  • I Had a visit to Woolpit, started to wonder around, was told I could film no issues.. as I was walking around I was stopped by a VERY nice guy called James.. We went back and fourth for a while regarding filming to be honest it was a great Audit for myself I really enjoyed talking with James.
    Unlike other people he represented the company very well and done his job as anyone would expect.
    Only issue I found was the illegal number plates in the carpark but ill leave that unto DJ AUDITS for if he Visits..

    16:20 And I'll repeat. It's not common courtesy to go up to someone and demand them stop doing something. If LaA was hopping on one leg, would James demand that he stop hopping. No one has any authority to demand someone else follow their directives. Not even police. Police can only make such demands when they are enforcing a law and doing their job. The only way someone can demand someone else follow their directives is when there is a contract of employment. Or is the parent of a child.

      Well if you were to be a visitor in my house and you did something I didn't like, you would be shown the door. An option open when you do something on private property and you don't comply to their "demands"

      @@Slotplayer1 And you make the mistake of equating your house with a "public place". Just about everywhere is privately owned, so just saying private property doesn't mean anything. And when these privately owned properties are public places, the demands that can be made are very limited compared to a residential home. So on pavements (owned by the council) you can't be trespassed. In public places you can't be made to do things against your human rights for instance. And equality laws kick in too, which don't exist in a residential home.
      As to the demands made on private property. They have to have a valid reason for it. So demanding that you wear shoes when entering a shopping mall are unreasonable when its more to keep an image and especially when the mall is at a seaside town. And on the scale of things is definitely not a reason to use any force to trespass someone.
      Banning photography is akin to banning your eyes. If you can see something you can photograph it. If there is any issue, it's not the act of filming but publication where someone can sue. And they can only sue for libel or defamation if the caption of the photograph denigrates them.

With any public space within a privately owned grounds/property you have an implied right of access that can be taken away anytime providing no other law is broken such as on discrimination grounds. You see people being thrown out of football stadiums and you have nightclubs barring entrance based on dress code. All that this S33 of that 1972 act (a very much loved and quoted act by these auditors) does is allow the authorities to convict on public order offences in those public spaces hence that you can be arrested for spouting racial insults during for example a football match. Shops and restaurants can bar you if they want and indeed do.

      @@Slotplayer1 That's my point, the public can access a public place providing no law is broken. And photography is not a crime. As for being thrown out of football stadiums, they will be because they are harassing others or causing disruption to others who want to enjoy the game or breaking the race & hate crime laws or other public order offences.
      Whilst I'm no fan of s33 since it's to do with uniforms, I see it as just gaslighting by auditors. Which is exactly what police and security do when they say filming is illegal or not allowed. But the public place part of s33 appears in many places within UK legislation. So it's a commonly defined term and legal principle. Public place means that certain actions become crimes when they aren't when done in a private place. So as you say, public order offences. But anything else not a crime can be carried out, such as hopping on one leg or using a camera.
      Slight clarification about the implied right of access. That is up to a point. The point being an entrance. So at a residential property, the implied right of access is the direct route to the front door. Not past it, and not wandering around the front garden. That's what allows the postie to deliver mail and parcels. Same as with any business which is accessible from the road.
      A place place is any private land used by the public to go from A to B, or just wander about on even if they have to pay to gain access, such as a fairground. Case law has defined that even a corridor in a block of flats was a public place because it was used by the public as a short cut from a train station to a shopping precinct and that allowed someone to be convicted of a knife crime. Case law has also further defined public place to include the inside of a shop, even behind the counter. But not in the offices and store room parts of the shop. A path to a locked door is not a public place since there is no need for the public to use it. Case law has defined that a path to the reception of a care home for the homeless was not a public place since there was no need for the public and entry was restricted to the residents and in that case the person could not have been arrested for a public order offence.
      So as you see, it's not clear cut or as simple as just being asked to leave some place on the whim of someone who perceives they have authority.

      @@TheSadButMadLad It is not clear cut indeed. However, if I sit on a park bench and you come and sit next to me and start sticking a camera in my face, there is nothing I or others can do. Do this in a restaurant (a public space in the eyes of the law) and the proprietor has every right to boot you out as you've outstayed your welcome and there is nothing you can do about. It can even happen if there are no signs on the door saying photography is not allowed

    When I go on holiday do I have to ask the local authority to take photos,these people are getting a joke.Because Im a manager do as I say,these people are power crazy.Then the backup turns up starts then are sent away well done on that James,but on the rest open your ears and listen and take it in.Great audit again.

    I have for many years worked as a Facility Manager for many large organisation an educators and I can confirm that this guy is a total tool. Missed an opportunity to talk a positive about his organisation and does not understand the law at all, keeps focused on the negatives. I wonder what he is now employed as.

    17:35 One point when people say they will phone the police is that they need to be informed that if the police do anything to you or even if the police investigate and issue a No Further Action notice, they can become liable in a civil court for all the hassle and loss of liberty that you suffer. Just a kind of heads up to make them think twice. Not something required in this case, but a possible phrase to use when they are very aggressive.

    2:45 Since he is only one of many tenants on the business park he has no authority to tell you what to do or to ask you to leave. The simple fact that there are multiple businesses means that people coming on site could be visiting any one of the businesses, so challenging anyone is rude and intrusive.

    4:40 There is no such thing as common courtesy to ask before taking a picture of a building. If there was, there would also be the common courtesy of not approaching random strangers and making demands of them. Would it also be common courtesy to close your eyes and to only open them after asking? That's basically what he's demanding.

      James could start by educating himself on public photography, then if he wants to restrict it, he can put down his barriers, and put up specific exclusion notices.
      Probably something he should have done early in his employment , but here is an opportunity to enhance his skill set , as they say.
      He was pretty good in some ways, but when he did not get the answer he wanted , his mind was closed to other opinions ( which he has probably found out by now we’re better informed than his. )

    2:30 Once you'e got the images on your uSD card he has no say in where the images go. The images are your property to do with as you please. The only thing he can do is sue if the images are published and a derogatory caption place with the images. But he would have to show how that has caused him "loss". And as for not wanting it to appear on RUclips, which is part of Google, then has he also demanded Google remove all streetview and Google Earth images of his building - and having just checked they're still there on Earth.

    11:10 A private site doesn't mean anything about barring the public from it. A shopping centre is a private site but the public freely wander around it. All a private site means is that the owner has to maintain the infrastructure such as roads, pavements, etc and not the council.

Actually in the cinema screen itself photography and filming is banned - but there is there is a valid reason - protection of intellectual property and copyright. In the foyer, photography can't be banned for the reason of protecting privacy as it is a "public place". The only part of the foyer where any reasonable expectation of privacy exists is when someone is using their card to make a payment.

You have an implied right of access to a private place that has public access but that implied right of access can be taken away at any point providing no other law (such as discrimination for example) is broken. Night clubs for example can bar you entrance based on dress code, despite the place being a public accessible place in the eyes of the law. Whether you can or can't take pictures is irrelevant.

      @@Slotplayer1 Nightclubs are again not the same as an open car park or shopping mall. Dress code in nightclubs is not about image, but about safety of others And to be honest (and it has been a long time since I've been in one) none of the nightclubs I visited in my youth ever had dress codes.
      As for implied right of access. That does exist, but not for every private property. A shop can use it to ban someone who has shoplifted in the past. They can't use it just because someone is doing something different to the norm. A person can issue it for their own home against companies and their employees. But a shopping mall can't use it against people who have broken some minor policy, since it more akin to a footpath/highway as it's a route people use to get to individual shops.
      But you are right about photography. It's irrelevant. Any removal of access should be about the person and their actions, not the thing they are holding. Using a camera itself can't be a reason. Using a camera to stalk or upskirt is a reason.

      @@TheSadButMadLad They are the same because they are privately owned spaces that the public has an invited implied right of access to that can be taken away at any time at which point if you don't comply you will be tresspassing. If you don't agree with the rules of such properties (such as no photography allowed) then don't enter. Many entertainment venues prohibit you taking your own food and drink with you and despite it being a public space there is nothng you can do about.

    Another one that does not know photography laws. Thinks his building cannot be filmed, well if his building wants to be hidden build a 10ft solid brick wall around it. At least he did listen to you though he still didn’t like it. You did articulate yourself very well though, especially with Google cars filming the building. Keep them up. Have subscribed.

    4:10 You don't need to ask anyone's permission when you are in a public place. *And you don't need to ask anyone's permission when you are standing on private land.* Permission is only required when the photograph (or video) is going to be used for commercial purposes and they are a key part of the image. Commercial purposes is defined as "the promotion of a product or service" so basically advertising or marketing. That's why one of the T&Cs of many public events is something along the lines of being at the event gives the organiser the right to use your image for any marketing purposes. In other situations, a model release form is required which absolves the person of any control of their image in return for payment. And if a contract is arranged, then copyright can be held by the person and not the photographer.

    I just carnt understand why people in this day and age when a camera is seen people get so worried n scared back in the day people loved to be filmed or even said hi mom . .. .if I saw a man with a camera idr be like knock yourself and enjoy your freedom ,free publicity these days is a win win win to the decent or professional person...think about it !!! 😉 just smile and embrace freedom

The first guy was cool and respectful and assessed that being out in public, you had every right to photograph a building and that a camera is not a threat to a building!

    The police really are not interested in private number plates , if anything it makes it easier to identify a vehicle with a private/ illegal plate than a conventional one.

    After being a bit bristly I think James settled down well enough. We do have to understand a lot of people are misinformed and a bit protective, but this auditor had a lovely calm, articulate approach and this did a lot to diffuse the tension. Good audit
