The vast majority of HOAs are formed by the developer/builder long before the first home is built. The prospective buyer has a choice: buy, and become a member of the HOA, or move on to a different neighborhood. There is nobody forcing someone to buy a house in an HOA. The legal system acknowledge that, absent conflicts with national, state, or local laws, an HOA is a private corporation operated (hopefully) according to the bylaws of the corporation. The process to change anything in an HOA after it is created is outlined in the bylaws. Many bylaws are written in ways to make changes as difficult at possible, like requiring an in-person vote and a majority of 2/3 of lot owners voting to change. Think about this: if there are 100 lots in the HOA, 67 would have to be present to vote on an arbitrary date/time, and in favor of the change. I just had my hearing last night with my HOA. I submitted my application to paint my house. The denied the first submission and approved the second. I painted my house and then claimed it’s not like the picture submitted online. The picture of the color sample was taken in my office on my desk. Of course a cell phone picture will not do justice or look exactly like the sample. The application requires paint name brand. Last night the BOD told me the based their decision off a picture because it is not the job of the ACC to go to Home Depot or even pull it up online because they are volunteers. You mean to tell me that they based a financial decision off of a picture. Where does it state in the law that the homeowner is responsible for cell phone camera & printer quality, lighting, resolution and pixelation?! I offered to repaint my house another color at their expense. They refused. I painted my home the color THEY APPROVED. Their next step is the HOA attorney. I am livid!!! The ACC clearly failed to do their due diligence. I need help…
I'm a contractor dealing with this with a client right now. This is my first time dealing with it, and we did the pictures with the old and new. I'm hoping whatever person in the HOA that deals with approving these knows that old colors fade, because we are literally using the exact same color. I'm losing time and money waiting for a response that we don't know how long will take. The whole thing is sooo stupid.
If they are getting a lawyer, then you need one too. You can either pay the lawyer's fees or Home Depo's paint prices. Might as well stick it to the HoA
Crazy that HOA's has been against fences around pools. Where I live that's mandatory, doesn't have to be directly beside it but you need something to protect wildlife and curious kids who haven't learned to swim properly yet. If they're afraid of property values dropping, do they know what droops house prices really quickly? A dead child floating in the pool.
Paying HOA dues is extortion plain and simple because it's under duress or threat such as tacking on interest or even foreclosure. Residents need to be allowed to opt out from any HOA, again it's extortion if they don't get that choice.
It's a voluntary contract. They literally signed on the dotted line and agreed to let the HOA be their F'n nanny. Sure thing HOA, keep my A in line, please. Control my every life decision, please. If you voluntarily agree to something, it's hardly extortion.

Just when I was going to close the deal a woman knocked on the door. I was then informed that she had papers for me to sign. They were HOA contracts. I told both of them to eff off & I told the realtor that the deal's off because she lied. I had strictly told her NO HOAS & she did not listen. Luckily, I had not given any money at the time. I also told her boss & I let anyone & everyone know about how she sold houses. She lost her job.

HOAs are voluntary. Nobody forces anyone to buy a house within an HOA. And nobody can be forced to join an HOA that is newly forming in their neighborhood. No accident. In California HOAs own the title if you move into their neighborhoods. Then they take it, sell it for more than it's real worth and pocket the money. Thet keeps the neighborhood prisoner. And you.
Why would anyone want a group of people to tell you when to bring in your garbage can, what color to paint your house, what time your porch light needs to come on and on top of that pay them?
Awright, here's the thing. I'm glad they're finding ways to crack down on these thuggish HOAs. BUT, what gets me is nobody forced these homeowners to sign up for an HOA or to buy an HOA property. Don't sign on the dotted line! Get your power and control fix elsewhere.
The only reason I can validate an HOA is if there is community property such as a pool, clubhouse, park or any other "common area" Someone has to pay to keep those areas maintained and it should be ALL the residents within that community. However the HOA should keep their business off private property and not tell you what do do with your home or landscape or what vehicle to drive or where to park it. Those codes need to be left to the city and that is their job.
In NSW Australia, there is a law that stipulates a “Model” set of Rules for what we call “Body Corporates” which are roughly equivalent to HOAs, of the Model, some can be amended and some can’t. Also, the HOA books have to be maintained in a set way AND audited annually by an external auditor.

Especially if the developer is still sitting on unsold lots/houses, no change will happen. The system is rigged, but it's rigged in full public view (prospective buyers are supposed to be provided with the CCRs and bylaws before they make an offer).
@@raygunsforronnie847The only real choice a prospective home buyer is offered is, either join a HOA or go homeless. The problem with your, vote with your feet, concept is the first part of your initial sentence: "THE VAST MAJORITY. The vast majority of new homes have forced membership HOAs because the developer/builders who control them can suck more money out of the person buying a home. . This means that they not only receive money for the sale of the house but they also get the HOA fees. THIS IS A SCAM. The phony coverup for the scam is; once the homes are paid for, control of the HOA reverts to the homeowners. Homes are purchased with 30 year mortgages; do the math.

Its sad that something that was meant to be good turned out to be just plain greed and power. Such is the nature of some people.
ITS ABOUT TIME! But it needs to be Nation wide! Not just in Texas.
It's about time. HOAs Have too much power.
Now that's abuse!@@motherfudger6664
You shouldn't have to ask anyone to paint your house. This is proof that hoas are horse crap. Hope it gets sorted for you
Did you get the approval in writing? That's all you need is the written consent. If all you did was get a verbal agreement, then you F'd up son!!
If they are getting a lawyer, then you need one too. You can either pay the lawyer's fees or Home Depo's paint prices. Might as well stick it to the HoA
Every state needs to make a law that anyone can leave a HOA at any time with no penalties.
Just pass a law that HOA membership is now optional and anyone in a HOA can leave with no penalty (while remaining in their same home of course).
Who pays for inwall plumbing painting and assessments.
Shouldn't even have hoa's
They charge too much. My son is looking for a condo but can't really afford one due to the high HOA fees.
It’s amazing that people spend so much money on homes, and have an HOA to dictate, what vampires
People should get back pay for all the dumb offenses that HOA got them for. Plain robbery.
@@marcuslinton310some cities require new housing developments to have an HOA. Most available housing is in an HOA-controlled neighborhood. In 2022, my wife and I bought the only house outside of a major city that wasn’t in an HOA because the original developer went belly up in 2016.
The house is 8 miles from a grocery store, the local government is hot trash, and I have serious misgivings about the quality of the school district. Dealing with all of that to avoid the tyranny of an HOA is unacceptable.
Your idea of “voluntarily” doesn’t match up with the reality for most people. If your only option to buy a home is to be extorted by a lawless non-governmental organization, or don’t own a home, that’s hardly a choice.
One of my major house hunting rules is NO HOAS. If the realtor I'm working with shows me a house I ask immediately if it's in an HOA. If the answer is yes, then that's a huge DEAL BREAKER. I will walk out without another word.
I had a realtor try to trick me into buying a house in an HOA neighborhood. I really liked the house, too.
With them laws in place looks like HOA is looking up i still wouldn't buy a home with HOA looking over my home.
FINALLY! Most HOA's are a scam! Thank you!!!
All are, not most...every single one.
HOA's have given karens a way to force people that would never tolerate them to be under their control. It prevents people from taking the bullys power away by not having anything to do with them since now you have no choice and must follow every little peeve they have.
Don't forget the Kevins! They can be equally if not worse just as bad.
There should be a guild line on what lawn is accpeptable . They should ban HOA from fining homeowners if their front lawn doesn't look like a golf course.
There was 1 HOA that due to someone who was living in a garage (which was against the rules) demanded that all garage doors MUST be left OPEN. this was of course to see if anyone was living in the garage but you can't leave a garage door open ALL DAY! got sued and overturned but now before making everyone miserable for a few months
It's unbelievable that anyone would buy a house in an HOA. So ridiculous!!!
HOA should be voluntary and non mandatory, these are houses not unit blocks so you shouldn’t be forced into a strata over land you own.
Wow! Good Job Abbott! Can’t believe I just said that! HOA’s was getting out of control.
They need to be outlawed all together
Screw all HOAs!
Abuse is the very definition of a HOA. I will live in a van down by the river before I would buy a home in a HOA.
I think it stupid to buy your home, to have some one tell you ,you can't or can
Just as bad as that, you have to pay monthly fees to HoA's ranging from $150-400/month
@@srobeck77 The monthly rates are much higher when the subdivision has unsold lots because the property developer cherry-picks the HOA agents. Quite often, the way the deeds are structured, until all lots are sold, the residents cannot secure control of HOA. And when they do, they generally don't have much choice except to continue with the same agents (but at a lower monthly rate). It is indeed a big mess that surprises most first time buyers.
@@MathaGoram all builders are going HOA because they are giving them cash bribes to sign on. So why wouldnt they? They need to make that practice illegal

That's why in the future, I'm not going to be a part of the HOA. People from HOA are nice yes but they make you pay way more money and if you don't get the money to them, they are going to be like karens that are going to be rude about it. You have to pay fees that are higher than $20 a month which costs about $100. I would not agree to HOA for many good reasons for this. The government of USA is trying to make HOA because they think it'll be better for the owners who own their homes and to make sure they are overly checking to see if there's bad stuff going on or this house is in good condition. Not in my future house it would! Never! No offense but people who support HOA are stupid enough to pay their money into HOA for checking appointments towards their home.
to me is incredible that in the land of the free you can't do whatever you want with your own property.
HOAs are voluntary. Nobody forces anyone to buy a house within an HOA. And nobody can be forced to join an HOA that is newly forming in their neighborhood. So, anyone complaining about living in an HOA can go F themselves because they voluntarily bought the house and signed on the dotted line giving the HOA all the powers listed in the contract. So, F em!
Not when you voluntarily sign up for HoA's. Some sheep love those associations.
@@srobeck77 Sheep, goats, chickens.. usually prohibited by either local ordinance or HOA rules... But nobody is forced to purchase a home in an HOA. Don't like them (and I don't)? Move on to properties not in HOAs.
Understand that HOAs exist under the premise that they preserve home values by preventing or correcting homeowner actions that lower property values. What they really mean by this is "keeping out people not like ourselves." Back in the day that mean non-white Europeans.
Some people apparently love living under authoritarian dictatorships.
Track the money. Sometimes the hoa board of directors accidentally take some money.
No accident. In California HOAs own the title if you move into their neighborhoods. Then they take it, sell it for more than it's real worth and pocket the money. Thet keeps the neighborhood prisoner. And you.
About time the USA roped these "Karens" in. None of this BS in Canada.

Why would anyone want a group of people to tell you when to bring in your garbage can, what color to paint your house, what time your porch light needs to come on and on top of that pay them?
When buying property I will walk away if it manage by HOA.
Problem with HOA is Gov not taking responsibility for new developments, but still assessing property tax
What are you even talking about here? Property taxes are for the roads, schools, fire, police, dept etc.
My former HOA president threatened me with “community shunning” when I questioned her expenditures.
Persecute HOA civil rights violations. Unlawful search and seizure: Meet lawful second amendment adherence.

Awright, here's the thing. I'm glad they're finding ways to crack down on these thuggish HOAs. BUT, what gets me is nobody forced these homeowners to sign up for an HOA or to buy an HOA property. And nobody forced the renters to rent there either. When owners sign up for HOA they think they're getting control over others, but when the HOA bites them in the butt they cry foul. Grow up, people! Don't sign on the dotted line! Get your power and control fix elsewhere.
Screw HOA's. Thank god they aren't really a thing in Massachusetts. Or New England in general.
They need to do this in Florida as well. HOAs have WAY too much power in this state.
Hoa Reform = HRLNG
In NSW Australia, there is a law that stipulates a “Model” set of Rules for what we call “Body Corporates” which are roughly equivalent to HOAs, of the Model, some can be amended and some can’t. Also, the HOA books have to be maintained in a set way AND audited annually by an external auditor.
What’s the point of having one it always looks good on paper the idea of it but like anytime some get to much power it never ends well
I have said often in redit HOA stories that if a HOA is brought to a court and lose then that HOA must at least hold elections or dissolve

No, all HOAs are bad. Why the hell should they be allowed to tell any homeowner what they can and can't do.
1:39 It's Texas, no one was complaining over Crosses. Why not use an example people would have been using HOA's to fight against.
No point to living in America, especially Texas, if you got the North Korean HOA telling you what you can and can't do.
How about just getting rid of them all together. I mean isn’t that why we city ordinances?
You can put up a Cross now, but would they protect someone who decides to put up a Pentagram?
Homeowners association formed because bossy no good peoples that like to push others around!! Peoples can do whatever they want with their house!!
Strong wind had taken down the part of the retaining walls and fences behind a few homes. The HOA stated that the home owners were responsible for the repairs. Keep in mind the lots behind our homes had not been sold. Turns out the retaining walls and fences were now on our property.

What needs to be done by the State is to declare H. O. A.'s as quasi-government entities which must comply with the State's Constitution as well as all local Laws. Any changes in the by-laws must be approved by the members and the County Commissioner.
How is a criminal investigation initiated on an hoa?(no hoa records available)
I felt sorry for people that live under HOA. Sounds worse then living in public housing. Those people stayed positive, did everything right went to college became successful, retired and thought they would spend the rest of their lives in peace, enjoying the company of their grand kids. But no they get harrassed and prayed on by a crocked corporation for the rest of their lives. They give them fines for any and everything just to make extra money off them and they really hope you don't pay the fines so that they can take your house from you and sell it to one of their members for a few dollars like they did this one Lady. Id rather live in a trailer park. $500 fine because the paint on your barn don't match your house.
