I learned 20 years ago when I lost my home due to a shady bank officer ,to not trust any bank and make sure when you involve your home in any type of loans, that you have and understand any and all conditions of that loan in writing . As a senior citizen myself ,the only loans modifications that I made were refinancing my balance of my mortgage to a lower interest rate and I made damn sure to read and have the loan officer explain everything in the paper work before signing off . Anything else ,such as reverse mortgage or other BS complicated loans,I stay clear of ,because all that the bank or lender wants to do is take your home from you.

NEVER sign up for an Adjustable Rate or a balloon payment mortgage. Somebody refinanced her house NOT explaining her low fixed payments were for a “term” then BECOME ADJUSTABLE after a certain term or you pay a certain amount at THE END OF THE TERM. It is legal unfortunately. I’ve used these mortgages as an investor because I PLANNED to sell houses after making equity. I wouldn’t do this if it’s your forever home. Sad they took advantage of her. These are complicated loans meant for Investors to “move money around”, I don’t know how they could sleep at night doing this to the elderly or anyone for that matter.
Stop falling for these 'refinancing' 'restructuring' scams. When a corporation or even a person wants a piece of real estate they will do ANY and EVERY thing to get it. Where were her people when this scam was laid at her feet? Always find someone who is on your side that will help. And, make sure that the person/people you get to help you is NOT working with the scammers or is getting a cut.
I hate this happened to her. A lawyer was supposed to be providing me with/ loan modification. He pocketed his fee did nothing. Foreclosure proceedings took place. He was crooked and i was a victim of sub prime lending anyway.

Ain’t no way the bank approved a modification on a 73 year old woman past retirement age. Being able to financially afford the modification is the 1st thing that underwriters would consider. Who approved an ARM on someone post retirement age on a fixed income?????
That’s how it’s set up. Everyone doesn’t get to buy an affordable home in a safe neighborhood whenever they want to. It’s not always possible with housing shortages, unemployment, redlining, etc.

Thats a whole lot of house. She should have cashed out a long time ago. I'm sorry she's in foreclosure, she needed to plan her finances better. At an advanced age, high monthly bills add lots of stress.
you clearly don’t understand what’s going on. If she wanted she could have done a reverse mortgage. Clearly that option wasn’t presented to her. Not to mention she has 400k in equity in her home. That’s half of what the property is worth today. That tells me this woman paid this home off a while ago. She most likely bought that house in the 90’s at 400k. Whoever facilitated the modification participated in loan fraud. People act like companies don’t modify documents without the person knowing. She needs to sue the mortgage company and every NMLS licensee number on her documents as well as the Notary that stamped the documents who most likely was an employee of the mortgage company/bank. It is loan fraud to orally promise someone something that is not accurately represented in the contract.
It is up to the MLO to verify EVERYTHING. Why would you change a fixed rate mortgage to an ARM for someone who is on a fixed income? That’s a BIG red flag 🚩!

Reverse mortgage for what, so that her family can take over the home when she dies? Look at her now, she's in hot water but they can't help her. @ she modified the loan in 2012 at 73 years of age. It’s obvious she was post retirement age. Why would an underwriter approve an ARM for someone on a fixed income. This is a clear violation of the 2008 Dod Frank Act. It’s an underwriting requirement.
We know it’s an ARM because her rates keep changing which is impossible to keep up with if you’re on a fixed income.

She was 63 when she purchased the home. At that age, she should of been striving to have the house paid off in 15 years or less. It's none of our business, but I'd love to know why she did a loan modification in the first place. Also, for her to be a businesswoman, why didn’t she get the "oral agreement" in writing?
There is no oral agreement in real estate - everything is in writing. They try to tweak the story to make it more sappy

People are living longer. Ms. Jefferson is an example of longevity. However, she should've bought a smaller home at age 63. She didn't have little kids. Where are her children and grandchildren? They should be helping her.
I hope her kids and grandkids aren’t leeching off her. I have a widowed elderly aunt and she and her husband did the right things for financial security in retirement but now she’s practically the family bank for her kids/grandkids.

Loan Modifications are not safe at all, do your best not to do it. I know about 2 ppl one of which lost her home the same way and the other almost lost her home to the samething.

I remember during covid when I called my mortgage company just to ask a question, the customer service rep told me she was going to defer my payments..I was pissed off.. I stated" did I ask you for one?"... I have good credit.

NEVER sign up for an Adjustable Rate or a balloon payment mortgage. Somebody refinanced her house NOT explaining her low fixed payments were for a “term” then BECOME ADJUSTABLE after a certain term or you pay a certain amount at THE END OF THE TERM. It is legal unfortunately. I’ve used these mortgages as an investor because I PLANNED to sell houses after making equity. I wouldn’t do this if it’s your forever home. Sad they took advantage of her. These are complicated loans meant for Investors to “move money around”, I don’t know how they could sleep at night doing this to the elderly or anyone for that matter.
Stop falling for these 'refinancing' 'restructuring' scams. When a corporation or even a person wants a piece of real estate they will do ANY and EVERY thing to get it. Where were her people when this scam was laid at her feet? Always find someone who is on your side that will help. And, make sure that the person/people you get to help you is NOT working with the scammers or is getting a cut.

There was no loan modification, it has to be in writing. She started paying less and made up the story about a verbal agreement.
How can you verbally agree to the many terms of a modification?
I hate this happened to her. A lawyer was supposed to be providing me with/ loan modification. He pocketed his fee did nothing. Foreclosure proceedings took place. He was crooked and i was a victim of sub prime lending anyway.
