Hey! Im curious about your opinion on something sample related. Kanye west has song off his new album called Lord I need you and in the song He samples the voice of a lady (bri babineaux) singing her own lyrics and adlibs over instrumentals of a song called make make me over. The sample had changed the chords of the original song as well. The original singer believes he deserves full credit for the sample but shouldn’t the women who sang over his song get either some or full credit since Kanye only used her sound and didn’t parts of the original song?
As far as the sample, or any sample that Kanye uses, it's subject to a license agreement. And so anyone who has a claim in the song, has the ability to negotiate what they want. So for example, if the singer signed her rights over to the other person, that person controls everything! In regards to whether she's represented, I don't know about that particular song. Kanye West if very known for sampling music, and he does go through the proper process. And that's why we've heard from him before when he gets frustrated because he gets something cleared and that kind of thing. So, I don't know about that particular situation but the answer is: you have to do a license agreement and then all rights have to be negotiated as part of that.

I do have success in the field, and am a source of information to other independent artists. My career is well managed, and as an Entertainment Attorney I am confident in representing a lot of big name artists as well. Hope this helps clarify your confusion!
