for a lick of evidence since this started, UMG is also saying Drake has no evidence. If he does then they’re willing to go forward with it. But because they know he doesn’t, they’re saying that Drake is wasting everyone’s time and money and the courts time and resources.
He only cares about NLU not being at the super bowl. That’s what all this is about. It all boils down to the super bowl

Oh so, it wasn't the TCPA that Drake and his legal team were referencing, it was the TVA. They are suggesting that variants were used to boost "Not Like Us" streams (Us != Variants; thus "Not Like Us"), which caused the Sacred Timeline to split into the newly FORMed branches. This would explain errors in the deFAMation petition like, Kendrick being from Oakland. Instead it was motion to begin the deFORMation of the branches by pruning the streams and streamers. I thought they were tripping, but it all makes sense now.

We all know damn well that Kendrick is playing 'Not Like Us' at the super bowl. The NFL could file almost the exact same motion stating how they are simply playing a song that the public at large has deemed worthy of being "needed", and that they themselves aren't saying/singing any words. Not only that, but haven't both the NFL and the NBA played the song over live broadcasts? I believe we're way past them being implicated in any sort of way
I believe that this MTD will be denied as the court prefers resolution on the merits and there appears to be claims that continue to have some level of merit.
