      Actually, both of you are incorrect! If the patent handn't been granted, the lawyers would not be able to sue for patent infringement! As the lawyers did not violate any laws! It is up to the judge to decide if this case is valid or not!
      And evilghostrider is incorrect because laws are written by public servants and not voters as he implied and interpretation of the laws are done by the courts!!!

    Oops…a little out of date now. But I remember watching this documentary years ago. The east Texas court mafia has been shut down now. I think this documentary played a big role in that. The patent office is allegedly being reformed now, more progress is needed in regards to US Patent Office.

      Those patent office reforms initiated under Biden (and all the consumer advocacy, banking reforms and anti-trust litigation) will cease when Trump takes office. He’s a big fan of patent trolling (and trolling in general) and is owned by CEOs with anti-trust cases before the court. 13 billionaires in his cabinet don’t want any impediments to their rape and pillage of the American consumer.

      Extortion is a crime. Unfortunately the statute of limitations has probably expired. These trolls need to be in jail and their proceeds of crime seized using civil asset forfeiture laws. Normally I don’t condone CAF but in this case everything they own is derived from extortion.

    A good friend of mine. A real hard worker, very smart, deep thinker.
    He had filed 12 or more patants on verious things that he created on his own.
    He started a new engineering job a few years ago, after 8 months into his new job, the company claimed that because he worked for them, that they owned his patents and demanded that he sign them over to corporate immediately, they took him to court buried him in litigation and won. Even tho these patants were filed long before he ever hired into this company. It financial ruined him!

      Its because the people in this documentary complaining about patent abuses are using the exact same systems when it benefits them. In true libertarian fashion, they are only complaining because they are the victims, but if someone even remotely copied their ideas, then they would also submit frivolous lawsuits.
      And the issue isn't the frivolous lawsuits, the issue is that the legal process takes too long and is incredibly expensive. If lawmakers make it cheaper and faster to resolve cases, then it would no longer be financially feasible to make an industry out of patent trolling.

    I don't understand how all this is possible. All my life I have been told that you cannot patent an idea or a concept. And I just did more research to confirm that. However, many of the "patents" cited in this documentaries are patents of ideas and concepts. If these "patents" really do exist, it points to a much bigger problem: Something fishy is going on at the U.S. Patent and Trademark Office.

      Patent the process they use to sue for patent infringement and use the power of the pocket to ensure compliance, let's see them face a few hundred billion for all the cases they have ever brought against people. Knowing the two people behind this is a bonus, as they could lose absolutely everything.

    What about the requirement that a patent must be actively developled by the patent holder? For example, if I patent a better mouse trap I have to be actively be engaged in making and or marketing the product in order to enforce it.

    I had three U.S. patents that became worthless because the outdated and ineffective U.S. Patent System failed utterly to protect me. I was told (too late) that the Canadian Patent System would have been a much better choice.

    The solution is simple: patent patent trolling, and when they sue you, sue them for infringing on your Patent trolling patent.
    Another solution is for companies to band together and invent "Patent Troll insurance" Then when you are sued, aim all that cash towards them.

      It should be the idea of states. Everybody has to use it and it is a must for all powerfull group of people, you can get a return from nearly the entire poplulation of earth.
      Wait better one, common human genes. Everybody uses it so you get money from all born people. It is also patentable because people patented genes before.

    Glad to be Dutch.
    Over here it's quite simple. *_The losing party pays for all costs,_* unlike in the US where you have to pay your legal costs, whether you win or lose the lawsuit.
    That's pretty convenient for big companies or government when the highway cops have seized thousands and thousands of dollars from a citizen during a traffic stop without being charged.
    You can only get it back by starting a lawsuit and spend thousands and thousands dollars even more without any guarantee that you will win and get it back.
    All these victims know better than to sue the government because there is a big chance that you'll lose your lawsuit and have lost the money invested in the lawsuit as well!

    Clown world intensifies, excellent doc thank you so much. If all the companies would band together against them as one entity the trolls and even judges are going behind bars for extortion.       USPTO allows the holder of intellectual property to sue someone for replicating results claimed in a patent. I was surprised by this, having received a cease and desist letter because I was merely trying to test a claim. I checked with multiple patent lawyers. I had to stop my efforts. This is wrong, IMO. I was not attempting to compete or steal.

    One thing you didnt seem to notice is that people no longer dial a phone. Theres no dial! No dial- no dialing- no patent on touch screening or speak phoning etc... a phone number.
    We dont even use that language any more. We say "make" or "made" a call, not dialed a phone number.
    Surely a patent should use more specific language to describe if its for any other types of making a phone call not using a dial.

    There are two companies; one in DC, and one just outside of the Beltway… There sole business model is as the client of a foreign government. They basically scrape every shred of data off of as many patent items as they possibly can. They then take that data out of america and get to work on producing it themselves. Been that way for 2+ decades

    At some point is everyone going to learn the lesson that capitalism shouldn’t be involved in the public interest?
    Thanks to a patent, my medication is $970 for a 30 day supply. I’m so impoverished that I sleep on the floor.
    Patents should be utilized to document the people who originated an idea for our collective public interest and then be made available to everyone so that we may continue to innovate and advance without the exploitation that is inherent with capitalism.

    Should companies suing patent infringement must prove first that their patent was infringed and the cost of discovery should be borne by them. Maybe DOGE should have authority to stop these trivial lawsuits at the gate. How could American businesses flourish with these leeches?

    The US Constitution only authorizes patents on real objects in the classical sense.
    All of the so-called patent laws on program code, drugs, jeans, etcetera are unconstitutional.
    They are illegal.

      If you own the patent, you are allowed to sue those who infringe. You are allowed to sell licenses to use it. That is the entire point. It is far more difficult to fix than this

      @ you are allowed to sue yes. And I am allowed to counter sue as well..: pretty sue my counter suit will hold more weight than theirs.. especially given their actions..
      Even IF they win their suit, I can still win mine and they may come out worse.. maybe even see jail time..
      Better option than “oh gee! I been sued what ever can I do? Guess I’ll give in to their demands because they have a super vague and overly broad patent” approach

    As a non-immigrant working as a consultant in a heavy truck product development department an idea occurred to me. The manager threatened me to surrender the idea quoting that majority of patents are applied only by Americans. I said heck with your company. Was fired. I applied for the patent without hiring an attorney. The company influenced the USPTO to abandon my application. I spoke with the USPTO and got them convinced that the reply to the objections was filed in time. Got it granted in 2 years and 8 months.

    The Patent office has been around for a very long time and they have no one that oversees or regulates what can be filed as an actual Patent where anything that describes someone performing an action using a physical item like a "Stick to throw for a dog" can be filed as a Patent and this is where the heart of this problem is. A class action suet is what is needed for a case like this where many non patent citizens need to group together to explain that this is a violation of peoples right to own personal property that needs to involve data even though data is not a physical object is still needs to be seen as personal property the same goes for any unclaimed physical items that do not hold some sort of serial or patent tied number of the object or data that a citizen comes into possession of.
    The difficulty with this is that it involves legal documentation, physical and non physical items like a "stick" or "data", and physical and non physical possession of physical and non physical items. Now how is someone going to argue in a court room about a non physical item that no one has any physical possession of but still is able to sue someone for use or accessing these non physical items that somehow a company holds a Patent for? Only in America I guess would something as dumb as this become a 300 thousand to 3 million dollar legal issue where someone in the common public wouldn't be able to defend themselves from. God Bless America!

And then there's the horrible stories of all the inventors' suppressed technologies that have also fallen victim to these vultures.
