VA Changes: Am I Screwed or Protected?

  • The Department of Veterans Affairs recently announced proposed changes to the way they rate certain disabilities, leaving many disabled veterans wondering if they will be grandfathered in when the changes take place. This has sparked concerns and questions among the veteran community, specifically whether their current ratings will be protected or subject to reduction.
Firstly, it's important to understand that VA ratings are determined based on the severity of a disability and how much it impacts a veteran's daily life. Ratings can range from 0% to 100%, with increments of 10%. These ratings are used to determine the amount of compensation that a disabled veteran receives.
Under the law, the VA has the authority to reduce a veteran's rating if there is evidence that their condition has improved. However, there is an exception to this rule known as the "20 year rule." This means that if a veteran has held a VA rating for 20 years or more, their rating cannot be reduced unless there is evidence of fraud.
So, what does this mean for veterans who are concerned about the proposed changes? Unfortunately, it means that they are not protected from potential rating reductions. The only exception is the 20 year rule!
However, it's important to note that these proposed changes are just that - proposed. They have not been implemented yet and may undergo further revisions before being finalized. It's also possible that some of the changes may not affect all veterans or may have minimal impact on their ratings. The VA has stated that they are committed to ensuring veterans receive the benefits they deserve and will work with individuals on a case-by-case basis.
In addition, it's important for veterans to stay informed about any changes being made by the VA. This can be done through attending town hall meetings, reading updates on official VA websites, and staying connected with veteran organizations.
Overall, while there is no guarantee of protected ratings under the proposed changes, it's important for veterans to understand their rights and options. It's also crucial for them to advocate for themselves and seek assistance from organizations or legal professionals if necessary. The VA may have the power to reduce ratings, but disabled veterans have the power to stay informed and fight for what they deserve.
So, if you are asking yourself "Am I screwed or protected?" - remember that while there may be some uncertainty, knowledge is power! Stay informed and stay empowered. We are in this together! So, let's continue to support and advocate for each other!

I recently became *100% P&T* within the last month. I have new claims I intended to submit and submitted claims that were denied I planned to Higher Level Review (HLR) or Supplement. I am inches from 60 y/o and friends have been advised not to submit nor challenge claims.
*Question 1:* Should I still submit new claims that I know were service connected and challenge denied claims on HLR/Supplemental or just leave it alone and trust that the VA will not come to me for a reduction down the road?
*Question 2:* Would a challenge of any denied claims jeopardize my current status?

I worked at the VA for 9 years (eLearning developer), There was an incident where claims processors were taking paper claims and stuffing them up in the ceiling vents to get rid of the claims instead of processing them. A building maintenance contractor found hundreds, if not thousands of paper claims. Not one single person was ever fired. All government organizations are corrupt - but this is the worst.

I worked a VA Hospital in Texas on the NEURO/Rehab unit for 11years and witnessed and reported incidents such as an RN giving the wrong patient a heparin in infusion, that was meant for his roommate (catastrophic medication error), the same nurse tied a patient to the bed with a sheet ( big no go) , the nurse preformed minor surgery on patients with bed sores cutting off the dead tissue ( without a doctors order) and lastly the same RN used the dull end of a butter knife on a patient, who was complaining about a sore throat. I am really surprised I didn't get fired for insubordination, because I yelled at the RN in front on the other nursing staff and asked her, if she was (f) crazy for putting a butter knife down his throat. I reported this nurse several times and put in written complaints, but it was my word (LPN) retired MSgt against hers RN and she would deny it and none of the Indian nurses from India would back me up. There was so many times the RNs and nurse manager turned a blind eye and no one was held accountable for their actions, I left in 2018 and the RN retired or was finally fiired. I loved my patients, but was glad to leave the VA. My 2 best days there were my first and last.....

I feel very protected because a permanent and total rating is legally protected including by the 14th Amendment of the Constitution unless you committed fraud or if you file for an increase when you are already 100% permanent and total. They’re simply not legally allowed to reevaluate you under P&T status. The fact that the IG identified this means that it was fixed.

I submitted a claim for worsened condition in September 2023..Did the exams as scheduled in December and haven heard anything since..The examining physician told me off the record my condition has worsened markedly and that he was writing that into the text he was supplying the VA. Sonly one step up from where I am right now and that's 100%. But I have no updates from the VA and am wondering what is going on. I am 66 years old and am not getting any younger. Basically my hearing apparatus is screwed and I have extreme tinnitus with loafs of secondary conditions one of which is extreme Meniere's syndrome. Last summer I fell and hurt myself really badly, cracked three ribs and had a swollen heart as a result of s fall from a vertigo episode. That's when I decided to put in for worsened condition. The VA said in the only update I got back on November that I didn't need to submit anything else yet I feel like I am being jacked around. Just venting here. I have been hearing stories about vets waiting years for decisions. I don't think I have years to wait to be honest.

Glad I didn’t pursue the Pactact when other veterans were telling me that I should. I would have definitely lost my P&T rating from sleep apnea alone. There’s always a hidden agenda with VA changes. They’re presented as positive changes, but in reality they’re just finding new ways to take benefits away. It’s no wonder that recruiting is suffering. I used to try and recruit younger people that I thought would be a good fit, but now I warn them that they will be used and forgotten. I tell them now to go visit a VA facility and talk to the veterans in the waiting room. Kinda wish I did that first.

Of course you have no evidence to support what you allege.
I follow this stuff closely, even read daily Office of the Inspector General reports. While there's some in govt. who might fantasize about tapping into VA/VBA monies, those funds are budgeted by Acts of Congress. And it would take an act of Congress, signed by the POTUS to do that.
The bottom line: any one person or group in the Executive or Congressional branches wanting or conspiring to "transfer (VA/VBA) funds to the precious illegals in NY/CO" (your words), wouldn't be able to do that, not even on the sly (because, as Combat Craig has alluded, there's the Veterans Affairs Office of Inspector General keeping an eye on things). And truth be told, no one is going to risk going to prison for criminally stealing Veterans' money to pay for pet projects or causes, such as "lateral transfer funds to [their] precious illegals."
In regards to your "Buddy" -- a knee injury may not be permanent and total, nor even 50 to 100% disabling because this kind of injury may improve over time.
Moreover, a knee injury with surgery and/or therapy may be less disabling than prior to the corrective therapy and/or surgery.
So your Buddy should be honest with his doctors, and do everything the doctors recommend. If his condition improves, then he rightfully should be reexamined so the VBA can determine if an adjustment to his rating is warranted.
Then again, the doctors and others may opine his condition is worse than before, and/or that his injury is 100% permanent and total because he can't work nor enjoy life. IOW, like me. Because of my now-rated 100% P and T Ménières syndrome: It ended my five-year relationship with my GF, I had to give up driving, sold the SUV I loved; can't ever travel on a plane (so vacations are no longer); can't go out on the town, not even a movie; I can't do anything helpful, not even volunteering, because I'm too unreliable; can't work (not even a menial part-time job to stay active and busy); had to give up teaching at a local community college; I can't even keep my FREE VA dentist appointments.
I provided you the above information as a hint. These are the kind of statements your Buddy should be making to his
doctors/nurses/examiners. He should look to see that they are writing down this information so it is in his file, and more importantly, so that the VBA rater sees it. Also, in any communications to the VBA he should put down this kind of information.
The best way to document the disabling nature of his knee injury: he should keep a daily journal/diary about every incident where his knee injury has affected his doing whatever. For example: "Today I slipped on to the floor because of my weak knee. Was frightening because I have relatives who have died from falling on to the floor. Luckily I was able to grab the towel rack ."
Or: "Today I was invited to go skiing with a long-lost friend. Had to say 'no' to him because my knee was in pain, a six on my one-to-ten scale." (Note: VA doctors and doctors nationwide use the 1 to 10 pain scale. So your Buddy should use it too.)

Probably about 6 or so years ago. Now I hit the v. A. Contact me saying that they wanted to re-evaluate a couple of my conditions. And I told them that if they wanted to reevaluate my conditions when I didn't feel a need for it, I was going to hire an attorney and they would need to facilitate all requests through that lawyer. They laughed it off and I did exactly what I said and hired to a lawyer. Needless to say, I didn't get reevaluated and the lawyer found some sort of system to make the VA pay for their services. Probably got lucky on that.

It's unbelievable how much the VA employees can lie, reword, and not have the full report on things. It blew my mind an elderly lady could do that to a Veteran. pure EVIL damn shame. My psychiatrist wrote in her notes (after my old psychiatrist retired)? - Never attempted to commit suicide and getting better. I had the word with my psychiatrist and had been referral set up for outside private provider, but at VA expense. Here's the problem though. - VA gets the reports from private provider but I cannot see them.

They make it difficult to correct errors too. They make you use narrow language, provide line by line copies (hard to print from e-records, at Fed Ex office to make a packet to scan). They suck. It is not the people working there. It is how the illogical regulatory system works. Definite inaccuracies in my MyHealth-eVet. My employment status, my insurance status, my medical history, ALL have inaccuracies. PLUS, I had to go to private doctors to even get diagnosed with asthma. Then, they said I had asthma from childhood, when I did not. I got it after Iraq. I am leaving the US since outside, they may be more likely to pay for non-VA doctors. The worst doctors I ever saw - we are talking incompetence- were in the VA. My breast cancer scars were supposed to be seen by specialists. Primary care doctors without breast cancer expertise said YOU are FINE. Hahaaa. Breast cancer surgeon said she has to check it, but I have no job, no private insurance, so I have to see incompetent VA doctors.

Im not trying to be a dick but folks when it comes to voting stop looking at party and start reading between the lines on the candidates own words. Many Vets who are getting screwed by this went out and gladly voted for candidates who are doing this too them. They voted on party lines not listening to the policies they said they would enact. So, this being an election year remember this!! Look into your political candidate and not just their words but their actions, past statements, and most important how they talk about other organizations and groups. This is the best advice I can give as an old disabled VET.

I send people to this channel almost every day I work. There are good people at the VA, but truthfully, they don't care about boosting your disability rating. I don't work with many veterans, so they don't particularly understand the full impact of military service. Also, just like the military, 10% of veterans are shitbags and monopolize 90% of the resources and screw over the other 90% of veterans. And if you receive legit shitty service, complain. It doesn't change if we don't get rid of the shitty people and when a VA employee complains about another VA employee the response is "It is a personal problem between employees, multiple employees complain - its a conspiracy against the shitty employee, or a veteran has not complained about that person."

I was medically retired after 12 years of service and have 100% SC. Now I work at the VA as a provider because I want to stick with our population. However, I have little faith in the VA as an entity and find its resources extremely lacking for what many Veteran's needs. Seeing these wasted resources is very frustrating. Regarding being a good 'VA Employee', I can you I've been asked to do things that are unethical and flatly told her no, I wouldn't be doing that. Honestly, I think many people in the VA are scared to stand up for what is right fearing the repercussions (that is true for my immediate co-workers I know) but being 100% SC and having and having that other source of income allows me to be less concerned on that. I've filed complaints and heard nothing, considering doing a FOIA request to see how the situation was handled. A provider in another area shared that about 5% of any complaints actually get anywhere. No idea if there is any truth to that or not, but it would not surprise me. At this point I don't see much value in tilting at windmills (unless something comes up that just couldn't be ignored by leadership) and focus my time on doing the best job I can.

I did. The doctor immediately cut anxiety meds and pain meds on the spot. I filed a complaint with my patient advocate. Good idea? No!
A few months later, I got a reduction letter because " I missed a scheduled re-evaluation" that I was never notified of. I was cut back to 0%. It took me a year of appeals and jumping through hoops to get a new 70% Unemployable P&T

You should definitely check your medical records once a year.
I've looked at my VA psych stuff to share my own example and even at 100% TDIU for PTSD line, my psychiatrist writes stuff like "patient is well groomed, well dressed today, no financial issues" etc etc.
You'll see shit in there that contradicts your ratings and you need to make sure you know how to combat those if you ever get reevaluated. My paperwork says "no further examinations in the future. Unlikely to improve ever" and even with those notes in my paperwork, I still look at doctors notes to "play the game".
We all know combat ptsd from iraq or Afghanistan (insert your war here) comes and goes. 99% of your life can be no issues, but that 1% is what got you 70% to 100% rated. I've had 3 DV cases(all thrown out of course) and a divorce after getting out of active duty.
Just because I'm doing fine today with a new wife, kids are almost 18, mortgage etc doesn't mean I will be tomorrow and throw all that down the drain. If you know what I mean then you know. IDGAF about anything, yes I'm a responsible adult but I could care less about anything anymore. That's how PTSD can go.

I asked for a different PCP (for obvious reasons) in the beginning of November. My first appointment with the new PCP was January 4th. They call me to inform me that they can’t find the paper requesting a new PCP so they won’t be able to keep that appointment. I contact the patient advocate and go anyway (she’s great btw), she’s leaving the VA on January 31. She agreed to see me twice because my case is so complicated, already ordered tests, home health aides. I was supposed to be handed off to another PCP but I went to that clinic and got the same thing, we can’t find the change of provider form. Fml. Believe me, this is the short version.

I work as a peer specialist at the VA. A veteran only position. The medical director, a civilian, did me dirty, refused my step increase when I was offered a higher step increase to offset my pay difference, that was approved by both my section and my HR all the way up. Someone making 6 figures plus and is only working their until the new hospital gets built so it looks good on their resume, took an employee, a veteran at that, living paycheck to paycheck, give them a promotion and extra responsibilities….. but less pay. I now make $8,500 less annually. $327 a pay period. Not every one that works at the VA is bad. I’ve found a strong correlation with bad civilian employees and good veteran employees. And even though miss quarter grand a year has a right to pencil whip, just as fat nco can pencil whip a pt test, doesn’t mean it’s fair or right. This is a week after she made a joke after a bomb threat saying we wouldn’t be able to find it and it would be a waste of resources to look for it. WTF!!!! Only when disciplinary action is taken against the VA raters and their supervisors will there be a positive improvement. If you believe a C&P examiner (usually only a nurse that does nothing but C&P exams) has made false statements on your C&P exam report, file a complaint with the appropriate state licensing agency. I have filed a complaint against a LHI nurse C&P examiner and there was an investigation initiated by the Texas Nursing Licensing Board. If there are enough complaints about the same nurse the licensing board can suspend or revoke the nurses license. Your medical team is very helpful in understanding the evaluation process.

It's a amazing that I have requested my mental health reports after the C & P exams - the VA claims that they were too busy to get the reports and their recommendation was to send via request by US Mail - I did and got no response for months - not sure if the reports will come. It's so sad.

I would happily mail a letter to my state's politicians that outlined the facts contained within the OIG report's findings of VA misconduct and the 'proposed' changes from the VA that are currently being floated (e.g. Tinnitus) should someone craft one (which cites the references).

Albeit not in VBA, I am a non-clinical VHA employee. Do we have typical federal large agency processes....of course yes. 90% of my fellow VA employees are vets and that is culturally a good thing. We do remove people that don't carry their load. We will hold each other accountable, despite our workload. Why? Because we are vets with a conscious. If I was king, the best thing we can do for the VA, would be to grant the VA both authority to replace old hospitals and stable funding. Yes, stable funding would immensely help DoD also. We have not had a budget passed on time since 1995 and matters in DC are only getting worse.

I am working on getting my 100% disability right now. I'm at 90 last year. I had to have 3 C&P exams last year. Two of them were for the same thing because they were trying to decrease my amount instead of increase it. I don't know if the VA is allowed to try to take away other person's disability money that has a lower percentage. For the longest time I was stuck at 40%. Every time I moved to a different VA facility in a different state they would reevaluate and try to take my disability away even though it's been more than 20 years And nothing's changed. Also don't trust the VA Doctors. Back in 2014.
When when they done a branch blon, my lower lumbar. They lied and said that patient tolerated Procedure well and was pain free. Totally I screamed through the whole procedure. They even had to stop it because it was so painful and it made my issues much worse. I have caught lies stating that I never showed up for my one of appointments and I was there for all my appointments that were going on that day. But I didn't realize that they had completely lied about the procedure until 2022. My physical therapist who I was referred to me by the VA Stated that my neck and shoulder problem on my left arm had to do with my spinal cord problems which are which I was denied by the VA. Even though I am getting disability for my right shoulder because it goes numb as well as the left shoulder does. But they say my left shoulder and my neck have nothing to do with my spinal cord problems. And because of their lies, I had to get an attorney and hopefully my 100% comes through so anyone that is facing this. Make sure you go through one that isn't requiring money up Front. Plus if I don't win I don't get charged.

VA is not Medical Care it is Medical management. There is a very distinct difference between the two. Think Property Management (Privatized on base housing comes to mind.) Do the bare minimum to fix and maintain, you can have good people under a shady company it still equals bad care. When public opinions can have your medical care denied, taken away, or changed without considering your particular requirement or medical need it shows what kind of shady business practices (not medical care) are used within the VA.

I am a retired Rater, and retired military, and I never ordered re exams, I always came up with a reason not to do one. For one thing the backlog of new claims was enough to keep busy without making work. Trouble is the VA hired kids straight out of college and they have zero common sense. They couldn’t care less how it affects a vet.

Had a VA rating for over 10 years. Spouse and two children.
VA "lost" the paperwork and the claimed I never claimed the second child.
VA took over $8000.00 back. I proved to the VA that it was a mistake. It took aost three years just to get into a review board.
Everything I showed up to the revuew board, three times, in Wimston Salem, they conveniently never has anyone available to attend the board or had no record of the board being scheduled even with a letter in my hand from the VA.
Have been fighting for many years to recover the funds, but the VA actually no longer even responds to my inquires.

My VA PCP told me in 2017 that she was quitting bcuz it was going to be ordered that all PCP and MH docs would "observe or reexamine" Veterans with higher or 100% connections (they said this was immoral and they were right), and "if they seemed better" they'd reduce or eliminate their service connection. 3 out of the 4 doctors in the women's health quit, my chiropractor quit, many of the MH dept quit, and they are having a hard time hiring anyone new. It's 2024 and I haven't had an MD since 2017 in my PCP. This is all too real and it's happening. They hate us Veterans.

Similar to Tinnitus if awarded before passing a new law all they can do is not give it to anyone else. They can’t take it from you if it was awarded to you before a law was passed. That goes for anything you were awarded.

I've had chronic migraine for the past 30 years. They sent me right before the major increase. Doctor said she was seeing that a lot that year. 100% unemployablity P&T. Examiner said I should be at a straight 100% not just unemployablity and told me how. I have that info in my back pocket incase anything changes. I don't see a point right now as I hit the 10 year rule in a 10 months. Hope I am right by not pushing for the straight 100%

Sometimes I blame other vets for the issues we run across. Ive ran across several people who openly hunt for more money. Not better care, more money. I knew a guy who dresses down and walks into the VA sad and walks out with his head up smiling. Never deployed. 100% P&T. I walked from that friendship years ago. These people disgust me. I am 100% P&T and would happily give it to them but they gotta take my health with them. Am I worried that I’ll lose any benefits one day? Sure, I’ll never feel 100% comfortable. But my experience with the VA has been good. Not great but good. I had a stroke a couple years ago and they covered everything and still send me locally to see a great brain doctor. I get weekly allergy shots too. I wish everyone got the support I do. My VA is also a clinic and not a huge hospital so I think that’s a bonus. But i will admit it’s not always easy. Lots of mistakes are made but you have to be your own advocate or find someone who can fight for you. Good luck vets and thanks for keeping us informed Craig.
