Season 5, Episode 11 "Blowback": As we begin our mid-season premiere, Mike’s worst fears have come true. He’s been arrested for fraud and is under investigation by a ruthless government prosecutor, Assistant US Attorney Anita Gibbs. Why didn't the Judge just subpoena that tape? We are talking about a public servant who denied someone his 5th amendment rights.
Yeah, she should have denied the motion and still subpoenaed the tape to see if the prosecutor should be sanctioned and thrown off the case.
quid pro quo between counsel plus because the discussion in chambers was off the record, she didn't officially know about it so she can't officially subpoena it. she knows they made a deal so the case can progress so they move on.

I mean if both Harvey and Anita had revealed in the chambers that they murdered one person each, and they decide to not use it against each other, would the judge not do anything because of "quid pro quo between counsel"?

i think she's a worse character than rachel, and that's hard to do. she wanted to know everything and when she did, she ran away as if she'd seen a ghost, and then blamed it on harvey.

honestly that judge should have throw out the case with prejudice after she found out what she was trying to do to mike and harvey. at least that would have bought them more time or get the story straight if they had been called up to the bar next if gibbs didnt get her way in court.

Harvey and Mike both respected Anita very much.....as Harvey thinks He is the Best, he and Mike ultimately lost in the end. I think after Jessica, Harvey respects Anita next.
actually not true, they won the case but, Mike unfortunately took the deal instead of waiting for the final verdict which was ‘not guilty’. So, Mike may have gone to jail but Harvey and Mike didn’t lose the case. Mike lost hope and sacrificed himself.
