The judge will say the crime committed in the jury instructions. It is good that the judge is fair. Oh wait.
They're not going to. They're going to spend the vast majority of their case on character assassination. Sprinkle in a little bit of testimony that the hush money thing happened. Then the judge and the prosecution will work together to craft jury instructions that tell the jury if they find that the hush money thing happened then they are required to find him guilty. It will be total judicial misconduct and complete misstating of the law, but they're not going to care. They don't care if this sham gets overturned on appeal. They just need a conviction on the books before the election.

@@BidenBrigade2024 On the contrary. Even if you don't like Trump, don't you want him to be punished correctly rather than on trumped up charges? Criminalizing anything to get Trump has two problems.
First, it causes people to not believe Trump's guilt in any circumstance, the Cry-wolf effect. After all, if all they could prosecute him for is something that politicians have done for centuries and never been prosecuted for, they must not have anything.
However, there is a worse problem. I'm reminded of an Asimov story, The Tercentenary Incident, where a group discussed assassinating the president and replacing him with a robot. The protagonist rejected the idea outright, despite how bad the man was. Paraphrasing: "If you do it now for all the right reasons, you will justify doing it later for bad reasons, or for no reason at all". Once you open the floodgates, it will be done repeatedly, consistently, and for less and less reason. It's not a slow decline either.

Cohen sounds a lot like Nixon's "plumbers." A lot of what they did was on their own and without Nixon's knowledge.
Nixon was unaware of the Watergate break in. When he found out, he, for some reason, felt a misplaced loyalty to the ones caught. Everything he did after was his own doing. He just kept digging a deeper hole. Should have disavowed the whole Watergate mess.

Viva, That brought back memories! My dad used to take me to Loxahatchee when I was a kid, 40 years ago. No piers back then, just banks, boat launches, and the old flood control valve docks (I guess that's what they were used for?). Dad had his own contest with a gator, but he was right at the bank and it was starting to appear if the gator was thinking about eating dad and saving the catfish for an after mint!
