HOA dispute: Concrete barriers causing headaches for homeowners in Elko neighborhood

- Over the last two weeks, trips to and from home have gotten a little longer for Pat and pretty much everybody else in a specific Elko neighborhood. A handful of concrete barriers have been up across sections of two private streets near Boulder Pointe Golf Club since mid-April.

Private roads are maintained by the owner, I can fully see why the owner doesn't wany his private road being used a public road.

The hoa is saying the golf course is responsible for that private roads maintenance and that wasn’t the agreement when they allowed the construction of those houses. Been in the turf grass industry my whole life and had to deal with bs hoa stuff twice

99.9% The property owner doesn't want to be in the HOA and the HOA is demanding he join. But the HOA can't force him to join for some reason... and the HOA is being assinine in their demands, so the property owner is sticking it to the HOA.
Wait - if I’m understanding the overhead shot at 2:08 correctly, it looks like this is adding maybe 30 seconds to the commute time for about 10 houses? (It looks like the street closure is just to the left of the center of this picture. Note the rectangular asphalt pad that was in the video with the barriers.)
Yes, it’s an eyesore - but other than that, there’s really no issue here. If it’s his land, he can do what he wants with it. This is why you don’t buy a house in an HOA.

The part people are not understanding are the words PRIVATE ROAD. The property owner does not have to let anyone use the road.
Never ever buy a home in a HOA. I did and sold my home. Now I live in peace on an acre lot in a beautiful community.
When renting a tow truck to move these becomes necessary to get out of your own community.

For those curious, it seems that the issue was resolved based on Google maps. Street view shows June 2023 and no barriers up. Pinehurst Dr and Pinehurst Ct are the closest cross streets to where those barriers were in the video.
A household attempted to form an HOA in my neighborhood. For what reasons, I do not know. This is a peaceful and relatively uneventful neighborhood. Offended by the general consensus, they moved less than a year later.
I think alot of people who don't live in an HOA neighborhood would slam the door in thier face too. People live in HOA-free neighborhoods for a reason.....

If that was my private road that I owned, just to piss the HOA off, I would install a gate on my private road. If you want access its $5 every time it opens from the outside. Card only, no cash. Daily refunds to anyone who helps build, or finance said gate.

I worked in a quarry as a blaster. If I lived there those barriers would be in pieces.

Why doesn't this guy install a small toll booth, charge people 50 cents to pass. If they don't like it go around it. Is there any laws preventing him from setting up a toll booth on his property to allow people to use the private road?

Blocking access to a public road is a violation of local and federal laws
You can easily just walk around it or drive around the barrier. It's so easy look at the video. No problem

Then it will turn into a criminal case - trespass and destruction of property. This is hardly even an inconvenience, and it seems that it’s the owner of that private stretch of road who blocked it off.
A better solution - don’t buy a house in an HOA.

Hoa lol. Not sure why somebody would buy a property with such snotty neighbors. My house and my land is my land, if somebody ever forms an Hoa on my street and tells me what to do ill laugh at them. Im king of my land, the only person to argue with me and has a say is my wife. And if I would of bought a house in an Hoa I also would of laughed at whoever attempted to tell me my grass was to long or told me what color I can paint my house. Hoa or no Hoa my house and my land is my house and my land lmao. Ill take a shit in my front lawn if I want to and nobody is telling me otherwise!. And I could care less what my neighbors do as long as they don't step foot on my land without asking. People are just snotty busybodys these days.

Looking at that map, it looks like the owner of the private properties is using the HOA's roads to get to those properties. The HOA should put up their own barricades and cut those homes off completely from the road system. See how the developer like having properties with no public access. 🤣

You clearly read that map wrong. The property owner owns the land that the road runs through that leads to that side of the HOA neighborhood. The homeowner was working on a deal with the HOA to sell them the property for the road and was going to develop the land and build homes but because he did not want the home built to be a part of the HOA they refused to then purchase the land for the road. He then put up barricades as the land is still his and they should not be allowed to use it if they are not paying for it.
@@TheFlooringInspector82 Look at the map at 2:03. The red lines clearly show the property that he owns. If the HOA decides to block the roads at each of those three points, then the property inside the red lines becomes inaccessible to motor vehicles.
This is why I own trucks that can easily drag those barriers away

They built a road on private property is what sounds to have happened. The owner of the property might have allowed a temporary easement to the HOA to have them by the balls, to later ask for more money. There's a reason that they won't say crap about what the altercation between the owner of the land and the HOA is. Even Fox is fake news.

THey are using his private road and were supposed to pay a portion of the upkeep. Once the homes were built the HOA said you know what, we are not what are you going to do about it .

Best option for all those people Is to take the lose and move. Put the houses up in the market for half of the value and take the money
you build house away from any public road, you responsible to make the link to them either within your own land or public one with a request
