      But what is illegal is harassment and that's what he's doing. Using the right to film/take photos to gain a reaction and keep doing it which is classed as harassment so technically could be arrested for it.

Where the problem occurs is when private concern send their employees onto public areas to try to impose perceived authority and not knowing the law. As with this video you have 2 private security guards out in public stating "laws" and refusing to acknowledge what the actual law is when its presented to them. Its "I have a yellow jacket and SIA licence (not on display) so the public must follow my instructions.

    As an ex security guard from another country it astounds me how little training security guards receive. Waitrose are negligent. These two unfortunate souls are left to their own devices and make fools of themselves and their behaviour reflects badly on the company. Same stupidity where I come from.

      @@shaka7594 The law says that he does have to have his licence visible. This is a licensable front line activity (guarding, patrolling, observe and report). And there is no data protection exclusion; only an exclusion if the activity requires that they are not identifiable (i.e. covert), which doesn't apply here.

    If SIA officers come up to you to tell you to stop filming, make sure they have their Public Space Surveillance Licence, as they're trying to taking control over video footage. If they're unlicenced to do so, they're making an illegal request under their existing license conditions. Also, while the Section 26 of the criminal justice and courts act mainly covers corrupt or improper exercise of policing powers and privileges, it also applies to licenced SIA officers in certain situations. in this case, the guy at the start is indeed acting as the security guard for the business and thus acting under his SIA authority. Liability for SIA is not limited to civil charges outside of the property he's working on, as section 7 of the private security industry act 2001 notes the license requirements, and liability of legal consequences including fines, and criminal charges.

      Your actually wrong here, its only required when you contract security, however Waitrose don't need it because they own the site and employ the guard for the sole purpose of a privately managed area, its called in house security, Ive looked into this in depth.

      Doesn't matter he's dealing with a member of the public in his duty of a licensed sia security. Check the govt security website laws. Better still, watch the dj audits video of him, talking to a sia corporate regional manager, at a trade conference. The sia guy makes it very clear that not wearing your sia licence, which must be visible, not hidden, is a CRIMINAL OFFENCE, except when working covertly, or its been reported lost, or stolen. Waitresses can not employ private security, to deal with non waitrose employees in the uk, unless they are sia licensed. Its the law.

    I work for Waitrose and I am quite literally seen a lot of these videos of Waitrose employees coming out to see two photographers and videographers that you can’t do those sort of things…
    I go around taking pictures and I’ve never been stopped by the security guard so far and I’m quite glad for that but I don’t like it when other people get stopped because they are not doing anything harm it’s the job of the security guard to observe and then report not to intervene if they don’t know the laws

    Suspicious is one of the most abused words in the English language. When the presumed security guard tells DJ that he is investigating suspicious activity, what he really means is that DJ's activities arouse feelings of suspicion in him. So, in reality, the presumed security guard is the suspicious person.

    Thus SIA operative is OUT of his area of work and you should take his number from his badge and report his
    He is putting ALL of the SIA security personnel in a BAD LIGHT, I personally was 9 yrs in security and never had a problem but this guy needs investigating and at least reporting

    7:10 The wording says "licensable ACTIVITY" not licensed premises. This guy is incompetent. He is also stupid and refuses to understand the law around his job. Does he not understand that breaking the law that covers his job, he is committing a criminal act. Not many jobs have laws that govern them, but being a security guard does. So follow the law or become a criminal.
