    The Trust cost more on both ends with the dozens of steps to validate, certify, transfer, distribute, settled administration in Litigation costing 15% more than Probate.       I'm sorry to hear that your family ended up in court. While trusts are less likely to end up there for multiple reasons, no estate plan can guarantee that will not happen.

      @@rouletlawfirmp.a.4922 With all due respect your Pragmatic Clients on the other side of the fence disagree, although there are more Wills out there 9 out of ten times the Trust ends in Fights or Litigation because families are using Plain English Lawyers instead of Legalese Lawyer's. Avoiding fights and Trust forgers with the NICER Standard Operation Procedures in a few months to avoid Grantors being victimized from inheritance thieves. The Plain English Trust and Will are made out of the same easy to forge paper needing Legalese Administration Lawyers instead of Estate Planners.

      Whether or not you have to go through probate doesn't depend on how many children you have. Rather, it is based on what assets you have and how you own them when you pass away. All states have laws in place which determine when probate is required and it is usually some combination of owning real estate and/or personal property in excess of a certain value. To avoid probate, you can use certain planning tools such as trusts and beneficiary designations to transfer assets outside of probate.
