My parents had their old tenant leave around Sept of 2019 at their old house. We spent a good amount of time doing some work and getting the house back nice and clean. They were just about to put the house back into the market to rent when March 2020 came around and the eviction moratorium came into effect. My parents said HELL NO and immediately pulled the house off the market. Now a relative lives at the house in charge of upkeep and paying the property taxes. We dodged a major bullet with a potential tenant and still not paying rent. Screw that.

My tenant refused to pay the rent for over one year citing a " moratorium ". It cost me thousands of $ in legal fees. I finally sold the property. The new owner evicted the tenant, who now has a $16,500 judgement against them making it very hard or impossible to get another rental , AND the property will never be a rental again ! Everybody loses because of idiot politicians. There should be a moratorium on them.

However, I do have a kind heart and have been known to work with my tenants if they're struggling and communicating with me. It reaches a point where no matter how much you try to help your tenant, they're never going to uphold their part of the contract. I just had to evict my tenant for being 3 months behind on rent. I tried every thing to help her succeed. Communication lacked so I finally had to file for eviction. I hates doing it, but there wasn't anymore I can do. I've let tenants slide , too, on rent payments. I've usually give more time if they communicate with me first. Don't tell me two days before rent is due that you're going to be late. I'll work with any tenant up to a certain point. I generally will remove late fees if I know the tenant has been no issues for me.
All landlords should make a stance and fight the case in court. Get an judgement against the tenant and record it so that the next landlord knows what they are dealing with.

I don't think you'll ever see that money judgement. My tenant owes me about 2,000 and i know that I'll never see that money. I never asked for a money judgement. All I asked the court to do is to evict her from my apartment.

There is another 3 months delay because of the end of the moritoriam After this there will be more of a houseing shortage because landlords will be selling their homes.

Usually stick with tenants but if you haven't been paying for a period of time. I support the property owners. It's not the property owners job to provide free housing. State and local governments should do a better job in helping people that need help.

Look at the paperwork. She only owes a portion of 1 month. That amount isn't enough for landlords to catch up on anything. So the landlord being in bad financial shape isn't because of her 1 month of a late partial payment. Cut it out. Im glad that everyone thinks landlords are responsible with their money that that tenants are the reason their situation is jammed up. Buy the house before you rent it out. This seems so one sided .. i had tenenats not pay while working and the hardship to me and my family was devastating. As a landord i worked hard to acquire my duplex and my mortage was still due. If you want to help tenants than make more public housing and stop mom and pop landlords take on the brunt

It’s despicable that it’s taken this long. Can u imagine telling restaurants you have to feed hungry people for free and you can’t demand payment. What about grocery store. There have been cases where the landlord was forced to stay homeless because they were not allowed to move back into their own house which they pay the mortgage to and property taxes. She never heard anything back from them to work out a payment plan. She should’ve just sent something monthly to pay back what she owed until she spoke to them. Go into the office to speak to someone. I hear this all the time and have to tell people why didn’t you come in after your one phone call last year? You still have a legal obligation. People really thought the Moratorium meant they wouldn’t owe the money back. While they went to work every day or received unemployment, etc. and still didn’t pay rent. What about the fact that still expected the landlord to provide water , heat and repairs. Nobody complained until they saw the bill! Some people are abandoning the units and leaving the landlord broken and at a loss.

Another year long backlog means the wheels of justice is moving too slow . New renters are waiting to move in and pay on time. Judges are going on holiday break. Landlords have to file ASAP just in case more laws are passed.

Unless you are willing to neglect the property and become a slumlord, it's challenging to make a profit as there will always be some issues.

The house already existed, nobody needed you to buy it so that you could rent it out, that why landlords are referred to as "leeches" and "parasites". I think those terms are accurate.

Some of paid to buy homes on new developments as a residence. As times and needs change, the property transitions from a primary residence to a rental. Having own 2 properties, I can tell you that the properties didn't maintain and manage themselves. It required money and manpower. Things break and wear out. Landscaping. Utilities. Garbage. Landlords do not provide a useful service or product. Instead, they use their money to wedge themselves between people and the places that they need to live in and they increase the price above what it would normally cost to live there so that they can make money off of it. It's referred to as "passive income" for a reason. Landlords are not special, nor are they necessary. They actually make society worse.

And didn't see all the work required to maintain the property, pay the bills, paint/fix/market units when vacant, answer calls, respond to tenants, settle inter-tenant disputes, etc. For what? The risk that any one apartment could burn down the whole building with a cigarette or poor cooking. The profits on 5 rental properties (14 rents) was never more than $25,000 per year and many times a loss due to non-payment and/or vacancies. That's right I HAD TO PAY to do all that work. The only thing that kept the properties afloat is the 9-5 job I have. Now I am working on selling. Too much effort. Too risky. Too many new laws telling landlords they can't be paid.

My tenant caused 13,000 in flood damage and I am having to evict my tenant. They will literally squat until you can evict them. If I take them to small claims court, they likely will not pay. I had to block their phone numbers. They provided fake background information and have criminal records! Renting sucks because people who can’t afford their own home they take care of the poor!

But...due to the outrageous tenant ordinances in both Oakland and Berkeley- your landlord needs to get you out at the first sign of trouble.
