- We’ve probably all broken the law at some point in our lives. Even the people that proudly call themselves law-abiding citizens may have accidentally driven through a red light or not-so-accidentally stolen candy as a child. It’s thought about 1 in 3 Americans have some kind of police record, and the figure is about the same in the UK. Research shows that in the USA, about 70 percent of the population have done something that could have landed them in jail. That’s a fairly realistic statistic considering that the Substance Abuse and Mental Health Services Administration says around half of the population admit to having taken illicit substances. What you might not know, though, is that you’ve probably broken the law on occasions and are not even aware you did. Today we are going to explore these small crimes in this episode of the Infographics Show, Illegal Things That We Do Every Day.

It has absolutely nothing to do with free speech, and everything to do with the copyright expiring.
Technically its not speech though, its music, and it certainly wont come under what you think "free speech" is.
Free speech, especially in the UK and other commonwealth countries, does not mean you can say whatever, whenever, wherever. It simply means that you can speak out against the government, vote for who you want, and have whatever religious and political views you like without facing prosecution for those views.
Or in other words - voting and protesting are forms of free speech.
Singing a song not written by you is not free speech.
The EU copyright expired in 2016. The US copyright was ruled in 2016 to be invalid and the work was found to be in the Public Domain. Warner (and its predecessor Summy) never owned the rights to the lyrics ONLY the piano notes (that copyright long since lapsed so their only potential claim was to the lyrics).

I think the "using fake names" law shouldn't be a law because then people can see what your real name is
These are what my lawyer friend calls RME laws or "Roll my eyes" laws. He says he will come across them on a daily basis and even finds himself saying "oh give me a break" out loud occasionally while reading law books when studying for cases lol
He's had a few cases like that but you have to remember that Lawyers are allowed to review cases before they commit to taking the case. He usually turns petty/stupid cases down but he always has amazing stories about them. The worst one he told me so far was between two neighbors. They hated each other for years and finally one day neighbor 1 caught neighbor 2 tossing a gum wrapper on the the ground and DECIDED TO SUE ON THE GROUNDS OF DESTRUCTION OF PROPERTY. Needless to say my friend rejected it but he referred the guy to an ambulance chaser attorney that he knew. Less than a week later the case had been reviewed and rejected by the judge immediately . Now the case is essentially in infinite Limbo because the ambulance chaser is a scumbag and of course found technicalities - or RME laws- that allowed him to prolong the case and try to win it based on false stuff

Got done for jay walking In Sydney. $89 fine. Had my go pro rolling, the street was devoid of vehicles, it was 3 am. Cost the cop his job. Why? Coz it was an entertainment district with plenty of homeless. I ignored the "calls" from the officer, and he chased me down the footpath on his motorbike and collided with me. I turned around just a split second before he hit me. "You crossed against the red light" he said. I said "you just willfully rode a motorbike down the footpath and struck a civillian, and I have it on camera!". A cab was right beside me and I jumped in, and told him "GO!". Long story short I reported the incident to police and provided the footage. The cops in my area are much nicer ;)

Actually, they fixed the "Happy Birthday" thing. You can do that in public now. It was ruled that the playing of "Happy Birthday" only applied to a VERY specific rendition, so now there's no consequence for it.

No, not recently. Almost two years ago now. Over a year before this video was uploaded.
More specifically, in 2015 a federal court ruled that Warner's copyright claim was invalid. As there were no valid claimants to the copyright, it had actually expired many years earlier.
True... actually, Warner made money off it illegally for some time... but you know they'll never get punished for it. But steal one of their songs or content, and they'll jam you ass in prison with a potential 150K fine per offense!
I am curious how it was illegal though. (at the time) I mean, anyone can sing any song in a public setting with no recourse. It is only illegal if you use a song to get money that is not yours. So I am curious how that one worked....

As of 2015 no one officially holds the copyright to the happy birthday song. It is considered an orphaned work, so someone might be able to come forward with proof of ownership, but until then no one can demand royalty fees for it.
