When people don't know the difference between being detained and arrested. Detained means you're not free to go until you're told you are. Arrested means you're going to jail.
Arrests don't always lead to jail. Just a booking. The cops will determine if you're a risk to yourself or others or a flight risk. Usually if you're well behaved and there's no immediate risk then they just book you and set you free, give you court date.
Being detained is you being investigated for a crime that's been committed. You cannot (legally) be detained for the officer to search for a crime which is what happens alot of the time before cameras started giving accountability. You can't detain someone if you don't already have a suspicion of and can articulate the crime they're being detained for. If they don't have a crime they suspect you of, then you can't be detained. If they refuse at that point then you demand a supervisor. You don't even have to ID until they tell u what crime youre suspected of committing and the only time you should ID otherwise is if you're threatened with bodily harm or arrest (and at that moment you have a lawsuit)
so apparently, after the first video went viral, the lady was pulled over again and just screamed her head off at the cops and blamed them for releasing the footage, (even though they have to by law when someone requests the body-cam footage.)

If requested the police has to release this information to the public. They don't have to post it on social media or anything like that but if a request is made it's considered public record so the public can obtain the footage.

Taking your seat belt off during a traffic stop isnt normal behavior. There may be moving traffic close by and taking it off makes u less safe. Been involved with alot of traffic stops, never had someone take it off when they were stopped unless they are getting out of the vehicle. Plenty of people try to put it on as they are being stopped to make it look like they already had it on, we can see you putting it on... most reasonable people leave it on specifically because they dont want cops to think they werent wearing it.

@Benji-jj2bg you may want to look up case law. Cops only need reasonable suspicion that you violated the law, even traffic law, to detain and request identification. They don't need proof. The standard required to charge someone is probable cause, which is legally defined as 60% likely the offense occurred. If a cop has an articulable suspicion, they can definitely demand ID from a passenger so long as the passenger is suspected of an articulable offense. As far as beating it 10/10 times, that's hard to say and heavily dependent on each jurisdiction and magistrate. A cops testimony is considered evidence and not hearsay. In most cases, where there may not be physical evidence available in my county, the defendant was still convicted on the Officers statement alone. In fact, Magistrate court is often the Officers word vs the defendants for traffic offenses and misdemeanors. Generally, don't make a fuss over seat belts unless children are present. Statistically speaking, it's not the individual not wearing a seat belt that dies in an accident it's the passengers because the unseatbelted person goes flying around the car after impact killing others.

Wilson states that the passenger is also lawfully detained during a traffic stop and can not leave without permission. If the passenger is the one suspected of the violation, then cops definitely can demand ID from them. Some examples would be not wearing a seat belt, odor of narcotics, or hanging from the side of a vehicle. They do not NEED to catch you breaking the law. The only need to have RAS that you have, are going to, or are in the process of to demand ur ID. Proof would be probable cause. The standard for detainment and identification, as set forward in Terry v. Ohio, is simple reasonable articulable suspicion (RAS). There are a variety of instances in which an officer didn't observe something but received information from a complainant, and they can detain and ID to investigate.

Idk, I have never had the urge to take my seat belt off when I have been pulled over. It's even weirder to be a passenger in a car and get pulled over and decide to take your seat belt off considering in a routine traffic stop you usually are not asked to step out if the car unless it's a pretty serious offense.

Taking your seat belt off during a traffic stop isnt normal behavior. There may be moving traffic close by and taking it off makes u less safe. Been involved with alot of traffic stops, never had someone take it off when they were stopped unless they are getting out of the vehicle. Plenty of people try to put it on as they are being stopped to make it look like they already had it on, we can see you putting it on... most reasonable people leave it on specifically because they dont want cops to think they werent wearing it.
They cant give you a citation unless they saw you without it on while the car was driving. So it is okay to take it off when stopping to be pulled over. Youll beat that in court 10/10.

@Benji-jj2bg you may want to look up case law. Cops only need reasonable suspicion that you violated the law, even traffic law, to detain and request identification. They don't need proof. The standard required to charge someone is probable cause, which is legally defined as 60% likely the offense occurred. If a cop has an articulable suspicion, they can definitely demand ID from a passenger so long as the passenger is suspected of an articulable offense. As far as beating it 10/10 times, that's hard to say and heavily dependent on each jurisdiction and magistrate. A cops testimony is considered evidence and not hearsay. In most cases, where there may not be physical evidence available in my county, the defendant was still convicted on the Officers statement alone. In fact, Magistrate court is often the Officers word vs the defendants for traffic offenses and misdemeanors. Generally, don't make a fuss over seat belts unless children are present. Statistically speaking, it's not the individual not wearing a seat belt that dies in an accident it's the passengers because the unseatbelted person goes flying around the car after impact killing others.

They need to actually catch you breaking the law or know that you did. If he went to court and told them he put his seatbelt on and they watched that video and saw how the commander wqasnt sure about that and the officer wasnt sure about that he would have won. And then it would turn into a 4th amendment issue cause he basically abused his power to force the guy to identify himself.
@Benji-jj2bg not sure who you're arguing with. I agreed that RAS for the passenger needs to exist to demand ID. I would note that Maryland v. Wilson states that the passenger is also lawfully detained during a traffic stop and can not leave without permission. If the passenger is the one suspected of the violation, then cops definitely can demand ID from them. Some examples would be not wearing a seat belt, odor of narcotics, or hanging from the side of a vehicle. They do not NEED to catch you breaking the law. The only need to have RAS that you have, are going to, or are in the process of to demand ur ID. Proof would be probable cause. The standard for detainment and identification, as set forward in Terry v. Ohio, is simple reasonable articulable suspicion (RAS). There are a variety of instances in which an officer didn't observe something but received information from a complainant, and they can detain and ID to investigate.
