Actually a lein on a home and it’s forced sale is the proper way to go once payment has been missed. Same goes for people who do work on home. Remodel a kitchen and they refuse to pay. Put a lien on the home and then they. A pay or the home gets sold. The sale money goes to the party owed money and any remaining balance gets returned to the home owner, assuming they straight up own the house, if not bank gets its money first. This means if you only lived in that home for say 5-8 years you could lose everything by not paying your bills. That’s because you mostly pay interest first before the principal in a mortgage, so you’d have little principal payed off.
You cant easily loose a home, its generally made of solid materials. Unless you bulldoze it, maybe, and grind down the rubble. It would be loose but Im not sure it would make a difference with your HoA. Pay the dues and follow the rules you agreed to, its the easier choice than loosing your home.

The one I am at, I just got in trouble for parking my car backwards into my spot. It apparently has to be parked with the nose of the car toward the building. Ridiculous!
lol I was told that it's so the car exhaust doesn't hurt vegetation. However I think it's bc many states do not have a Front plate /tag and if you back in they can't see the plate. How knows. So ridiculous
It’s because you have to have a registered vehicle and they want to see the tag with the non expired sticker - not that I agree that it’s any of their business
Down with home owners associations! If you buy your plot of land you should not be required to pay a third party program to tell you what you can and can't do with the land that was bought. What a huge waste of money and it let's the little guy get huge amounts of power and time time again have shown that the small guy gets power corrupt. Almost 50% of Floridians live in a home owners association. We need to reverse that.
I lived in Miami and had no hurricane since 1992 Andrew. Every year, insurance. and property taxes are going up. Coming down is a pipedream. I had Hoa before it was a mishandling the funding. Never again.
@@wotan5665 Yes, labor prices went up especially for labor and the Trades. Needless to say that the cost of materials and transportation is over the top.
I think this is for people who nitpick other people's house. You have a red begonia in your front yard it should be yellow. That's a 100 fine. Our lawyer says it should be 2000. You don't have 2000. We will sell your $200000 condo for $10 to this nice guy who happens to be the board president best friend.
I hope this will be looked at by other states to implement laws to help HOA homeowners. There are some HOA's that have abused their power and hurt people financially and harassed home owners.
We rented a house and ended up leaving 3 months later because my husband had an additional work vehicle that didnt fit in our driveway and we had to park it on the street. We received so many nit picks and fines that we had to leave.
Homeowners can do away with their HOA's and vote to disband them. The rules to do so are different by each HOA, but worth exploring. We did away with ours by just a simple 51% vote of members present at the annual meeting. Our neighborhood improved tremendously from it, along with the $$ savings to each homeowner !
Is there any useful law at all? Ridiculous details, parking, holiday decoration. It would be good to see some real changes that benefit homeowners. This is as good as nothing.
My HOA is looking for a way out of this. They saying because the Declaration does not include the " Kaufman language" the state rules does not apply to us. That is scary. Probably 3/4 of Florida HOA has the same kind of declaration. If that is true, we are screwed. That would be a sucker punch to the home owners, and it will put a huge smile on the board members face - an other victory for them. I am expecting a lot of resistance from Florida HOAs.
These are not rules, they are laws. As someone stated earlier, your HOA must follow the law. Rules can be broken and there may be a fine, but laws are enforced with fines and jail time if needed. That’s the difference. Remind the HOA they are not above the LAWS.
I will never understand the need to pay a bunch of people just so they can literally dictate how you live! It makes no sense. They can even come inside of your home in many of them and dictate what kind of furnishings you have. Who in their right mind would want to pay for this garbage, particularly with the fees they charge. When I buy a car I shouldnt have any need whatsoever to contact an HOA to make sure the make, model, year and color is approved by them first. The very concept of crap like that is insane from the start and I cant comprehend why anyone who ISNT a Karen or a Kevin wanting to live in one. Thats not to say that everyone that lives in these insane asylums is a Karen or Kevin, but its crazy that anyone that isnt would want to live in such an environment.
Well, Condo HOAs (aka COAs) are a bit of a different story. I have lived in both HOA/COA, and the vast majority of COA fee increases (at least in Fla) are driven by ongoing and expensive maintenance fees on aging elevators and insurance costs and ongoing replacing of landscaping due to Hurricanes. While I hate the increases as much as anyone, the increasing costs in older (15+ year) multi story Condo buildings have all been cost justified when I did a deep dive into the numbers. Maybe my condo is different since they believe in and provide full transparency when it comes to costs/expenses.
I have lived in an HOA member community of single family homes for decades and have zero complaints. The board of fellow neighbor homeowners is responsible for enforcement of the “bylaws.” I moved into the neighborhood while it was still under development and was given copies of the pending HOA guidelines. We vote on the board members regularly. I can’t imagine how you can manage things like common property, without some governing entity.
The rules to not be able to install a physical fence should be banned. I am ok with a special version (4-5 foot, metal…). But I have the right to keep my pets safe and other animals out.
My sister had to ask permission for me to visit and park my truck in her driveway! I would NEVER allow people to rule my life that way! If I were the auto industry I'd protest along with my customers!
Now pass a law that says HOAs have to puicly post what every dime is spent on for the neighborhood. The one by me collects $1,080,000 a year that apparently is needed for a 300 yard median strip and a swimming pool that's closed more than it's open. 😂
Those ridiculous HOA laws charging owners for everything should be prohibited . I already pay $750 monthly fee ( last year was $450.00) for one bedroom condo of only 800 SF. Recently I needed to replace my sofa and I was told I have to “ reserve “ the elevator giving the HOA $500 deposit, pay a non refundable fee of $ 100 fee for using the elevator when taking out the old sofa . Of course same when bringing in the new sofa. I understand and agree to give the HOA a $500.00 refundable deposit when moving in or out but if no damage is done to the elevator or to the walls or other condo facilities this deposit should be refunded. Owners should not pay anything else to use the elevator since all expenses were included when they assessed the monthly fee. Pretty soon we will have to pay to use the pool, gym, Parking and other amenities that were included when the condo was purchased from the developer. I already complained about this issue and was told that nobody will be able to change it because in was in the condo bylaws. Therefore it WAS THE LAW. I hope the government put a stop to those HOA and let owners to amend and revise those bylaws.
Anyone moving into a community with an HOA is giving a copy of the governing documents before closing on a property. At closing they sign those documents and a copy is given t the HOA. Most people don’t actually read the documents. This is the problem.
Remember, these prospective HOA purchasers do state they have read the HOA rules and regulations BEFORE they purchased the home. They actually sign a document on their application submission. So, it's not correct they did not know the rules.
i personally will never buy a home in HOA. i dont think they realize how many buyers they lose. some HOA fees so high that your money you make was spent in HOA fees. take your monthly HOA and inverst it and you find out just how mich of a rip off they are!
When you bought the house you agreed to enter into this agreement that you will "function" as a closed society within certain rules. So yes, you can have ownership of a house/apartment and be under regulations. Some for example with city ordinances, when you want to open a new window, or remodel your house, you need to comply with regulations, otherwise you are not allowed too, despite owning the propriety.
Some HOAs are ridiculous but when buying into a community that has an HOA, you are given the documents before closing. Read them and make a decision for yourself.
I would not live in a HOA because they believe they can tell you what you can and can't do to the property that they bought and pay for. HOAs should be outlawed
It's really important for prospective buyers of Florida homes to examine the HOA regulations before they buy. If the regulations are overly strict, look elsewhere. If HOA regs start affecting house values they will change.
When I worked in Real Estate my Buyers had the right to inspect HOA & Condo Regulations written into their offer & Contract. I can't tell you how many didn't even bother reading them since most were more worried about the Monthly fee instead.
@@elainekoop4651 The Board is customarily elected by the HOA members, and new regulations are customarily voted on by the members. Ya gotta attend the meetings and vote!
I would never buy in an HOA. We spent 300,000 for our home in 2011 and no way would i allow anyone to tell us what we can and cannot do with our property.
I totally agree with you. It can be too strict, but the streets are so narrow in these communities. If people start barking in the streets, I’m always concerned about EMS getting through and creating a hazard for residence potentially dangerous situation.
How about ALL your neighbors having ALL their families visiting at the same time all with 5 cars, all on your cul-de-sac of 5 homes, all staying for a month. Yes, that's ridiculous, but possible. Parking is one reason for limitations. Also, facilities are built for a certain number of residents and the residents pay to maintain the facilities. If too many people want to use the facilities, the costs go up for everyone. If there's a pool with a limit for users (limits are set by the county health department), residents who pay for it can't use the pool if there are too many visitors in it. That's not all, but it's a start for why there are limits. Pools, clubhouses where you can hold family gatherings, sometimes golf clubs, etc., are all things built and maintained by residents and some of the reasons that HOA's are popular. Our HOA also prohibits short term renters and Air B&B type renters. Everyone who lives here has undergone a background investigation so we're also short on criminal activity.
@jjbud3124 public pools have the same limits for capacity, so the logic in that is the same. I have 10 acres, my own well, fire pit, no one is going to give two shits about how loud the DJ (husband) plays, or anyone taking a leak in the woods, or who is parked in my 330' circular driveway. HOA can eat rocks.
@@marywiggins7411 HOA residents' have PRIVATE pools but our taxes still pay for the public schools. How many people live in the woods? You're just acknowledging you don't give a damn about anyone else, and you have enough space and money to do as you please. Congratulations. You are privileged.

Never buy a home in an HOA especially in Florida
HOAs should be banned
Exactly 💯💯💯💯
The one I am at, I just got in trouble for parking my car backwards into my spot. It apparently has to be parked with the nose of the car toward the building. Ridiculous!
lol I was told that it's so the car exhaust doesn't hurt vegetation. However I think it's bc many states do not have a Front plate /tag and if you back in they can't see the plate. How knows. So ridiculous
It’s because you have to have a registered vehicle and they want to see the tag with the non expired sticker - not that I agree that it’s any of their business
@@mruggier0 yes, that is because they cannot see the license plate, not because of the vegetation.
HOAs play a small role in maintaining order, but the wrong representatives is the downfall, especially in the recent decade
Get rid of the HOA… period. We’re tired of paying someone to tell us what to do with property we OWN!
1:09 How about a law to lower insurance bills and property taxes.
God I’ll NEVER live in an HOA again. Love my freedom 🇺🇸
This is a win for the ppl of Florida next hopefully we can lower property insurance and rates and rents
and where is the governor on that?!
@BizznessBox sadly I believe you are correct
@@ponygirl1624the governor protects the corporations and investment groups currently, unfortunately.
Along with your property value 😢
I lived in Miami and had no hurricane since 1992 Andrew. Every year, insurance. and property taxes are going up. Coming down is a pipedream. I had Hoa before it was a mishandling the funding. Never again.
Require them TO LOWER FEES
Disban your HOA that's how you lower the fees. They will never go down.
I wouldn't. Its kind of like going to the casino and gambling and losing your house. Who told you to go, it's not the casino's fault
Great idea, but the cost of everything is going up: garbage pickup, lawncare, and especially insurance. You can't have something for nothing.
@@wotan5665
Yes, labor prices went up especially for labor and the Trades. Needless to say that the cost of materials and transportation is over the top.
Why an HOA is able to tell you to do anything is just wrong.
No more fines for garbage, No more fines for Holiday decorations, No more fines in regards to types of vehicle that you park...These are GOOD CHANGES!
How about when a lawn care company breaks a window and the HOA doesn’t want to pay for it? What do you do?
sue
@@bonchidude Creating more backlog in our courts. Unfortunately that's a result. It's a darn shame to have to sue, but in this case, necessary!
They need to stop HOA’s from raising fees every 6 months.
I believe all HOA should be abolished. My home is paid for and I’m afraid of losing it to the HOA for stupid reasons.
In other words, actually READ your HOA AGREEMENT. I have, and never found an HOA agreement I would sign, therefore I don't own a home an HOA.
We rented a house and ended up leaving 3 months later because my husband had an additional work vehicle that didnt fit in our driveway and we had to park it on the street. We received so many nit picks and fines that we had to leave.
HOAs allow rentals? Seems that would be a major thing to rule out.
@@virginiamoss7045 usually a certain percentage of a neighborhood can be rentals.
This is great! I'm lucky not to have bought a home in an HOA in Florida, but I've heard complaints from friends who have and they're terrible.
Is there any useful law at all? Ridiculous details, parking, holiday decoration. It would be good to see some real changes that benefit homeowners. This is as good as nothing.
Thank you for presenting this information in a clear manner.
Never buy in an HOA
My HOA is looking for a way out of this. They saying because the Declaration does not include the " Kaufman language" the state rules does not apply to us.
That is scary. Probably 3/4 of Florida HOA has the same kind of declaration. If that is true, we are screwed. That would be a sucker punch to the home owners, and it will put a huge smile on the board members face - an other victory for them. I am expecting a lot of resistance from Florida HOAs.
Exactly! And they thinned the hell out of the original changes they wanted to make. HOAs will continue to go rogue. Smh
… but state laws will always supersede little locality laws.
Anyine on a HOA board is going to hell so who realy wins in the ends
If your HOA doesn't want to follow the law, sue them. They are a LLC just like any other business. Years ago someone sued McDonald's and got millions.
These are not rules, they are laws. As someone stated earlier, your HOA must follow the law. Rules can be broken and there may be a fine, but laws are enforced with fines and jail time if needed. That’s the difference. Remind the HOA they are not above the LAWS.
Quit allowing an HOA to file a lien on a home.
Our HOA is criminal
why is my condo HOA Fee more than my mortgage 😫
Moron
That’s not enough!
They should only be able to enforce the upkeep of the exterior of the home, that’s it!
Exactly 💯💯💯💯
I have lived in an HOA member community of single family homes for decades and have zero complaints. The board of fellow neighbor homeowners is responsible for enforcement of the “bylaws.” I moved into the neighborhood while it was still under development and was given copies of the pending HOA guidelines. We vote on the board members regularly. I can’t imagine how you can manage things like common property, without some governing entity.
I've had two homes in HOA's . NEVER AGAIN!
The rules to not be able to install a physical fence should be banned. I am ok with a special version (4-5 foot, metal…). But I have the right to keep my pets safe and other animals out.
imagine if the HOA says "no pet walks in the neighborhood" 🤣
HOA's should not be allowed to foreclose on a home
Pretty soon they gonna say when or not to sell ur house...
Most garages are too low for pick up trucks to go in. How stupid to not allow you to park in your own driveway.
An HOA should never be allowed to foreclose on someone’s property
Preferred vendors sounds like a preferred kickback
Rule 1 for dealing with an HOA
Do not buy a home where you must be a member of an HOA, period, no exception.
I already pay $750 monthly fee ( last year was $450.00) for one bedroom condo of only 800
SF.
Totally agree.
Remember, these prospective HOA purchasers do state they have read the HOA rules and regulations BEFORE they purchased the home. They actually sign a document on their application submission. So, it's not correct they did not know the rules.
Who monitors the fine money after it is collected? What is that $ used for? How long do these people hold that status as an HOA rep?
Dont know why someone would want another form of government on their home. HOA's are another form of government.
If the HOA tells me what I can do, what vendor I can use, what vehicle I can own...am I the actual owner of the property?
How did we go from dumping tea in the river to this…..
i personally will never buy a home in HOA. i dont think they realize how many buyers they lose. some HOA fees so high that your money you make was spent in HOA fees. take your monthly HOA and inverst it and you find out just how mich of a rip off they are!
People love them.
People don't love them. They love their homes and alot of nice homes are in HOAs.
People should know what they are buying into.
Never would i buy with HOA.
Homeowner 🤔 ?
I own it, but you tell me what to do 🤣
This law is to get rid of the Nazi HOA’s.
@@Flavor88 true, but you must admit the HOA's can create new petty rules at will after such original agreement !
@weareallamericans7358 yes they can, and that is because you agreed that they can do that.
@@Flavor88 so you're saying that you've signed your property rights away in perpetuity ?
Lowering homeowner standards for people who didn’t bother to read HOA rules before purchase.
Some HOAs are ridiculous but when buying into a community that has an HOA, you are given the documents before closing. Read them and make a decision for yourself.
I would not live in a HOA because they believe they can tell you what you can and can't do to the property that they bought and pay for. HOAs should be outlawed
People who are on the HOA board are the same type of people who had no friends in high school.
I would not take a free home in the state of Florida governed by an HOA.
I wish Missouri would take notice of what Florida is doing and take the same action.
HOA canot bother you about things in yur back yard!!! Gardens, clothes lines, boats, rvs... all things that are no longer an issue
I absolutely hate HOA even though I live in one. I think 90+% of their rules are ridiculous!!!!
When do these laws take effect?
It's really important for prospective buyers of Florida homes to examine the HOA regulations before they buy. If the regulations are overly strict, look elsewhere. If HOA regs start affecting house values they will change.
When I worked in Real Estate my Buyers had the right to inspect HOA & Condo Regulations written into their offer & Contract. I can't tell you how many didn't even bother reading them since most were more worried about the Monthly fee instead.
But the HOA. Board can make new laws!! Or add regulations!!

I'm tired of the HOA scam. It's government overreach.
I totally agree with you. It can be too strict, but the streets are so narrow in these communities. If people start barking in the streets, I’m always concerned about EMS getting through and creating a hazard for residence potentially dangerous situation.
Thanks, Governor DeSantis, for another win for the people of Florida
What are the other 100+ laws?
It’s about time!!🎉
How do we get this in Georgia!
Why does anyone buy a property just to have your neighbors act like landlords?
Cause there’s a lot of trashy people in the world and you can just have one person come in your neighborhood and ruin it for everybody.
It’s amazing how conveniently states across America have all these new laws, yet not 1 of them put real effort into the homeless or veterans
I know, right! So many real, pressing issues that are still not resolved or mitigated.
Some of them have limits on guests being able to stay for more than a week, or your grandkids visiting.
Ridiculous business.
