Today was a fine display of jurisprudence by the High Court. I was really surprised by the decision of the Victorian court of appeals, that was truly perverse. If you get accused of sexual misconduct in Victoria (and you're innocent) you're screwed, we have a community of juries who are eager to convict and judges in the appeal courts who are willing to turn a blind eye. That is what was the most outrageous thing to me as a lawyer. I have little hope for this country and am planning my retreat to freerer nation after twenty years as a civil rights advocate and dirty wrongthinker as a centrist. Ultimately The problem is that the Catholic church has a long and proven track record. Of priests sexually assaulting children and then their superiors in the church covering it up. What do you expect the law abiding citizens of Australia to believe? That an accused pedophile who is also a Catholic priest isn't guilty? That seems unlikely to the rest of us.
I am no Catholic, but in times where Christianity is attacked like this, I find myself suddenly in support of the old Church. What had to be proven is. Was the person lying or have something to benefit from his accusation, and was the accusations plausible as these have been the factors that have convicted many pedophiles before him.

(Biased Court Judgement) Facts, Evidence and the rule of law must be upheld. (Numerous breaches identified) Police must investigate the matter/incident and search for the TRUTH, not for the Crime! one person testimony in rape cases is a common occurrence.

What do you expect the law abiding citizens of Australia to believe? That an accused pedophile who is also a Catholic priest isn't guilty? That seems unlikely to the rest of us.
I am no Catholic, but in times where Christianity is attacked like this, I find myself suddenly in support of the old Church. This was no "witch hunt", it was a deliberate attempt to chip away at the influence of Christianity in the world. Why wait for Pell to become a Cardinal? I remember hearing a story of a mother in a department store who thought a man was taking photos of her children, turns out he had the cameras reversed and was taking a selfie in front of a Star Wars cardboard cutout. Did the mother check first? No she didn't instead she takes a photo of the man and posts it on social media labelling him a paedophile. It was later sorted out, but damage has already been done.
We all know that the Catholic church has a lot of pull and that he had friends in very high places, so who knows why he was found not guilty.
Certainly the plaintiff was genuine in his coming forward, out of the respect for his dead friend who could not put what happened to him behind, and his personal testimony does seem plausible in such a crime. What could have been the other reasons could this person come forward for, and why target Pell. So there it is.
It's no surprise to me that he was like that as these two report shows the church is full of disgusting men in powerful positions.

In such crimes it is often impossible to prove beyond a reasonable doubt, because it is done in private and in circumstance when the victim is a child or vulnerable, so a factor of reasonable doubt is always there. What had to be proven is. Was the person lying or have something to benefit from his accusation, and was the accusations plausible as these have been the factors that have convicted many pedophiles before him.

There was only a 5min window for this to have occurred straight after the mass and it's impossible to have happened the way they said. A plea to Cardinal Pell . We are certain to have a very bad recession, every charity organisation including the Catholic Church will be pleading for funds to feed the needy and find shelter for the homeless. That is why you must take legal action and sue for defamation and wrongful imprisonment . @@pete-ex7qt Read the verdict of seven Judges of the high court, accept the fact, in the first case, there was initially, a hung Jury, in the second case, a guilty verdict, followed by an appeal, where one of the Judges didn't agree with the others, and you have a clear situation where people were being biased, not listening to, or assessing the evidence, and it becomes clear, especially given the fact there was so much in the Media about child abuse at the time, George Pell wasn't being judged for the claims against him, he was being punished for the whole Catholic Church.

Pell was not declared innocent, as the judges following all the evidence , stated due to a technicality in the evidence; Pell was allowed to go free. Even if he is guilty, the evidence of the case is simply not there. Now clearly he is innocent. Surely heads have to roll. The Victorian Court system jailed an obviously innocent man. Those two judges should lose their job. Nothing less erodes any trust in the legal system.

Facts, Evidence and the rule of law must be upheld. (Numerous breaches identified)
Police must investigate the matter/incident and search for the TRUTH, not for the Crime!
Searching for the Crime instead of the Truth/Facts of the matter pre-exposes the investigator to JUDGEMENT, consciously or unconsciously, which is not his/her role.

It puzzles me why Victoria Police didn't undertake a full reenactment of the scene, that was so diligently and analytically performed by Andrew Bolt. That in itself must raise serious questions! Were the Police investigators assigned to this case arrogant, complacent, presumptuous or driven by political and personal objectives, with professionalism and critical judgement being excluded? I am not defending G. Pell or doubting the victim with my comment. My comment is purely to ask the questions ...how many other people have been unjustly convicted and are in goal? How many criminals and paedophiles remain free because the Police haven't performed a proper and thorough investigation? Unfortunately, this catastrophic media frenzy that we've all witnessed has once again distracted the focus away from paedophilia because of the determination to implicate the Catholic Church and an individual. I am not religious, nor defending anyone. While there is this continuous focus on one institution and individual, means all the other institutions and individuals who actively partake in this hideous crime are free to continue.
