Art style cannot be copyrighted. There are pals that use a pokemon art style but that's not illegal. Designs can only be copyrighted, but similarities don't warrant a lawsuit when they're 10%+ difference
Pokemon stole a few other things: * The DBZ artstyle (seriously look at gen 1's instruction manual) * Monster designs were a parody of Final Fantasy much like Palworld's were of Pokemon
Okay People here's this pocketpair made a game called Craftopia it came out from 2020 way before pokemon did their own open world game mechanics. They even had all the legal rights for Palworld to use all the mechanics from craftopia and other add on before their release.

Unless you are going to answer 'Pokemon ABCDEFLBGT' And if you haven't noticed, Nintendo primarily operates as a publisher, it's smaller Japanese studios that signs contracts with them to release games on their platform. You will notice some patterns here, on other non-nintendo platforms, there has been gamepass, PS+, and Ubisoft and EA variants of subscription models and whatnot that throws masses of 'old cheap games' at you... But Nintendo is the only platform that lacks it.
Palworld copies much more from Ark than it does from Pokemon in my opinion. I might never buy Nintendo again. I hate their ethics SO MUCH, not getting my money anymore.

There’s something much bigger at play here than just a simple violation of patented technologies. If Nintendo is pushing litigation, it doesn't necessarily have to be about merit. They could be using this strategy to drain Pocketpair financially by burying them in court costs. Pocketpair likely doesn’t have the resources to sustain a prolonged legal battle against giants like Nintendo and Pokémon. This could be about suing them into submission. I’ve been explaining some of the ramifications if Nintendo wins, and the outcome isn’t good for the industry. Nintendo's litigious approach highlights a deeper issue: lack of innovation. Instead of encouraging competition, large companies can simply sue challengers to make them waste their resources. I doubt Pocketpair would even be able to settle on favorable terms, and I’m not sure how Japanese courts handle such cases either. The biggest problem here is that Nintendo has no real legal leg to stand on, yet they’re willing to play the bad guy. And what’s worse-many people will celebrate them for doing it.
Heres the real kicker for a legal battle though, Microsoft already is aiding palworld cause i believe...they are working together in some capacity But also apparently, as I've only heard this in the firm of comments, Sony is partnered with Palworld to make an Animated Series or something... I think this would mean Microsoft and Sony could and SHOULD if possible be able to help Pockpair be unharmed cause they are partnering with the IP/Palworld brand... So i would think both would see Nintendo being petty and shit then go "Ok you need to back the fuck off this time" Especially cause if its gameplay mechanics like... Since it's a patent lawsuit and not copyright, it may not even be something from Pokémon. I was thinking maybe it could be Tears of the Kingdom/Breath of the Wild. That's the only other Nintendo game I can think of that's somewhat similar. Then again it might still be Pokémon.

To my knowledge, neither of those games do anything new. They're basically casual survival games if we're looking at what they did compared to previous Zelda games. But you have Conan: Exiles that has you building bases, crafting equipment and food, capturing creatures and people to work for you. To my knowledge, Exiles came out before the last two Zelda games. Same goes with Ark: Survival Evolved. While people say Palworld is Pokemon with guns (which is kind of true) I've always referred to its gameplay as Conan: Exiles without the blood and nudity.

Pokemon doesnt own Monster catching Square Enix did it first with Dragon Quest 5 and made another monster catching game with The World of Final Fantasy.

You're forgetting that Sony owns the marketing rights to Palworld, Sony is a bigger company overall than Nintendo and has more experience with legal matters Across many fields, not just gaming. They can easily provide pocket pair with legal assistance.

@@solitaregames What they did specifically is on April 1st 2016 they moved the responsibility of Sony's gaming division from Sony Interactive Entertainment (Japan) to Sony Computer Entertainment (California USA). All the other Sony sections are still in Japan and this move won't last as the executives of the Sony group won't accept this kind of failure.
Competition breeds innovation. Competition is a pro-consumer concept, obviously Nintendo see’s them/this game as some degree of competition or, in some capacity, as a threat to market share. Again, even to some degree. It’s insane to sit there and cheer Nintendo for this move, it’s too “fan boy” to the point you’re shooting yourselves in the foot at the end of the day. If you like the idea of a healthy gaming ecosystem of options, this. Is. Not. A. Good. Thing. IMO it does make sense for Nintendo to wait for the game to be more successful, that could translate into a more lucrative lawsuit potentially. But I have no idea.

Gonna say it again clearly: *This is a lawsuit in Japan, subject to Japanese law.* This means 2 things; first it means we won't know anything about the lawsuit until either side speaks about it. Japan doesn't have an public court system like the US, you can't just look up case filings as a civvy. Secondly, Pocketpair has a very high chance to lose even if they're completely in the right because that just how Japan's legal system is built. There's a very real chance Nintendo found some of their code in Palworld, there's *also* a very real chance this is all horse crap and Nintendo just doesn't like having a competitor on Steam, the PC market that Nintendo isn't a part of. We'll just have to wait and see what happens.

Yeah palword still has issues… but it was still running way better than pokemon Scarlet and Violet…. Even with the DLCs… I love pokemon… but that doesn’t mean I am blind at the issues it currently has. I just hope that Legends ZA is better… and that Palworld continues to exist… I really do enjoy both franchises (minus Gen 9 Pokemon games)

God I swear every day I hate Nintendo a little bit more, and I used to love Pokemon, I even have mew two tattooed on my arm. And yet I can’t be bothered to play any of the newer games, they suck, talk about lazy, which is why games like Palworld are so important to creating a competitive market, keeps companies on their toes and making better stuff. Palworld is so much fun, and feels nothing at all like Pokemon aside from the cute little monsters, who also feel more alive, and who I’ve pack bonded with. If I get my pals taken from me because of this, I’m going to lose my marbles.

@@tobyzilla America doesn’t really let you patent game mechanics for the most part, it’s happened very rarely, and most notably was the Nemesis system in shadow of Mordor which made the enemy adapt to how you killed it and then learned from the player and what not and your interactions would be different when you saw them again. It was an incredible concept, but warner bros managed to patent it and it’s hurt the gaming industry for years, it would have been awesome to see that implemented in other games. I just worry this will be a similar situation if Nintendo gets away with this, we don’t want a rerun of Nemesis, so tired of greedy corporations. But Japan isn’t so strict on patenting game mechanics and concepts so who knows what will happen.

There is also Cassette Monsters and Temtem. And one point they tried to sue Yokai Watch, but lost, sparking this current flood of Pokemon-like creature catching, collecting, taming, and battling games.

Nintendo used to make playing cards bought by the Yakuza, they were not controlled by the Yakuza. They probably did pay the Yakuza "protection" money, but that doesn't make them a Yakuza company. What they have patented is at least the mechanics for aiming and throwing an object with an object, dodge action during an opponent's attack, free movement during combat, riding and flying a creature, harvesting and foraging materials, and the boss battle.
Looking back on history, this story has parallels to back when Universal Studios was suing Nintendo because of Donkey Kong. I hope it plays out in simiilar fashion where the underdog wins.

They can't patent gameplay mechanics for 2 reasons. 1) The pokemon games don't have guns, nor can you catch people. 2) Imagine if Nintendo tried this shit with platformers and Mario. It's not allowed to be patented or copyrighted. It would be like the copyright of the word Edge. Yes, it used to be copyrighted.

If there isn't, the law itself would be biased to the point that eventually at some point in the future; said law will be questioned itself. Japanese laws are made to favor the big fish. Not the little fish. Specially with patent and copyright laws. And he also spoke in livestream about this lawsuit as well. And so far, Nintendo has this court case won. That this has more of a high chances to end on a settlement.
I wonder if this will be settled out of court. I work as a dev - months ago i took a close look at a number of their 3D models. Obviously none of the Pals are 1:1 copies of a Pokemon counterpart. But from a Rigging / Modelling standpoint - the way the models are built are dangerously close. I'd even say that if i took a Pokemon 3D model - modified it a bit, add an appendage here and there, edit some edge loops etc - its very possible to come out with a completely new model. I'm just speculating - but it's possible that this could be Nintendo's basis for the lawsuit.
To be fair you could say that with a lot of things. The way a lion is made well ofc it’s going to similar to how someone else makes a lion same with something like dragons. The reason they are similar is because how else are you going to make some of the pals. A lot are just abstract animals not much wiggle room on making topology different or rigging.
Only issue with that is this is a Patent Lawsuit, designs and models would fall under copywrite instead. So they could be suing them for using the Monster Capturing mechanics, or allies fighting for you. Wonder who they will sue next, Age of Mythology for having summoned troops?

What a joke. Imagine owning the Pokémon license for over 30 years, and in all that time, you haven’t managed to make a single truly GREAT Pokémon game. Then an indie studio comes along, and within two years, they have an instant hit with 12 million copies sold. Meanwhile, Nintendo and The Pokémon Company are literally shaking in fear because they just can’t seem to create a solid game. I would love to see developers, Indie or otherwise, start pulling their games off the Switch and not develop for Switch 2 as a result of this and as a sign of support. Obviously not everyone's going to do that, but hopefully at least some will, enough to make headlines in gaming news at least.
Yes they should in protest heck if I become a game developer I wouldn't port my stuff on thair platform not just because thair systems are underpowered but also Nintendo hates creativity and now indie developers like it was one thing that Nintendo goes after fan games and mods but it's another that they are going after a legally distinct indie game
If a bunch of small indie devs want to pull games off of Nintendo they won't care because there are major publishers especially Japanese ones that'll never quit supporting Nintendo.
It doesn't have to be a major game concept. It could easily be the patent for starting a battle by throwing a ball in 3d space, a patent they obtained from Pokemon Legends: Arceus. Or the more recent one for riding a beast, US20240286040A1. Game mechanic patents shouldn't be a thing. It'll take a while for the internet to scour Japanese patent records for possible culprits, as what people have done when Konami sued Cygames for Uma Musume for their trait inheritance mechanic.
Simple fix. Make "palspheres" into "palcubes" and turn the "Palbox" into the "Pal Station" and you literally destroy the entire argument. Have this for free, Pocket Pair!
There are two reasons sometimes companies wait to file. File immediately, little money, vs if infringement and wait you Nintendo can get a much bigger payday. 2nd. Sometimes big companies push weight in fear of involvement due to court fees, and settle for a fee outside of court. A good example of this, Prey of gods. Kickstarter game sued much latey by Bethesda's because Prey was a name of their game. Settled outside court. Named game Preay of gods.
This could be like Nintendo vs universal. Universal used nintendo and lost. so this can apply here and nintendo tried to sue Pocketpair but Pocketpair wins.

Although I like Pokèmon, I am really sad to see Pokèmon bullying other monster franchises like Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Yo-Kai Watch, Palworld, Bakugan, Monster Hunter, Monsuno, Moshi Monsters, Monster Sanctuary, TemTem, Nexomon, or Chaotic in order for Pokémon to remain on top especially with the attempt on monopolizing the monster taming genre. For anyone who hasn't played WoW in recent years pets have always been a thing. It wasn't until much later Blizzard came up with the idea to outright make an in-game Pokémon style mechanic. To add insult to injury pets in the ingame store were outright overpowered.
If only Nintendo put this amount of effort into improving their shitty 3D Pokémon games, like they do bullying smaller companies, their games wouldn’t suck much.
nintendo did the same thing with yuzu and citra. They have a track record for waiting till the time is right and often when they do go this far it's usually because they have a pretty hard case. TIme will tell, but this aint great because they must have something and the fact is its often better to fold since you just can't fight a monster like nintendo. Even pleading your case is wallet breaking and then if you lose game over. Even winning can be game over if all ur money is gone. nintendo need a reality check. if they think palworld is copying pokemon why are they just now suing them instead of when the game was first announced. if that was the case they could,ve done the same to digimon since i think some of their designs look similar.

Okay People here's this pocketpair made a game called Craftopia it came out from 2020 way before pokemon did their own open world game mechanics. They even had all the legal rights for Palworld to use all the mechanics from craftopia and other add on before their release.

And if you haven't noticed, Nintendo primarily operates as a publisher, it's smaller Japanese studios that signs contracts with them to release games on their platform.
You will notice some patterns here, on other non-nintendo platforms, there has been gamepass, PS+, and Ubisoft and EA variants of subscription models and whatnot that throws masses of 'old cheap games' at you... But Nintendo is the only platform that lacks it.
Palworld copies much more from Ark than it does from Pokemon in my opinion. I might never buy Nintendo again. I hate their ethics SO MUCH, not getting my money anymore.

There’s something much bigger at play here than just a simple violation of patented technologies. If Nintendo is pushing litigation, it doesn't necessarily have to be about merit. They could be using this strategy to drain Pocketpair financially by burying them in court costs. Pocketpair likely doesn’t have the resources to sustain a prolonged legal battle against giants like Nintendo and Pokémon. This could be about suing them into submission.
I’ve been explaining some of the ramifications if Nintendo wins, and the outcome isn’t good for the industry. Nintendo's litigious approach highlights a deeper issue: lack of innovation. Instead of encouraging competition, large companies can simply sue challengers to make them waste their resources. I doubt Pocketpair would even be able to settle on favorable terms, and I’m not sure how Japanese courts handle such cases either.
The biggest problem here is that Nintendo has no real legal leg to stand on, yet they’re willing to play the bad guy. And what’s worse-many people will celebrate them for doing it.
Heres the real kicker for a legal battle though, Microsoft already is aiding palworld cause i believe...they are working together in some capacity

Since it's a patent lawsuit and not copyright, it may not even be something from Pokémon. I was thinking maybe it could be Tears of the Kingdom/Breath of the Wild. That's the only other Nintendo game I can think of that's somewhat similar. Then again it might still be Pokémon.

To my knowledge, neither of those games do anything new. They're basically casual survival games if we're looking at what they did compared to previous Zelda games. But you have Conan: Exiles that has you building bases, crafting equipment and food, capturing creatures and people to work for you. To my knowledge, Exiles came out before the last two Zelda games. Same goes with Ark: Survival Evolved.
While people say Palworld is Pokemon with guns (which is kind of true) I've always referred to its gameplay as Conan: Exiles without the blood and nudity.

From what I understand this is a joint lawsuit, involving the Pokémon company as well so probably not Zelda related.
Pokemon doesnt own Monster catching Square Enix did it first with Dragon Quest 5 and made another monster catching game with The World of Final Fantasy.

You're forgetting that Sony owns the marketing rights to Palworld, Sony is a bigger company overall than Nintendo and has more experience with legal matters Across many fields, not just gaming. They can easily provide pocket pair with legal assistance.
Sony no longer based in Japan. So they will have a difficult case. This is a court in Japan and laws there are made to favor the bigger fish.

Gonna say it again clearly: *This is a lawsuit in Japan, subject to Japanese law.* This means 2 things; first it means we won't know anything about the lawsuit until either side speaks about it. Japan doesn't have an public court system like the US, you can't just look up case filings as a civvy. Secondly, Pocketpair has a very high chance to lose even if they're completely in the right because that just how Japan's legal system is built.
There's a very real chance Nintendo found some of their code in Palworld, there's *also* a very real chance this is all horse crap and Nintendo just doesn't like having a competitor on Steam, the PC market that Nintendo isn't a part of. We'll just have to wait and see what happens.

God I swear every day I hate Nintendo a little bit more, and I used to love Pokemon, I even have mew two tattooed on my arm. And yet I can’t be bothered to play any of the newer games, they suck, talk about lazy, which is why games like Palworld are so important to creating a competitive market, keeps companies on their toes and making better stuff. Palworld is so much fun, and feels nothing at all like Pokemon aside from the cute little monsters, who also feel more alive, and who I’ve pack bonded with. @@tobyzilla America doesn’t really let you patent game mechanics for the most part, it’s happened very rarely, and most notably was the Nemesis system in shadow of Mordor which made the enemy adapt to how you killed it and then learned from the player and what not and your interactions would be different when you saw them again. It was an incredible concept, but warner bros managed to patent it and it’s hurt the gaming industry for years, it would have been awesome to see that implemented in other games. I just worry this will be a similar situation if Nintendo gets away with this, we don’t want a rerun of Nemesis, so tired of greedy corporations. But Japan isn’t so strict on patenting game mechanics and concepts so who knows what will happen.

What they have patented is at least the mechanics for aiming and throwing an object with an object, dodge action during an opponent's attack, free movement during combat, riding and flying a creature, harvesting and foraging materials, and the boss battle.

They can't patent gameplay mechanics for 2 reasons.
1) The pokemon games don't have guns, nor can you catch people.
2) Imagine if Nintendo tried this shit with platformers and Mario. It's not allowed to be patented or copyrighted. It would be like the copyright of the word Edge. Yes, it used to be copyrighted.
The right holders of H.R. Giger's works should sue Nintendo for blatantly ripping of his style in 95% of the Metroid games.
Nintendo/The Pokemon Company/Game Freak holds a patent on the game play mechanic of throwing a ball to catch an animal inside that ball.

If there isn't, the law itself would be biased to the point that eventually at some point in the future; said law will be questioned itself. But that's neither here nor there, the fact of the matter is, they have a chance; not matter how small it may be.

I work as a dev - months ago i took a close look at a number of their 3D models. Obviously none of the Pals are 1:1 copies of a Pokemon counterpart. But from a Rigging / Modelling standpoint - the way the models are built are dangerously close. I'd even say that if i took a Pokemon 3D model - modified it a bit, add an appendage here and there, edit some edge loops etc - its very possible to come out with a completely new model. I'm just speculating - but it's possible that this could be Nintendo's basis for the lawsuit.
To be fair you could say that with a lot of things. The way a lion is made well ofc it’s going to similar to how someone else makes a lion same with something like dragons. The reason they are similar is because how else are you going to make some of the pals. A lot are just abstract animals not much wiggle room on making topology different or rigging.
Only issue with that is this is a Patent Lawsuit, designs and models would fall under copywrite instead.
So they could be suing them for using the Monster Capturing mechanics, or allies fighting for you.
Wonder who they will sue next, Age of Mythology for having summoned troops?

I would love to see developers, Indie or otherwise, start pulling their games off the Switch and not develop for Switch 2 as a result of this and as a sign of support. Obviously not everyone's going to do that, but hopefully at least some will, enough to make headlines in gaming news at least.

If a bunch of small indie devs want to pull games off of Nintendo they won't care because there are major publishers especially Japanese ones that'll never quit supporting Nintendo.
It doesn't have to be a major game concept. It could easily be the patent for starting a battle by throwing a ball in 3d space, a patent they obtained from Pokemon Legends: Arceus. Or the more recent one for riding a beast, US20240286040A1. Game mechanic patents shouldn't be a thing. It'll take a while for the internet to scour Japanese patent records for possible culprits, as what people have done when Konami sued Cygames for Uma Musume for their trait inheritance mechanic.
Simple fix. Make "palspheres" into "palcubes" and turn the "Palbox" into the "Pal Station" and you literally destroy the entire argument. Have this for free, Pocket Pair!
There are two reasons sometimes companies wait to file. File immediately, little money, vs if infringement and wait you Nintendo can get a much bigger payday.
2nd. Sometimes big companies push weight in fear of involvement due to court fees, and settle for a fee outside of court.
A good example of this, Prey of gods. Kickstarter game sued much latey by Bethesda's because Prey was a name of their game. Settled outside court. Named game Preay of gods.

Although I like Pokèmon, I am really sad to see Pokèmon bullying other monster franchises like Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Yo-Kai Watch, Palworld, Bakugan, Monster Hunter, Monsuno, Moshi Monsters, Monster Sanctuary, TemTem, Nexomon, or Chaotic in order for Pokémon to remain on top especially with the attempt on monopolizing the monster taming genre.

For anyone who hasn't played WoW in recent years pets have always been a thing. It wasn't until much later Blizzard came up with the idea to outright make an in-game Pokémon style mechanic. To add insult to injury pets in the ingame store were outright overpowered.
If only Nintendo put this amount of effort into improving their shitty 3D Pokémon games, like they do bullying smaller companies, their games wouldn’t suck much.

nintendo did the same thing with yuzu and citra. They have a track record for waiting till the time is right and often when they do go this far it's usually because they have a pretty hard case. TIme will tell, but this aint great because they must have something and the fact is its often better to fold since you just can't fight a monster like nintendo. Even pleading your case is wallet breaking and then if you lose game over. Even winning can be game over if all ur money is gone. I love nintendo and their ip's, but i'm definitely rooting for pocket pair on this one.

nintendo need a reality check. if they think palworld is copying pokemon why are they just now suing them instead of when the game was first announced. if that was the case they could,ve done the same to digimon since i think some of their designs look similar.

Patents cover things that were invented; it can cover things (video game wise) that deal with specific mechanics like how certain things work. For example: how the pokeball opens, or how the Pokemon is forced into the poke ball, those are patentable, but the action of throwing a ball to capture, that is not patentable. You can patent how something works, but not the action of using it, otherwise the first game that designed a throw action could come after literally every game that uses that same action.
Things that cannot be patented:
literary, dramatic, musical or artistic works,
a way of doing business, playing a game or thinking,
a method of medical treatment or diagnosis,
a discovery, scientific theory or mathematical method,
the way information is presented,
some computer programs or mobile apps,
