    "In Japan, the police don't help you because 'it's a family matter," yet when you take your children back, they arrest YOU for "abducting your own children." Makes perfect sense.

      @Sum Ting Wong You're greatly mistaken that it affects only foreigners, it's pretty much same for japanese parents too. Counter abduction will lead to prison regardless of nationality. Why foreigners are highlighted here, is that japanese ignore laws from other countries. I.e. married in foreign country, living in foreign country yet can go away with child abduction.

      @Sum Ting Wong Did you even watch the video ? They also talked about a japanese father and his issues with child abduction and how rempant it is. It's not just about foreigners marrying japanese only. Wtf.
      And it's this attitude ruining it for everyone. Not caring specifically of one side because "it's domestic" means nothing. It's an issue encouraged by the government there that could actually happen to ANYone, foreign or not.
      Meaning there's a giant loophole.

    Japan doesn’t really do shared custody even when both patents are Japanese. It’s no wonder they don’t care if the kids lose contact with foreign parents.

      Counter abduction within Japan would lead to detention. And in case you manage to bring back your child to your country, the Japanese parent will use The Hague to get back the child to Japan. A perfect ecosystem for abductors...

      Nobita's best work is with topics that concern Japan directly. I think a large amount of the controversy that has been generated by this channel is Nobita's willingness to cover topics outside of Japan that he clearly doesn't understand and/or cannot remain impartial with when discussing them. If he's able to cover those topics with the same level of impartiality as he has shown with this topic, his channel would do just fine.

    I’m Japanese but, definitely Japan violates important international laws such as convention on the rights on child and forces children separation from one parent. Under Japan’s law you will never be able to see your children or only 2 hrs a month after separation or divorce. This is huge serious violation of basic human rights on both children and left behind parent.

      I married a japanese, work fulltime , had 4 children, doing fine with his parents and siblings, rendering community's activities, after 15 years, got divorce, decided to get the custody of the children. 2 kids to him and the other 2 to me. We never stop the kids on visiting me or their father and gathered with their siblings. They're normally go to school near where they resides. I' still have my job, still joining community's activities, my ex give child support. We do family gathering once month. Our kids been already used to it. So I think it depends on both of you on how to handle the situation especially your kids after divorce. Being responsible and mature enough to
      communicate to your ex's and be wise to handle what consequences of your action.

      Jordan Fernandez learn how to interpret context. This is a quote from the video in which Nobita makes the point that in Japan children are considered property in the sense that things that would be psychologically beneficial to the child like joint-custody are not implemented. So they are considered property in the same way you wouldn’t have joint-custody of, say, a couch after a divorce. Whoever the child is with, it belongs to them and no one else has any say.

    This is infuriating. Japan's judicial system is terrible as it is with its "Guilty until proven innocent" process. No wonder divorce and custody cases are like this.

      @@warrenlauzon5315 Regarding divorce, it is quite a sexist concept, unless for some reason the mother is incapable of caring for a child. It's sad that divorce in Japan makes it so that fathers can't visit or help their children develop. It's also sad that some fathers can use it as a scapegoat and just disapear from their child's life. I think this also influences sexism in the workplace. Many companies don't invest in promoting or hiring women because of having children. Women miss out on career opportunities by having children and are typically expected to raise them at home. Being out of work for a period of time in any country is questionable to any company, and so oftentimes, single mothers have to work part-time, which is not financially stable, And now, we're in a pandemic, so business has slowed, and fewer hours are distributed to workers.
      I don't understand this traditional concept that divorce is a broken family and equates to failure. It doesn't have to be that way.
      I went off of the subject being discussed here of foreigners being denied their children, but it is a Japanese problem. And although many foreigners in Japan appreciate and want to participate in the culture, we can get dragged into the ugly parts of the system as well.

Never would I have thought that a country which seems to be a good example in some ways can actually be failing in many others, but hey nothing is perfect right? Well at least a country like China shows most of its issues in how they deal with political problems and its people including the whole Hong Kong ordeal, but I digress. Well this kind of ruins my dreams of marrying a nice Japanese woman cuz ya never know what will happen in a marriage :D

      @@vaan4500 I think it stems from the value of tradition in Japanese culture. The status quo often goes unquestioned because to think in opposition of society can compromise "harmony", which is the foundation of Japanese identity.
      If more Japanese people advocated for change rather than accept everything as it is, I'm sure the law would be more practical and frankly "just", as it's supposed to be.
      Divorce is just one obstacle. The next one is the child's identity. If Nobita hasn't covered it yet, he should consider documenting half-Japanese and foreign Japanese (foreign children born and raised in Japan) citizens and their experiences growing up in a culture that doesn't fully accept them as Japanese.
      I love Japan and hoped to have a family here too, but it seems too much of a risk..

Whether that statement was made as a cry for pain or not, it's still a xenophobic thing to say. While what happened to her was certainly tragic, it doesn't give her a pass to make that sort of statement. You don't generalize a country of people because of the act of the one that hurts you and/or the way their government handles things. It's just another example of a person exploiting a flaw in the system, it's going to happen in any country no matter the flaw. This is a human issue, not unique to Japanese people. Though I'm sure you're already aware of that.

    When people are in love they don't look at the big picture of "what if.. ?" Whenever we are going to live in another country or get married to a foreigner, please educate yourself, learn the law of that country, learn about family laws, don't wait until your relationship get to that point you never thought, wanted or look for. Know what are your chances before you take the big step.

      Also, marriage counselling to help a failing marriage or mediation is rare, if it even exists. If a problem makes them lose face it is ignored and backs are turned. Brain storming an idea to solve it was alien to my ex-husband and he did not even understand the concept. Black or white thinking and disconnect forever from the problem. To hell with the kid's mental health from having a parent that abandons them.

      @Manannan anam the problem here first of all is that its not only about foreigners but it also happens to Japan own citizens. But even worse is that even when the Japanese courts agree that the kidnappers are the ones in the wrong and that they have committed crimes they still fold to the ones that are in the wrong and not only let then walk free but reward then for their disgusting behavior . This is the equivalent of someone being robbed and instead of the thief being sent to jail the victim has to plead to the thief to give back his belongings. This is a joke, there is no other way to describe it, it's not only unjust the say they handdle this but it's also the same as spitting on the laws that rule on theses matters itself.

      The problem is japan does not care about their community more for their image. I mean past mistakes or present problems. I could count some big issues wich japanese citizens probably don't know or don't take serious because of the clean image they were given. I mean comfort woman's (kidnapped young woman's and teenagers) during wars, whale hunting etc.. I'm sorry if I'm being persemestic. But as long as people in japan don't have any interest about publishing problems and the fact that they think life is so perfect because of all the faking and hiding (suicide in japan,thinking mental disorder is a weakness). I love Japans culture and diversity but all the faking and hiding is more than just a thorn in the eye.

    I had a vague idea of how poor the laws and rights were surrounding children in Japan, but this is much much worse than I had known. I don't want to be too harsh but this makes Japan look like a joke. It's just so unbelievable that any country would allow something like this to happen. And just like Catherine had said, it really does make you think twice about having children with a Japanese person. It's beyond sad that such a fear exist.

    I personally know people who have has this happen to them, primarily fathers - both Japanese and foreign - who's child was kidnapped by the mother. It's truly awful.

    Everytime I go to Japan, I see a lot of wanted and missing posters hanging in bath houses or near train stations. Sad thing is, you don't see those posters often in mainstream areas such as Tokyo.

Children missing from their home and going to resident areas and then they report them back to police and they do it again. it happens mainly because their parents can't give them enough time and they don't have any friends. Specially Elementary kids.

    A friend of mine had the custody of her children contested and the custody was eventually handed over to the father.
    She had no criminal history whatsoever, but the father had. Yet the courts considered the father to be the better parent.
    She had visitation rights, but the father constantly stalled and refused to cooperate so she barely got to see her children at all, and the courts did nothing to help her.
    Eventually, the father stabbed her to death and almost stabbed the present social worker to death too, and is now serving time in jail.
    This is the man with a prior history of both assault, robbery and dealing drugs, which the courts considered the "better parent" of the two.
    This is what courts to to children and their parents in the world.

    I am from Bangladesh. Currently a child custody case involving a Japanese mother and Bangladeshi father is catching the headlines. The father abducted the daughters to Bangladesh and the mother followed him to get the daughters back. Initially I thought the father was doing wrong. But after listening to his interview and researching more about Japanese custody laws, I am shocked and scared. Now I understand the father simply had bo choice as if the kids are taken back to Japan, he will never be able to see them again. That's inhuman and so unfair. The lesson from this incidence is never think of marrying a Japanese person.

    Japan is messed up. My then six year old son was kidnapped 9 years ago to japan, and I've been fighting for all of those nine years to try to get to see him. The state department does nothing...I've reached out many many times. The Japanese even allowed my ex to remove me from his birth certificate, change his name to her japanese name. He's 15 and has no idea who his father is. Nothing has changed.

    Sadly this is exactly what happened to my sister when she got a divorce from her husband. He took their 2 and a half year old son and didn't let my sister see him. He got the child custody only just because he was the first to take the child...unfairly.
    my sister's lawyer reassured her that she can get a divorce and get a custody as she was getting domestic violence from him. However, the bad news came to all of us as a huge shock as we were all absolutely certain that things would turn out in her favour. After they got a divorce and the courts final decision about the child custody, my sister not only lost the custody, but she was able to see her son 6 times a year. .. can anybody possibly believe it?
    By the way, she has the kindest heart in the world and she loves her son to bits. She always looked after her son and her family including her parents in law. She only wanted to sort out the issues fairly, that's why she did not take her son away in the first place like he did. Now she hugely regrets not doing it as the Japanese court proved it right.....
    By the way, both my sister and her ex husband are Japanese nationals. I can imagine how even harder it is for a parent who is non Japanese national to fight over custody against their Japanese spouse. This thing needs to change.

    Thank you for bringing this horrific topic to light. Let me add my experience. When I divorced my Japanese husband he immediately wanted nothing more to do with his two sons. He said that is how it is done in Japan - to cut ties completely and act as if that old life is dead. This devastated our two young sons and it still impacts them very negatively as adults even now to have been deserted by their father. Their father today does not care about them and the damage he caused. Want to marry a Japanese person?

      @American Restoration Initiative as I said it all depends on how good the lawyer and how biased the judge is. For example the fathers lawyer could say 'are you discriminating against my client because he's a male even though single mothers are more likely to abuse children?' and if the judge has seen enough cases of single mothers abusing children they might be biased and give full custody to the father even if the mother isn't abusive. It doesn't happen as much as mothers just claiming dv cause feminism but it does happen a lot more than you think

      As stated in the video, not a solution. Even if you're the sole surviving biological parent, relatives of the deceased parent get custody via possession upon the death of the deceased parent, under the Japanese family law principle, mentioned in the video, of the children belonging to the household in which they live.

    Not just these situations but also adoptions. I remember researching adoption from Japan and.. it's sad that no matter how much bond you made with that child you adopted, they could be taken away at any time even if the biological parent didn't want the child before... :( it's so severe not just from research but people I know that was able to adopt from Japan. I can't imagine adopting a child and raising them with my heart as apart of my family and yet they'll get taken away. I decided to not adopt from there. People need to know these things more.

    There is so little awareness about this, even japanese themselves often don't know about the issue until it's too late. And many don't even care unless it's affecting them directly. You can't expect to be perfect in every area and predict every single problem. Not everyone is a lawyer nor can plan perfectly for every trouble in future, i.e. getting a lawyer explain you all caveats with the marriage law and skip the marriage altogether. If i knew all this beforehand i would also most likely not get married to a Japanese person. My case was really close to a total failure and i'm still walking on a thin ice... People change, people get sick and mental sickness can change person completely over a really short amount of time. It's true that regardless of what happened in the marriage and people involved, it's the person who abducts the kids first will keep them, domestic violence, child abuse, cheating, mental problems etc is almost completely irrelevant. That is insane reality of a "well developed" country that we call Japan.

    I knew the exact opposite. This Japanese woman married a service member. Apparently, they got into divorce. She had 2 children. But her ex-husband had the custody of the kids in the US. She tried to see her kids but he refused. I think she took her own life.

    It seems like a lot of Japan's problems stem from the cultural identity that you've talked about before of not wanting to disturb the peace or cause problems. The government would seemingly rather let these kidnappings situations happen than go through the messy process of further custody battles or criminal charges.

    Many abuse from Japanese wife on husband happen when couple are living in Japan. Husband have to shut they mouth and say yes to everything when they have kids (more than 90 percent of the couples are Japanese women Foreign men)... Join custody and parental Visa just doesn't exist in Japan. I know many cases when wife will trow stuff and beat husband do psychological violence and claim that they are the victim when couple go to court for divorce. Court will never recognize that women can be violent. If you try to meet your kids while separed, prosecutor can extend your period of detention for more than 40 days.

      @@socialservice576 In "the Red Pill" a guy tells how COPS told him she can beat him half to death but if he fights back and she breaks a nail he's going to jail. No wonder some get back financially. During a divorce procedure a man has withdrawn all the savings and burned them at a waste disposal site Joker style. Said the wife won't be getting a cent. Iirc they had no kids, otherwise he might have resented the wife but still gave money to help raise the kids.

    It's a really sad situation. I heard a case in my country where the father couldn't meet his daughter in Japan, and he didn't have money enough to support the child and the child's mother, so after a time, she gave the child to adoption without notice him.

    Thanks Nobita for rising the subject. Let's be honest, this is happening in every country. Especially in Canada and muslims countries. I'm a foreigner living in Canada, my ex-wife, from the same nationality as me, decided under the advices of feminist group in the province of Quebec, to abduct our two children, and to accuse me of abuse on my daughter. In Quebec, women are encourage to act like this, they are not punished for their actions. I never saw my daughter again. I got the custody of my son after four years of battles. I raised alone since he was 8 years old, but I never saw my daughter again. And nobody, nobody gave a f... about it. It's not only Japan. To my opinion, it's better for a child to be raised in Japan than in North America. North America doesn't have anything to offer to a child. North America has no values. If you marry someone from a foreign country, it's your responsibility to check the different situation who can happen. For sure, children should never be taken as hostage. Every child needs his/her both parents.

      i highly doubt theyre encouraged to act like this. feminism is hated and that's a literal crime. Maybe in some secluded feminist cult, but in general, most women in canada or america are not encouraged to kidnap children or falsely accuse people.

      ​@@kawosdhdos Well for one law enforcers are, usually, tied down to following protocols unlike civillians who are committing the said crime and when a perpretrator of said crime has the intiative (which is usually the case) he or she won't let the situation unfold without prepping some sort of "safety net" or is confident/desperate enough that it's just some hurdle to get through which won't stop said perpretrator in it's track at least for 80 to 90% of the cases.
      If you want "good" exemples of very bad cult like movements that spreads far and keep having influence even though it sounds and look pretty... obviously dumb, it would be the fake martial arts ones that boomed in the past decades and still have quite some impact to this day, be it as the typical ones that stems from uncaring civillians or the more "official" ones like say taichi.
      Exemples aren't missing so if your curiosity is peaked I can throw 1 or 2 references but it's safe to safe that this guy's circumstance doesn't deserve the skepticism, at least not with the many other cases that also happened.
      Also sorry if it was a bit too big of a text but I did tried to make as concise as I could.

    Also child neglect is on the rise in Japan, just last week, a single mother left her 3 years daughter home alone for 8 days and the child starve to death in a dark apartment. Any other country, she would lost her custody long before this happen.

      Child neglect is an issue in every country. Social service can only act if and when the parent or parents appear on their radar when alleged neglect is reported. At times neighbours are aware that something isn't right but don't want to get involved. In other cases, the parents could be seriously struggling not knowing where to turn to for some assistance.

      @@electronicraisin5956 that's a huuuuge issue in Japan. There used to be a BS law according to which the household is so private it's out of police jurisdiction as long as the victims of abuse are family members. Some neighbors still think it's super private and they should not intrude.

    I have been following your channel for a while and this video is probably one of the best you've made to highlight some social issues in Japan.

    I’m so glad you are addressing this and I hope it gets recognizing. japan needs to change many things especially this one. I really want to live in japan but this such a scary thought especially if I ever think about having kids.

    If this situation happened to me in Japan, though it's very painfull as a father, I would rather leave Japan and my kids than force the Japanese system nor the courts to be with my kids. As a Philippine citizen it's most likely impossible to be in Japan unless my job requires me to be there. It's best that the parents should talk and arrange things that will protect the kids future without the third party nor the government. If the mother kept the kids away from me then so be it. That what I did with my wife I initiated annulment and the moment she is knew about it she made sure that my kidz stay with me as I told her I will not pay child support even I the case reached the supreme Court nor I would even bother hiring a lawyer and attend court hearings. This is my suggestion keep communicating with your spouse, things get settled easier. If your spouse takes a hard stance turn around and walk away. In my real life communication worked and I still keep my kids also the wife 😁😁😁.

    My dad tried to kidnap me from my mum when i was around 8 (who had full legal custody) and keep me in germany. Luckily my mum managed to get the UK embassy and german police involved and he was forced to send me back. Its scary to think what would have happened if she didnt have £2000+ to pay for the legal fees of getting help and even then she nearly couldnt get me back.
    Side note: My parents were divorced and my dad had previously been physically abusive to my mum. The event only lasted a couple weeks but i remember it clearly and to this day think about it constantly even though it was resolved, so i definitely believe it traumatises the children involved. I never got over it and it definitely creates trust issues.

    Wow, I’m stunned. I’ve heavily studied Japanese culture for the past year, both within and outside of college, but I have never heard about this social issue. To so easily abduct a child from their family is so cruel and unjust, I cannot even fathom it! After hearing about so many social issues in Japan such as bullying, suicide, sexism, and now this, it seems as though there is a herd mentality within the nation towards social problems, which is to pretend that they don’t exist. It’s as though the logic is either, “If I don’t see a problem, then it doesn’t exist,” or “ If a problem doesn’t affect me, then I don’t care,” or perhaps even both! I don’t understand how, as a human being, you can see or hear about suffering and not want to do something about it.

      Well, finally someone who gets it. It is all about honor and losing face, nothing more. Your statements are all true and I have lived them through my ex. Oh, they don't come from a Christian background so helping the suffering is not ingrained. Mostly, ancient superstition rules things.

      @@Dice-Z All cultures grow from their original religions. The west would not have ancestor worship or fertility festivals like Japan does. As I travel I observe behavior and how it may be in tune with that country's belief system, which comes from religion, usually. I witnessed many examples of what I stated above. Have you lived in Japan? I have. And I am an atheist.

      anime isnt real like you can't compare this issue to it y'all weebs need to stop making these comparisons
      when japanese couples divorce the mother almost always gets custody of the child because 1. fathers usually aren't interested in raising them and even go off to remarry and have kids with someone else 2. the system is biased and works on the (old and sexist) narrative that only women truly know how to take care of children, even though that's not automatically the case.

    Given Japan's culture of children out without guardians as normal. Foreign girl, no one gives it a second thought. She vanishes, no one knows. Prostitution is also much easier in japan from what I have researched. Doesn't mean it's true. The former seems like a big reason for me. Oh, this is just child custody, still fucked up.

    この手の話は以前も聞いたことあるけど、思ってた以上に大きな問題ですね。まぁ虐待された子供に対してもろくに何もできない役所や法律ですからね。基本家庭に踏み込めないように作られたシステムが、社会が変わってもそのまま残っているための問題なんだろうとは思います。
    いい加減政治家には仕事してもらいたいけど、まずは国民がしっかりと問題を認識しないと改善していかないでしょうねぇ・・・

      Nah, the birthrate thing goes a bit deeper than that. Also, it doesn't just affect Japan either. Japan is just ahead of the curve. Birthrates just seem to decline at a certain point once a country develops to the point where it can be considered first world.

      Taeseong Moon Birthrates decline as women are given more power. Hell even leftists agree that is the case so long as you word it differently. Find any list where they talk about "protecting the environment" or reducing our carbon footprint, and there will almost always be a listing of educating/empowering women because in their own words "educated women have less children."

      MoreEvilThanYahweh you aren't wrong, often .... lets say less savory women get custody of their kids just for being a mother. Even if the father is arguably the better father and in a divorce the woman might end up with almost everything in some states/ districts

      @@dbzcupcake In my country, divorce rape and child support is the norm. There are legal ways to prevent the divorce rape but not the child support, but it should be done in BEFORE the marriage takes place.
