Hi everyone. Thank you for your insightful comments. 1. This kid is not from Boston. He is from a suburb that is middle/upper class. 2. In the Commonwealth of Massachusetts, Assault And Battery with a “Dangerous” weapon is used very broadly - but it is a Felony charge. In the commonwealth, you do not have to commit an actual “battery” to commit Assault & Battery, as the state defines it. 1 charge and can include the threat of battery - (a misdemeanor), thus Assault & Battery. It used to be “deadly weapon” a few years ago but they changed it to “dangerous” - however it’s still a felony. So, yes, the toss of the water bottle is a felony, and because this is a public case it will be an uphill battle for the defense. However, he did hire a well-known local attorney. It is sad though that the DA is going to prosecute this case. If convicted, this individual will be a convicted FELON. Even his college is “aware of the conduct.”
