      Not always. Oral agreements are possible. Most do require modifications in writing though.

      Why would anyone start a gofundme for her without knowing the details of what happened.
      Ok the bank did a loan modification, did they lower her rate ? Did she cash out the equity and go on a world wide vacation with the money??
      I watched the story and I have ZERO idea what happened to her other than she took out a loan and can't pay it back.
      You know what most people who own expensive homes they can't afford do ? They sell their home and move into something smaller that they can afford.

      No​@bettinacarr4222 No No She probably took a loan modification to reduce her mortgage payment because it's obvious she's on social security at her age and social security isn't the same amount of .money you get monthly like when you're working and getting paychecks bi-weekly
      It's much less and on fixed income you have to budget your social security payment monthly with less now!!!! That's why you see too
      many people's working beyond their social security ages because
      that monthly amount isn't enough to take care of them financially 😕
      We have alot of real-estate shark 🦈 🦈 out there surfing the web looking for people to sell their homes so they can get you out and make more money 💰 in their pockets because they're always 😉 harassing people 😉 about selling their property 😉 and they saw her with a loan .modification 😉 and saw a loop hole they can jump in
      And she's elderly and decided to victimize her because that lady wasn't trying to put herself in jeopardy to loose her big beautiful home and I don't know how to Go fund me ,and if I did I would do it for her and whomeve can do it please help her and start it up for her because it's heartbreaking to see this lady being g duped out of her home she worked hard for and remember you will be an elderly person one day yourself because she was once your age before and the years goes by faster than you realizes and you would want someone in your corner too!!!

      @@bsgvlog5640if you listened carefully, you would know that that house is already sold back to the bank by the bank and now her attorney is trying to get the 400k equity since the house was worth a million but sold for 600k. Skip the go fund me….and just hope she gets the 400k equity.

      In 2021 houses were selling like hot potatoes- then she should sell the house, pay off the mortgage and downsize.
      I bet her family didn’t have another place to stay - that’s why she can’t do this.
      Now, if foreclosured, she’ll be left alone - no house to leave to her children so nobody’s interested in her.
      Thats why they don’t tell the whole story - it’s not that cute as it sounds

    Terrible reporting, i can watch a three mintue Dave Ramsey video and get a better understanding of someone's financial situation. You reported zero relevant information other than bank modification, failure to pay womam loses home.
    Did they charge her a 25% interest rate ? Like what actually happened that makes her story tragic here, you didn't mention it at all. Specifics people!

    I learned 20 years ago when I lost my home due to a shady bank officer ,to not trust any bank and make sure when you involve your home in any type of loans,
    that you have and understand any and all conditions of that loan in writing .
    As a senior citizen myself ,the only loans modifications that I made were refinancing my balance of my mortgage to a lower interest rate and I made damn sure to read and have the loan officer explain everything in the paper work before signing off .
    Anything else ,such as reverse mortgage or other BS complicated loans,I stay clear of ,because all that the bank or lender wants to do is take your home from you.

      Ain’t no way the bank approved a modification on a 73 year old woman past retirement age. Being able to financially afford the modification is the 1st thing that underwriters would consider. Who approved an ARM on someone post retirement age on a fixed income?????

    Thats a whole lot of house. She should have cashed out a long time ago. I'm sorry she's in foreclosure, she needed to plan her finances better. At an advanced age, high monthly bills add lots of stress.

      you clearly don’t understand what’s going on. If she wanted she could have done a reverse mortgage. Clearly that option wasn’t presented to her. Not to mention she has 400k in equity in her home. That’s half of what the property is worth today. That tells me this woman paid this home off a while ago. She most likely bought that house in the 90’s at 400k. Whoever facilitated the modification participated in loan fraud. People act like companies don’t modify documents without the person knowing. She needs to sue the mortgage company and every NMLS licensee number on her documents as well as the Notary that stamped the documents who most likely was an employee of the mortgage company/bank. It is loan fraud to orally promise someone something that is not accurately represented in the contract.
      It is up to the MLO to verify EVERYTHING. Why would you change a fixed rate mortgage to an ARM for someone who is on a fixed income? That’s a BIG red flag 🚩!

Reverse mortgage for what, so that her family can take over the home when she dies? Look at her now, she's in hot water but they can't help her.       @ she modified the loan in 2012 at 73 years of age. It’s obvious she was post retirement age. Why would an underwriter approve an ARM for someone on a fixed income. This is a clear violation of the 2008 Dod Frank Act. It’s an underwriting requirement.
      We know it’s an ARM because her rates keep changing which is impossible to keep up with if you’re on a fixed income.

    She was 63 when she purchased the home. At that age, she should of been striving to have the house paid off in 15 years or less. It's none of our business, but I'd love to know why she did a loan modification in the first place. Also, for her to be a businesswoman, why didn’t she get the "oral agreement" in writing?

    People are living longer. Ms. Jefferson is an example of longevity. However, she should've bought a smaller home at age 63. She didn't have little kids. Where are her children and grandchildren? They should be helping her.

    On earth, nothing is really ours. That's why you don't fall in love with houses, jewelry, cars, etc. There's only so much an attorney can do for you. She's going to have to leave it.     I remember during covid when I called my mortgage company just to ask a question, the customer service rep told me she was going to defer my payments..I was pissed off.. I stated" did I ask you for one?"... I have good credit.
    these mortgage companies prey on people who do not have a financial education...I Never refinanced or modified..my home is now paid off🎉🎉🎉🎉🎉

    NEVER sign up for an Adjustable Rate or a balloon payment mortgage. Somebody refinanced her house NOT explaining her low fixed payments were for a “term” then BECOME ADJUSTABLE after a certain term or you pay a certain amount at THE END OF THE TERM. It is legal unfortunately. I’ve used these mortgages as an investor because I PLANNED to sell houses after making equity. I wouldn’t do this if it’s your forever home. Sad they took advantage of her. These are complicated loans meant for Investors to “move money around”, I don’t know how they could sleep at night doing this to the elderly or anyone for that matter.

    Stop falling for these 'refinancing' 'restructuring' scams. When a corporation or even a person wants a piece of real estate they will do ANY and EVERY thing to get it. Where were her people when this scam was laid at her feet? Always find someone who is on your side that will help. And, make sure that the person/people you get to help you is NOT working with the scammers or is getting a cut.

    I hate this happened to her. A lawyer was supposed to be providing me with/ loan modification. He pocketed his fee did nothing. Foreclosure proceedings took place. He was crooked and i was a victim of sub prime lending anyway.
