They shouldn't have won. But now I'm scared they're going to be going around getting every other trademark for everything, which is what they should've done in the first place.
I honestly agree, I'm also glad Nintendo didn't win this case. After so many lawsuits it's good to see them lose at least sometimes. I love Nintendo as it's a company that paved the way for me to develop my passion for video games in the first place, but I also see how their overprotectiveness over their brand, franchises and products has a negative impact on the community. Their war against emulation and fangames is honestly just disheartening and feels kind of pointless, especially since they are still gaining large profits from their sales despite the fact that emulation exists and there are people who pirate their games and probably will in the future. I like to remember that the DS had a rampant problem with piracy and yet it was still their most sold product ever and they gained huge profits. Admittedly, if the developers of emulators had more resources to fight back, maybe Nintendo wouldn't be winning these court cases nearly as much...
Same. I have a huge grudge against Nintendo, But I have to be honest, The yuzu team earning revenue to develop their emulator was a stupid idea in the first place. Not only that, but the people who kept leaking the games and basically put out emulating TOTK videos on YT before the game even came out was despicable. I have no problem with emulators at all, Just don't do stupid shit like again.
Okay, really I didn't expect this to happen, especially with emulation, but originally, I thought they would win this lawsuit. But they didn't. But why celebrate them losing over a grocery store? That's pretty paltry if you ask me.
I'm not sure I would go as far to say I'm celebrating their loss lol. It's more that I hope they chose their battles more wisely moving forward I guess you could say. They've filed tones of lawsuits and C&D in the past year (some warranted and some, not so much) so having a loss on something more on the minor side is on par of a small tap on the finger and a reminder that no ones "undefeatable". There's already a decent amount of people that find Nintendo displays borderline bullying behaviour in the context of when they decide to take action against someone too. (ex. when the whole GMod thing last year or when they used to strike down youtube channels that recorded gameplay). Don't get me wrong though, I love Nintendo and I'm not waiting for their downfall or anything like that I just want them to be more careful lol. Hopefully that kinda explains it bit better!
