We have robust open dialogues amongst ourselves here. Out of curiosity, do you or more so, your wife, not believe some cognitive behavioural therepy would apply here? This is one type of behavioural issue that would most commonly be recommended for CB therepy here in the UK by a patients general physician.

Not accurate, from what I can recall the process would be that it's found to be defamation and she has to pay, then if she repeats the defamation you can file and the judge will order her to pay up again. It's tricky to say what is or isn't part of a religious practice. Take candles for instance. While there is no religion that worships candles they are used in many different regions. Religions don't have to be the unusual recognized ones to be considered someone religious belief. And she might be able to prove that she has practiced using cards as her religious practice long before this case started. It depends on a judges take.

So the reasoning path she seems to be taking runs like this: A summary judgment ruling means there are no questions on which there are factual dispute. To reach the conclusion that there is no material dispute on the question of whether Gillard's statements are defamatory, Scofield must prove that the statements are false (this is her key incorrect logical step). Meanwhile, in determining that Scofield has met her burden and Gillard hasn't, the court repeatedly states that Gillard has no evidence other than her "spiritual intuition". Dismissing information gleaned through her spiritual practices is a form of religious oppression because it holds her readings as "lesser" and assumes that they are false. Ergo, the case can't be ended at the summary judgment phase because the court can't just throw out her tarot readings.

Take candles for instance. While there is no religion that worships candles they are used in many different regions.

The so called "psychic" is clearly crazy, but I want to point out that a Plaintiff needs *actual damages* before getting to punitive. I'm not saying there aren't any damages, but they're probably not really that substantial, in actuality. The fact is that everybody knows the "psychic" is crazy, and her opinion has no merit, therefore, no one is taking it seriously. Did the Plaintiff lose their job? What money did the Plaintiff lose based on the Defendant's ridiculous claims? Ergo, limited actual damages. So, we're down to tallying up whatever platform income came from those videos, specifically, and of course, legal fees are always on the table, as well.

Yeah!! Quick Bits It's easy, her religious freedom does not trump the rights of the person she is slandering. She can have her opinion but it is illegal to force your beliefs on another. The Professors Lawyer needs to do better. Use the Psychic's own logic back at her. Her Tarot cards need to be certified. If they cannot be certified then her readings can not be verified as accurate in any way. She needs to be tested in her field to be able to claim she is in fact using the Tarot cards correctly. A Priest has to verify they are a priest and Rabbi has to verify same, a Lawyer has to prove they are licensed to practise law. Where is her certification to make these serious claims?
