    UPDATE: Not guilty on both First and Second Degree Murder! Guilty of first-degree manslaughter with a firearm enhancement. Facing 11.5 to 13.5 years. What a shame. He got off easy!

      He got off way to easy! Manslaughter is the lightest form of punishment he could have been awarded. Guess his defense attorney wasn't that bad after all. Personally, I think he should have got second-degree murder and 20 years.

      There were only crocodile tears during the testimony.
      From on line pictures upon his sentencing (to a measly 13 years for this crime) there were actual ‘real’ tears on display.
      Btw If he was tried in an actual military court with trained soldiers as the jury, I doubt they would’ve thought the shooting was accidental.

    The defense should have said " this story has many versions from beginning to end " that would have been more accurate in this case , lol. Thanks for the upload CCV.

  • @cateellington4081
    @cateellington4081 8 лет назад +9

    Yeah? And if Skylar Had NOT yelled 'oh NO Danny Noooo', everyone would hv said he had no reaction. This is really not evidence of anything.. A guilty person would do same. It's the OTHER evidence that says he's guilty. The lying, the jealousy, his anger & his outrageous controlling behavior.

  • @Wheezerism

    Defense, "This story is told best from beginning to end....."
    The defendant's "story", that is......
    Even even as a child, I understood one's "story" was often just one's lie.

    • @rumham7466
      @rumham7466 Год назад +1

      Yea not really a loss. When you listen to this defense lawyer in the beginning, he’s explaining first degree and second degree. Even a 2nd degree would have been a sort of “win” for them. So they definitely feel it’s a win with just manslaughter and 13 years. Likely will be out in 6.
      If I were on that jury, just the fact alone if the bullet placement would have been enough for me for a murder2. Premeditated in the 1st.. okay ‘maybe’ not as concrete. But the fact that not only did a supposed “accidental rogue” bullet just happen to not only hit the head; rather than the chair or the wall or ceiling.. it hit her head AND dead center. Meaning he pointed and aimed. So I don’t feel like it was a win at all

    Definition of what premeditation is/ does not mean to imply that every single word in said definition must be present for premeditation to have been proven. But nice try. This is why defense lawyers always want jurors to be on the intellectually challenged side. I say we need to start using professional jurors

    • @thisisme3238
      @thisisme3238 Год назад

      What constitutes a "professional juror?"

  • @cateellington4081
    @cateellington4081 8 лет назад +4

    Like all defense lawyers they want jury's to believe that in order to prove premeditation- nothing can be present that shows stupidity, or irrationality on part of killer. Again- premed can happen in seconds and be born of rage and anger in heat of moment. Oh and heat of moment killings can be premeditated

  • @Wheezerism
