This is the first time I saw your post…….. I’ve been rated 100% with PTSD combined with agent Orange prostate cancer. my rating took place in 2008 and the cancer a little little bit later. I have been diagnosed with sleep apnea and I was told not to put a claim in because of a possibility of reduction on what I have now. Hello, I am a new VSO and subbed your channel a few months ago. Not only have you helped me help other veterans.... You helped me with my own claim! I finally got adjudicated on SOME contentions after 320 days (from my file date not the ITF). I'm not 100% yet but hopefully soon. I learned the hard way early on. I retired in 2004 at 80%. Barely went to my appointments eventually I got reduced to 60%! I wasn’t educated! That was a bad experience. I am currently 100% P&T for 6yrs now. I will let other vets know about this RUclips channel so they want experience what I did.

This is crucial information. I didn't properly educate myself and went for an increase about 6 months prior to my 5 year window. I am pretty sure they will come up with something to reduce me, but I know now. It's the little things like this that make a world of difference. Keep it up because we need to understand the game in order to play it.

1. Get the ratings code sheet 2. Find the effective dates for your disability 3. Wait for 5 years before you have the C&P examination - don’t do the exam within the 5 year window, do it outside of the 5-yr window. Yes it’s confusing.
Not at all, the point is, educate yourself on the process and what you are doing with your claim. For example, PTSD at 30 percent and you feel it has gotten worse. Educate yourself on the 50 and 70 percent criteria, provide evidence if you have it and be able to explain it to the examiner. Unless you have your own DBQ from your private example. @@dcmoor4662 Well if it keeps you from working file for Individual Unemployability do to your disability form 21-8940 and form 21-4192 you would have to had been working but had to stop because of your disability.........hope this helps

I would just be careful on using the medical from the V.A. I know it’s very helpful with certain things, but I would stick to my private doctors because their word is bond. Unfortunately the V.A. is full of foreign doctors that think they can cure you of everything. They’re not your friends. Especially all of the nurse practitioners that are used at their hospitals, but this information was definitely helpful. Thank you. 👍🏼👍🏼👍🏼

Hi Dewayne, thanks for sharing this critical information. Initially filed a sleep apnea claim without being educated so we know what happened there. I have since had a sleep study and was issued a CPAP device by the VA. Because there was no evidence of an in-service event, should I close out the claim as a direct, or can I just modify that claim as secondary to migraines or tinnitus?

Good morning Dewayne. I am at 100%...is there anything I need to do prevent myself from getting reduced? I am over 62 and it's been two years since my rating. Please advise.
Idk if this is what hit me a 100% but i pretty much made it easy for the evaluator, I itemized every claim like I was an IRS agent, gave details of incident, names of witnesses, date, times, year, locations, name of hospital/facility & physician who treated me as well as page numbers, I started from the head & worked my way down to the feet, i pretty much gave them a more organized & verifiable version of my medical records lol! I even listed the phone numbers & addresses of each hospital I was treated at lol! I went overboard but hey, it paid off. But more than less info.
Great info! Thanks for all you do to help us 'get educated'. How does this work if the vet is 55+? Per my C File, my SC Anxiety Disorder is from 5/9/2022. But I am over 55 yo. Once the upcoming criteria changes to mental health disorders go into effect, I may file for an increase. I'm wondering if the over 55 rule protects me from the situation you describe.

If it's a joint, they have to look at the other joint and measure the range of motion. Make sure you know what can and can't be done before you file the claim. I 100% permanent and total disabled veteran. When I was getting checked out by the VA doctors, they said my knees which hurt really bad we’re not service connected and they’re at 0% if I get surgery in the future because I need a knee replacement or what have you if I’m already 100% disabled is it worthwhile to get reevaluated for my knees to see if I can’t get them service connected in case in the future I need knee surgery? I don’t wanna be 100% disabled and require knee surgery only to have the VA denied to pay or deny the surgery altogether.
If your knees are 0% that means your knees are service connected unless they were denied. A 0% is still service connected. However, if your knees are not service connected and in fact were denied then it would be of interest to file claim for your knees other than that leave it alone as you are already 100 P&T

You have to have 60% disability above your 100%. So if you have 100% PTSD and 60% other disabilities added up then you can file for SMC S housebound. It's an additional $400 a month

Well I waited for 10 years and have had plenty of appointments along with increasing pains and spinal issues. Hopefully as I keep meeting my appointments I won’t get reduced.
That's not how you get reduced, it's not knowing the criteria for the next higher percentage when you go in for an increase. If you go to your appointments and the doctor says you are doing better and you go in for an increase. Raters can see the VHA progress notes. It's more to it than just going to appointments. Hey hey hey!! I have 2 dependents from a previous marriage that I forgot their ssn and I can’t get it from the ex spouse. SSA said they are over 12 yrs old and they have to show up for me to get replacement cards. My 2 kids I don’t get to see cuz they don’t want to see me. I have child support orders and I’m supposed to claim the kids for taxes every other year but I haven’t been doing that. Do I bring her back to court to get the judge to tell her to give it to me??

Dewayne I’m 100% disabled and I’m receiving 10% disability for migraines and 0% on other service connected disability, is it worth applying for a increase on my 10% disability and 0% disability. Love your video just ran across it.
Thanks for the support to the channel. You will not get extra compensation unless qualify for an SMC. If you decided to go in for an increase, make sure you know what you are doing and what VA employees are suppose to do.
@DewayneKimble thank you for this video. Very interesting. I have currently sent away from my C&P exams so I’m going to definitely look for that rating code sheet. My back was listed at 40% since 2011. I went to an evaluation exam middle of last year looking for an increase and instead I got reduced from 40% to 20%, I only had one exam to my knowledge on my lower back. So I will definitely be looking into more dates and reading sheet for verification because I don’t believe I should’ve been reduced. I’m currently still overall rated at 100% but like I said, I don’t think my back should drop 20% after 1 exam. Any help would be greatly appreciated.

I had a scenario question. I just got increased for my left shoulder and maxed out range of motion rating at 30% (non-dominant arm). I am planning on filing for my right shoulder soon. I was wondering if I could have the C&P examiner not test my left shoulder (obviously say due to pain) when I do my exam so as to protect my left shoulder rating. I understand the DBQ asks for both shoulders to be tested for ROM even if only being evaluated for one of the shoulders. Would the examiner frown upon me not wanting to test both shoulders? Thanks for any input
They have to test the left shoulder but I see where you are going and I've seen vets do that. I can't say what each examiner will do but more likely, they will note they couldn't test the left shoulder due to pain. It shouldn't have an impact on the right shoulder but that will depend on the rater. I'm glad you understand the basic as it pertains to they have to test the S/C shoulder. Got it. Something a little off topic for this video. But I only have one visit in my STR’s (2 months before separation) for right shoulder pain diagnosed as mild rotator cuff tendinopathy due to overuse injury from weightlifting and my firefighter job tasks. I got denied for it in 2019, 6 months after separation with reasoning being it’s not chronic. I gave up for years but have since educated myself and am going to start treatment. Did I still have a chance for direct service connection with a couple months of physical therapy and another diagnosis. Pain has never subsided since military and has actually gotten worse.

I am pt unemployabilitywith a total rating of 80%. I am paid at 100%. I was diagnosed by the va for sleep apnea and use a cpap. I filed a claim for sleep apnea and denied flat out. Should I be concerned about being reduced? I have been weened off on almost all of medication for PTSD, depression and insomnia. I have been trying to live healthier. I was alcohol dependent and have been clean for over a year. I just got tired of being medicated all the time. Should I be concerned?

I tell vets one thing to do is keep checking your appointments from time on va.gov. I was part of the vets that the VA scheduled CP appointments without telling us the vets about our CP exam, then rated our claims. I still continually use my primary doc at the va for a lot of my appointments and meds. I see vets that get their rating and then never do the things to maintain it. have to stay active for sure. good stuff.

I'm 100%, but developed sleep apnea later down the road. I'm not sure if it was because of my service connected injuries (neck, psychosis), but should I file a claim to get it added to my record? The VA hospital were the ones to determine my sleep apnea and provided a CPAP for me.
I am 100% PnT and have never used the VA. I have TriCare and go to civilian docs out in town for my continuing care.Do I need to have a relationship with the local VA or am I good to go if I continue with my own docs? With the upcoming changes I am afraid to go in and draw attention to myself. Figured out of sight out of mind?

I feel I need a little help with mental health due to PTSD, it affects me socially and occupationally. If I get help and the person I get help from states in notes and what now they feel there is improvement, If I turn 55 would I still have the chance of being reduced If I get help to better myself? I do not want my benefit taken away, but I do want to feel better. And I am NOT P&T, how can I get there? Thank you!
If you go into your ptsd counseling and talk about improvements they will reduce you. Everything you say is being recorded by them. At the end of the meeting between you 2 they will produce a sheet about EVERYTHING that was talked about and your current conditions.

@michaelerickson3626 to be honest with you, brother. You have to play their game. You CANNOT hint that you are getting better even though you want to be. They will reduce you. If your in school and they ask. So how's school? School is going good I have good grades I enjoy the assignments and the work. I get along fine with my classmates etc etc. That statement to them is that your condition is improving. They ask you. So how is your home life? My wife and I are doing good we are getting along better. I'm doing really well with my kids etc etc they will take it as you are improving. You have to use discernment when speaking to them. Don't tell them everything and anything. Be vague and frank. It's extremely unfortunate we all have to play these games with them but it is what it is.

So in order to not get reduce, a veteran should not file a new claim not until after a 5 year period. Am I correct? And if a veteran makes the mistake of filing a new claim within the 5 year window, not after it, there will be a new C&P appointment where there is a possibility of decrease or increase depending on your disability status whether it has improved, stayed the same, or has gotten worst.

I received a C&P exam 20 years after my rating and the VA said that the range of motion on my back condition had improved and reduced my percentage by 30%. I did submit a new claim later and they increased it back to its original rating plus gave me 10%.

I was medical retired from Army in 2013 for PTSD (70%) and i’m like 80% VA with UI so paid at a 100% , i’m always nervous they will drop me but i feel since i was Medically retired for PTSD and have SSDI for PTSD it would be hard to drop me, i don’t work and have a real hard time sleeping and even leaving my house to get a haircut. My original VA rating happened in 2009 while i was still in and that helped me get through the process of medically retired in the Army

Will 2 C&P exams be required in order to reduce one of my ratings under this scenario? My left knee was service-connected on 4/24/2019. I submitted a claim for my right knee and back secondary to my left knee in 2019. My claim was denied, it has sat at the appeal level for going on 5 years. The VA has not scheduled me for a re-examination for my left knee in over 5 years. Had my hearing on March 4, 2024. No decision yet, not expected to get a final decision until December 2024 or sometime in 2025. Thoughts?

This is the first time I saw your post…….. I’ve been rated 100% with PTSD combined with agent Orange prostate cancer. my rating took place in 2008 and the cancer a little little bit later. I have been diagnosed with sleep apnea and I was told not to put a claim in because of a possibility of reduction on what I have now. I finally got adjudicated on SOME contentions after 320 days (from my file date not the ITF). I'm not 100% yet but hopefully soon. I learned the hard way early on. I retired in 2004 at 80%. Barely went to my appointments eventually I got reduced to 60%! I wasn’t educated! That was a bad experience. I am currently 100% P&T for 6yrs now. I will let other vets know about this RUclips channel so they want experience what I did.

This is crucial information. I didn't properly educate myself and went for an increase about 6 months prior to my 5 year window. I am pretty sure they will come up with something to reduce me, but I know now. It's the little things like this that make a world of difference. 3. Wait for 5 years before you have the C&P examination - don’t do the exam within the 5 year window, do it outside of the 5-yr window.

Not at all, the point is, educate yourself on the process and what you are doing with your claim. For example, PTSD at 30 percent and you feel it has gotten worse. Educate yourself on the 50 and 70 percent criteria, provide evidence if you have it and be able to explain it to the examiner. Unless you have your own DBQ from your private example. @@dcmoor4662 Well if it keeps you from working file for Individual Unemployability do to your disability form 21-8940 and form 21-4192 you would have to had been working but had to stop because of your disability.........hope this helps

I would just be careful on using the medical from the V.A. I know it’s very helpful with certain things, but I would stick to my private doctors because their word is bond. Unfortunately the V.A. is full of foreign doctors that think they can cure you of everything. They’re not your friends. Especially all of the nurse practitioners that are used at their hospitals, but this information was definitely helpful. Thank you. 👍🏼👍🏼👍🏼

Hi Dewayne, thanks for sharing this critical information. Initially filed a sleep apnea claim without being educated so we know what happened there. I have since had a sleep study and was issued a CPAP device by the VA. Because there was no evidence of an in-service event, should I close out the claim as a direct, or can I just modify that claim as secondary to migraines or tinnitus?

Good morning Dewayne. I am at 100%...is there anything I need to do prevent myself from getting reduced? I am over 62 and it's been two years since my rating. Please advise.
Age doesn't matter, make sure you are educated on the regulation for protections. Congrats on your benefits.
Idk if this is what hit me a 100% but i pretty much made it easy for the evaluator, I itemized every claim like I was an IRS agent, gave details of incident, names of witnesses, date, times, year, locations, name of hospital/facility & physician who treated me as well as page numbers, I started from the head & worked my way down to the feet, i pretty much gave them a more organized & verifiable version of my medical records lol! I even listed the phone numbers & addresses of each hospital I was treated at lol! I went overboard but hey, it paid off. But more than less info.
Great info! Thanks for all you do to help us 'get educated'. How does this work if the vet is 55+? Per my C File, my SC Anxiety Disorder is from 5/9/2022. But I am over 55 yo. Once the upcoming criteria changes to mental health disorders go into effect, I may file for an increase. I'm wondering if the over 55 rule protects me from the situation you describe.

You are welcome. Getting reduced if you are 100% P & T is You Tube click bait. If you are P & T, the VA is saying all your conditions you are service connected for are static (will not improve). If you go in for anything else, know what you are doing.

If it's a joint, they have to look at the other joint and measure the range of motion. Make sure you know what can and can't be done before you file the claim. I 100% permanent and total disabled veteran. When I was getting checked out by the VA doctors, they said my knees which hurt really bad we’re not service connected and they’re at 0% if I get surgery in the future because I need a knee replacement or what have you if I’m already 100% disabled is it worthwhile to get reevaluated for my knees to see if I can’t get them service connected in case in the future I need knee surgery? I don’t wanna be 100% disabled and require knee surgery only to have the VA denied to pay or deny the surgery altogether.
If your knees are 0% that means your knees are service connected unless they were denied. A 0% is still service connected. However, if your knees are not service connected and in fact were denied then it would be of interest to file claim for your knees other than that leave it alone as you are already 100 P&T

You have to have 60% disability above your 100%. So if you have 100% PTSD and 60% other disabilities added up then you can file for SMC S housebound. It's an additional $400 a month

Well I waited for 10 years and have had plenty of appointments along with increasing pains and spinal issues. Hopefully as I keep meeting my appointments I won’t get reduced.
That's not how you get reduced, it's not knowing the criteria for the next higher percentage when you go in for an increase. If you go to your appointments and the doctor says you are doing better and you go in for an increase. Raters can see the VHA progress notes. It's more to it than just going to appointments. Hey hey hey!! I have 2 dependents from a previous marriage that I forgot their ssn and I can’t get it from the ex spouse. SSA said they are over 12 yrs old and they have to show up for me to get replacement cards. My 2 kids I don’t get to see cuz they don’t want to see me. I have child support orders and I’m supposed to claim the kids for taxes every other year but I haven’t been doing that. Do I bring her back to court to get the judge to tell her to give it to me??
You will have to speak to a layer about that.

Dewayne I’m 100% disabled and I’m receiving 10% disability for migraines and 0% on other service connected disability, is it worth applying for a increase on my 10% disability and 0% disability.

Thanks for the support to the channel. You will not get extra compensation unless qualify for an SMC. If you decided to go in for an increase, make sure you know what you are doing and what VA employees are suppose to do.
@DewayneKimble thank you for this video. Very interesting. I have currently sent away from my C&P exams so I’m going to definitely look for that rating code sheet. My back was listed at 40% since 2011. I went to an evaluation exam middle of last year looking for an increase and instead I got reduced from 40% to 20%, I only had one exam to my knowledge on my lower back. So I will definitely be looking into more dates and reading sheet for verification because I don’t believe I should’ve been reduced. I’m currently still overall rated at 100% but like I said, I don’t think my back should drop 20% after 1 exam. Any help would be greatly appreciated.

I had a scenario question. I just got increased for my left shoulder and maxed out range of motion rating at 30% (non-dominant arm). I am planning on filing for my right shoulder soon. I was wondering if I could have the C&P examiner not test my left shoulder (obviously say due to pain) when I do my exam so as to protect my left shoulder rating. I understand the DBQ asks for both shoulders to be tested for ROM even if only being evaluated for one of the shoulders. Would the examiner frown upon me not wanting to test both shoulders?

They have to test the left shoulder but I see where you are going and I've seen vets do that. I can't say what each examiner will do but more likely, they will note they couldn't test the left shoulder due to pain. It shouldn't have an impact on the right shoulder but that will depend on the rater. I'm glad you understand the basic as it pertains to they have to test the S/C shoulder. Got it. Something a little off topic for this video. But I only have one visit in my STR’s (2 months before separation) for right shoulder pain diagnosed as mild rotator cuff tendinopathy due to overuse injury from weightlifting and my firefighter job tasks. I got denied for it in 2019, 6 months after separation with reasoning being it’s not chronic. I gave up for years but have since educated myself and am going to start treatment. Did I still have a chance for direct service connection with a couple months of physical therapy and another diagnosis. Pain has never subsided since military and has actually gotten worse.

I am pt unemployabilitywith a total rating of 80%. I am paid at 100%. I was diagnosed by the va for sleep apnea and use a cpap. I filed a claim for sleep apnea and denied flat out. Should I be concerned about being reduced? I have been weened off on almost all of medication for PTSD, depression and insomnia. I have been trying to live healthier. I was alcohol dependent and have been clean for over a year. I just got tired of being medicated all the time. Should I be concerned?
The DX is under VHA. Why would they reduce you, many on RUclips tell veterans that as click bait. Where does the sleep apnea fall under the five ways of service connection. I tell vets one thing to do is keep checking your appointments from time on va.gov. I was part of the vets that the VA scheduled CP appointments without telling us the vets about our CP exam, then rated our claims. I still continually use my primary doc at the va for a lot of my appointments and meds. I see vets that get their rating and then never do the things to maintain it. have to stay active for sure. good stuff.

I'm 100%, but developed sleep apnea later down the road. I'm not sure if it was because of my service connected injuries (neck, psychosis), but should I file a claim to get it added to my record? The VA hospital were the ones to determine my sleep apnea and provided a CPAP for me.
That would be up to you if you want to file that claim. VHA gave you the DX but that doesn't VBA will grant the benefit.
I am 100% PnT and have never used the VA. I have TriCare and go to civilian docs out in town for my continuing care.Do I need to have a relationship with the local VA or am I good to go if I continue with my own docs?

I feel I need a little help with mental health due to PTSD, it affects me socially and occupationally. If I get help and the person I get help from states in notes and what now they feel there is improvement, If I turn 55 would I still have the chance of being reduced If I get help to better myself? I do not want my benefit taken away, but I do want to feel better. And I am NOT P&T, how can I get there? Thank you!
If you go into your ptsd counseling and talk about improvements they will reduce you. Everything you say is being recorded by them. At the end of the meeting between you 2 they will produce a sheet about EVERYTHING that was talked about and your current conditions.

@michaelerickson3626 to be honest with you, brother. You have to play their game. You CANNOT hint that you are getting better even though you want to be. They will reduce you. If your in school and they ask. So how's school? School is going good I have good grades I enjoy the assignments and the work. I get along fine with my classmates etc etc. That statement to them is that your condition is improving. They ask you. So how is your home life? My wife and I are doing good we are getting along better. I'm doing really well with my kids etc etc they will take it as you are improving. You have to use discernment when speaking to them. Don't tell them everything and anything. Be vague and frank. It's extremely unfortunate we all have to play these games with them but it is what it is.

So in order to not get reduce, a veteran should not file a new claim not until after a 5 year period. Am I correct? And if a veteran makes the mistake of filing a new claim within the 5 year window, not after it, there will be a new C&P appointment where there is a possibility of decrease or increase depending on your disability status whether it has improved, stayed the same, or has gotten worst.

@@DewayneKimble how are they two separate things? Improving the severity of your PTSD (likely through treatment) means you will likely get reduced in your disability percentage, correct?
I received a C&P exam 20 years after my rating and the VA said that the range of motion on my back condition had improved and reduced my percentage by 30%. I did submit a new claim later and they increased it back to its original rating plus gave me 10%.

I was medical retired from Army in 2013 for PTSD (70%) and i’m like 80% VA with UI so paid at a 100% , i’m always nervous they will drop me but i feel since i was Medically retired for PTSD and have SSDI for PTSD it would be hard to drop me, i don’t work and have a real hard time sleeping and even leaving my house to get a haircut. My original VA rating happened in 2009 while i was still in and that helped me get through the process of medically retired in the Army

Will 2 C&P exams be required in order to reduce one of my ratings under this scenario? My left knee was service-connected on 4/24/2019. I submitted a claim for my right knee and back secondary to my left knee in 2019. My claim was denied, it has sat at the appeal level for going on 5 years. The VA has not scheduled me for a re-examination for my left knee in over 5 years. Had my hearing on March 4, 2024. No decision yet, not expected to get a final decision until December 2024 or sometime in 2025. Thoughts?
You are overthinking the process. Two exams that show improvement within five years, reduced or proposal to reduce.

I have a C&P exam for hip and thigh (I had a hip replacement 10 years ago). I submitted medical evidence I requested from a VA hospital and in 3 days I was set up for a C&P exam. Is that a good thing? Or is that common? I’m so worried.
