    Hi,
I’m in the UK since 2018. I applied for the pre-settle status in 2020. However I did not apply for settle status in 2023 when I had my 5 years. Now I want to apply but it won’t let me. Maybe I do something wrong ?

Hi! It depends are you EU citizen or non-EU with pre-settled status. If you are non EU pre-settled holder, then you can apply only after 5 years living in the UK. If you are EU citizen with pre-settled status then you can get settled status before 5 years living.

Hi. You have to wait 5 years to switch to settled status. You have to been in pre-settled status exactly 5 years. Because you got your pre-settled in 2021, which means after 2020. So, you have to be on pre-settled status 5 years.

@@UKBSImmigrationGulder That is not correct. It does not matter what nationality the person is as long as you arrived before 31/12/2020 and switched to the EU settlement scheme then anyone can count 5 years from the date they arrived as by switching to the EU scheme before the deadline meant that they protected their rights to carry on living in the UK. Non-EU citizens can also apply for settled status as soon as they can prove that they have been in the UK for 5 continuous years. They DO NOT have to wait for 5 years on pre-settled status to apply.

Hi, it depends on your circumstances. Generally, switching to settlement status is quick process and in case that your all documents are correct and you meet all requirements, the decision is taking withing 1 to 2 weeks times. I have many cases when the clients taking within 1 or 2 weeks time. In your case, I guess that that HO will ask some more evidence from you. Anyway, you have to wait for the decision.

Hi! It could take 1-2 weeks if your all evidences are ok during the automatic check. If it’s taking longer than 1 or 2 months, it means that something is wrong and Home Office could ask you additional evidence.

@FlyAudit If you've been out of the country for more than two years since you've held pre-settled status then you will find it difficult to apply for settled status. You must have at least 5 years of CONTINUOUS residence which means that you will need to prove for every year up to the 5 years that you have not been out of the country for more than 6 months at a time if not you would be breaking your residence. You'll need to supply documents showing that you've been in the UK across 6 months in each year such as bank statements showing spending in the UK, working in the UK or studying etc. for you to qualify for settled status after 5 years. This is all you need to know to apply for settled status. You are allowed to be out of the country for a maximum of 12 months within a 5 year period if it is for reasons such as child birth, study and a few but you will need to prove this and it will then be down to the official's discretion. When did you move back to the UK?
