Because the label is paying for it. They fund the recording, and own the recordings. For example, search iTunes for some 80's hair bands music. You may find a few that are not the original recordings, but the band has re-recorded them with modern recording equipment and re-released the album. The band owns the songs...they do not own the original recordings (in most cases). If the old label goes out of business, or refuses to release the old stuff to iTunes, they have the right to do so since they are the owners of the recording. If the band wants that music out there, they have to re-record it and release it on their own. Sorry to go off on a tangent, but the reason is because the label owns the "recording", not the songs. Research "Music Publishing" for a more detailed explanation.
Seeing this makes me: 1, want to be in a band, 2, be talented enough to be in a band. Travelling the world with friends and making music. What could be better?
