    When a state like Wyoming with a population of only 600,000 gets as much Senate voting power as California with 40 million the power in the US senate is so skewed against a moderate or progressive agenda that it is nearly impossible to move forward on any of these issues. Even without the filibuster 45 % of the population elects 65% of the senate. That 45% is in predominantly red states. The President is not a dictator and we need a legislative body that reflects the majority to put things right. All the proposals being put forward by Mystel are only good as long as the 2 years left in the Biden administration. We need real long term solutions.

      Wyoming has 1 representative, California has 53. According to the Constitution each state is supposed to get 1 rep for every 30K people, so I think we are really on the short end of that stick you are waving around. How do you propose that there be an equal division between red/blue states in congress when it is up to the people which political party they will support?

    I have to agree with this young lady about those fundraising emails... Cause I've been flooded with those emails as well.. and this could have been resolved decades ago.. I'm not sending not a thin dime to the none of them..

      The codification would have been overturned by the SC, just as any future codification of anything else, including abortion, will be. The only solution is to expand the court or remove christo fascist perjurious SCs.

      @@dHolbach77 And as a foreigner witnessing this from abroad, I’d have to conclude: good luck with that, in your divided country where minority rules and where 70% of Republican voters still support trump and agree with the idea that he was cheated out of office, and where incidentally (Republican) senators and politicians refuse to honor their subpoenas, especially those who tried to overthrow the government with their criminal dear leader.
      And I don’t even mention the filibuster and gerrymandering tactics to remain in power, since even worse is to come in election processes. The coup is still in progress…
      Good luck indeed. Scary, even for a foreigner like me, living across the pond.

    Ethics Reforms for the Supreme Court, an act of congress, yes, Okay. That would be a step in the right direction. Preventing the American Republican Fascists and the American, theocratic, “Cristo-Fascists” from eliminating our Bill of Rights is imperative.

    For Democracy, EVERY YEAR IS AN ON YEAR. Democracy requires Active Participation. Serving in school boards to keep education viable and awareness of civic responsibilities, all levels of city, county, state positions, federal offices…. Even as volunteers for libraries, crosswalk guards at schools, ….. many hands make light the work, find an itch that sings your heart! Thank You 😊

    This is what happens when Congress doesn't draft & pass any laws that establish protection of these rights we lose. We rely too much on judicial interpretation of the law, believing court precedent is somehow permanent & unchangeable but the whole history of the Supreme Court paints a different picture.

      We foolishly think they won't just grab the rug out from under our feet suddenly. It's plain that they enjoy exercising their power and we've got to make a path forward a way to grab that overwhelming power back from them. These are not people who really value democracy or most importantly, separation of Church and State. I can look at the Founding Father's with a more jaded eye than I have in the past, knowing Jefferson kept a slave mistress in the basement and the Father's didn't intend freedom for anyone other than white men, but for me they were redeemed by that one ideal they clung to adamantly: separation of church and state. I think it was a rare idea among nations, derived from their experiences of nations drenched in blood from religious strife and our history of welcoming religious refugees like Pilgrim's and Quakers. They were openly suspicious of Christianity as state religion and made eye-opening statements totally opposite from today's evangelist believers like: "America is in no sense a Christian country' (John Adams, Treaty of Tripoli).       That’s because most of the establishment democrats are perfectly fine taking money from the same groups as republicans to do nothing as well and they have no issue basically fundraising or galvanizing people to vote for them because the conservatives are just completely demonic. But democrats will continue to sit around with their thumb up their bums saying we just need more money, more representation in congress so just keep voting for us. There’s prolly less then a handful of actual representatives in congress who actually put their constituents needs over their own political aims or enriching themselves. They had the opportunity before all of this and the scotus to actually codify roe, but they didn’t do it, they have the oppurtunity to carve out or end the fillibuster, a fillibuster republicans don’t require to actually achieve their aims and is basically just an obstruction tool for them to have permanent veto powers, and they could have taken this election the people gave them which was said was the most important election in a long time and done something with it, put more justices in the court, passed significant legislation but they’ve done nothing while hiding behind sinema and manchin and just saying yeah nothing we can do here sorry.

    SC justices serving for life was supposed to be a check on power by keeping them out of the election process.
    The problem is that when the Constitution was first written in the late 1700’s, life expectancy was in the 40’s and 50’s. Today it’s decades longer.

      The perception of dithering inaction, a politicised Supreme Court, and a seemingly hopeless inability by Democrats to produce effective messaging is why it is very likely that they will lose in the coming midterm elections. Even stuff like the DOJ taking so long to move is seen as bumbling and ineffective even though it likely isn't.
      Strong leadership evokes a primal response. Democrats are once again, hopelessly ineffective at countering Republican talking points that portray Biden as weak, global inflation and global high fuel costs as his fault and so on. The very least they could do is utilise the executive power mandated to them by the electorate. Appointing an articulate effective spokes person to relate their achievements, programme and entrenched obstruction from the right could be useful. They are not by any means a perfect administration, but they are better than the alternative looming on the horizon. Voter apathy on the left in this country is a MAJOR issue too. I am a 70 year old EX Republican ( Post Reagan ) now independent. I will likely strategically vote Democrat in the near term simply to counter the fascist extremism of the right. I am not convinced we will collectively achieve that aim.

      Those confirmation hearing statements cannot be held against the justices because they weren’t made through the judicial process. Those vague statements off the top of their heads during the confirmation hearings are not legally binding and shouldn’t be held against them

    When/if Roe is codified, it should include a sentence saying: "This legislation is not subject to judicial review." Think that's unconstitutional? Chief Justice Roberts has said otherwise (not talking about this issue, mind you, but he's said it.)

      It is the Supreme Court that has given itself the right to review legislation in Marbury v. Madison, 5 U.S. 137 (1803), just as it has tried to manufacture a doctrine of Original Intent. Neither of these exist in the constitution nor do they exist in common law or the common practices of the day. It should be noted that in other constitutional democracies (such as Canada) their Supreme Court does NOT have a right to constitutional review of legislation.

    Yes Elie, but in order to have done anything in the past 19 months to codify Roe, it has to go through Congress to become law of the land. With obstructionist Senators, in a 50/50 + 1(the VP) divided Senate, that was never going to happen, not with the filibuster in place. It would have taken at least 10 Republicans and all 50 Dems voting to keep Roe in place. So Biden is right, the only way to fix this is VOTE, VOTE, VOTE blue in 2022, only vote once though.

      This is exactly what I heard today on NPR. There was a I don't know his name but he's a New York reporter covering for the last 14 years the supreme Court and he made this point that they know that nothing can get done in Congress. The obstruction in our government is breaking down the checks and balances that were supposed to be intact to prevent this sort of thing.

    Laws should be made by politicians, not by judges. Their job is to interpret those laws. Row v Wade should never have been determined by the Supreme Court, whose members are not elected by the people. In fact it was never the law at all.

    I love how everyone criticizes the Dems like it's a team in a football game. It's like blaming the government when you don't participate in any way to change it. If noone votes, if you don't like that Dems aren't as conniving as GOP or have a major MAINSTREAM propaganda outlet like FOX, then start your own party.       I'll be voting Dem, in the name of harm reduction. This is in hopes of at least slowing our headlong plunge off the cliff into Fascism.
      However. Our government institutions have been moving along the road to corruption for a looooong time. All three branches of government are now on the brink of complete dissolution. Is it We The People's fault? Yes. And no.
      Americans are among the most indoctrinated, self-censoring people on Earth. Our Ruling Class has spent a whole nation's worth of energy, time and wealth to program us and keep us bamboozled. They've been quite successful.
      What did Biden promise his sponsors? That there would be NO fundamental change. That's what he ran on, that's what we got. Biden is very much a conservative. Meanwhile, change is happening all around us, but the Dem Party Establishment has zero intention of even acknowledging it, much less responding to it.
      In case you haven't been paying attention, The Dem Establishment has been working very hard, in partnership with Repubs BTW, for decades to reduce and privatize the social safety net (the which would lead to its dissolution), bring the Federal Government under corporate and bankster control, squash any progressive legislation while eliminating the FDR wing of the Party, slowly but surely undermining government regulation of corporate greed, rapine, predation on The People and the planet. Did any of this agenda originate with We The People? No. It did not.
      Meanwhile, as horrific as the Repubs are, Dem Leadership (aka Centrists) still hollers for "Bipartisanship", with our Dem POTUS calling that vicious, conniving leader of the opposition, his honorable friend. Ain't bipartisanship wunnerful?

      A legal abortion in one State can't suddenly change jurisdiction and be illegal. California can't prosecute out of state crimes, no jurisdiction on Federal or Indian land because not part of State. But can States make unconstitutional laws and jail you if you disobey? check the Bruin decision
