Unless the contract has a specific assignment clause, the contract is implicitly assignable AND the assignor and assignee are BOTH liable for performance. That's why you need an explicit assignment clause that fully releases the assignor from liability upon assignment to an unrelated 3rd party.

The only thing that I don't see on RUclips that people are talking about is the 10 day inspection.. At 11:06 you talk about a contractor going to the house and inspecting it.. Who pays for the inspection? How much does it cost? Any particular things we need to search for to get a quality inspector?

State approved contracts still allow contract to be assigned, read the contract for sure but Kansas Citys says something like (contract allowed to be assigned) or something like that so you dont have to request them to add "and or assigns" Unless it has a no assignment clause which is usually only bank owned propertirs
I am so happy I seen this today because I had a seller that wanted me to use his attorney and no real agent on a property in Chicago Illinois. He also wanted $2,000 as a earnest money deposit and he wanted to close this week? This deal frightened me and the seller was to pushy. He also told me I can use his attorney as well just sign a Conflict of interest Contract with the attorney it smell that rat so I walked away
You should do a video on how to use this strategy in the states where it’s illegal to double dip. Because I’m trying to figure out how to use a buyers agent if I can’t use a listing agent and they don’t want to do a designated agency tactic.

If the buyer is not a licensed agent, then the buyer is not legally required to work through the listing agent. The seller is legally required to honor their listing agreement due to contract law. No listing agreement can prevent a seller from negotiating directly with a buyer.

Thanks for walking me through it , I’m literally going through this step right now and will be digitally signing within the hour 🙌🏽 - additional question is it normal for the P&S agreement to be signed with the offer paperwork ?
