      There's a damn good chance that this IS actually the "psychic" herself 🤷‍♀️
      You know, IF I were Ashley, I would be studying Emily's content covering me and my case! She has to know by now that Emily is covering this and she could seriously be getting VERY useful information for her to use in her case. I think that would be a very cleaver move to make because Emily is brilliant when it comes to cases, and law, and well, as we all know, Ashley clearly isn't.

      IMO, and my wife's expert opinion (she's a therapist) therapy rarely works for people with a personality disorder. Note: I am not really dx'ing her. More of a comment on the effectiveness of mental healthcare.

      In this particular Law Nerd community it's what we do, speculate about what 'may be happening' with some people's minds/mental state. We have robust open dialogues amongst ourselves here.
      Out of curiosity, do you or more so, your wife, not believe some cognitive behavioural therepy would apply here? This is one type of behavioural issue that would most commonly be recommended for CB therepy here in the UK by a patients general physician.

    Once a judge finds statements are defamation per se, there should be an automatic injunction blocking the person uttering them from repeating them, including a monetary penalty if they do it anyway.

      The adults here are discussing that the Professor who was falsely accused of murder, continuously defamed via social media by a narcissist influencer wannabe is facing excessive legal expenses for just trying to get the woman to stop. A case that has run excessively long because the "psychic" is representing herself, therefore has an idiot for a client, has consistently failed to comply with the court but been given benefit of doubt and/or further chances….. and many of us would like to help with the accruing legal costs of the Professor if we can.

      Not accurate, from what I can recall the process would be that it's found to be defamation and she has to pay, then if she repeats the defamation you can file and the judge will order her to pay up again. But since Ashley has no money anyways it's kind of pointless, you'd have better luck getting a pay out from Mc Donalds than you would from a dud like her.

    I have felt (no cards were needed) from the beginning that the TikTok person will never stop. This is her life and her obsession. QUESTIONS: (1)How can this process be accelerated? (2) Could (proven) diminished capacity of this Tik Tok person assist in ending this loop? (3) When the Professor's case is finally successful with an injunction granted, would this turn any future comments about this Professor into a criminal offense? (4) If so would breaking an injunction be enough for immediate incarceration and hopefully therapy? BTW SO appreciative that we are not using names, as that probably would be feeding this obsession.

    I'm a pagan Tarot is not religious, Tarot cards were developed in Italy early 15th century for playing games, there is no evidence of any significant use of tarot cards for divination until the late 18th century and even then it's not connected to any pagan religion directly.

      As for Wicca while heavily influenced by earlier forms of Western esoteric-ism, it was actually created in England by Gerard Gardner from around 1930s to 1950s. Wicca isn't even 100 years old yet so no not as old as Christianity, not even close.

      It's tricky to say what is or isn't part of a religious practice.
      Take candles for instance. While there is no religion that worships candles they are used in many different regions.
      Religions don't have to be the unusual recognized ones to be considered someone religious belief.
      And she might be able to prove that she has practiced using cards as her religious practice long before this case started.
      It depends on a judges take.

    Was the card reading entered into evidence? I’d be super curious about which cards told the psychic that the professor murdered the students. 😂 I’m serious. The plaintiff could bring an another tarot card reader as an expert witness to show that the TikTok psychic had no basis for her libel.

    Perhaps Tarot Card Guillard is giving Suitcase Sara Boone some proper competition as to who can hold off their inevitable trial the longest with nonsensical motions or by plain old, heels dug in stubbornness. 🤷‍♀️
    As it stands at the moment, Sara Boone has 1,623 days and counting......😱
    I think Ashley is just stubborn enough to try and actually pull this one off if given half the chance. But then, being your own council is something that will alone drag out a trial. It's all too often a very foolish decision.

    So the reasoning path she seems to be taking runs like this:
    A summary judgment ruling means there are no questions on which there are factual dispute.
    To reach the conclusion that there is no material dispute on the question of whether Gillard's statements are defamatory, Scofield must prove that the statements are false (this is her key incorrect logical step).
    Meanwhile, in determining that Scofield has met her burden and Gillard hasn't, the court repeatedly states that Gillard has no evidence other than her "spiritual intuition".
    Dismissing information gleaned through her spiritual practices is a form of religious oppression because it holds her readings as "lesser" and assumes that they are false.

    Thanks so much for your insight on this. This is just an example of trying to decide when it is worth taking legal action and unfortunately I think if the professon tried to just end the suit ithis 'Psychic' would just use that as 'proof' she was right. Such a sad and frustrating situation.

    The so called "psychic" is clearly crazy, but I want to point out that a Plaintiff needs *actual damages* before getting to punitive. I'm not saying there aren't any damages, but they're probably not really that substantial, in actuality. The fact is that everybody knows the "psychic" is crazy, and her opinion has no merit, therefore, no one is taking it seriously. Did the Plaintiff lose their job? What money did the Plaintiff lose based on the Defendant's ridiculous claims? Ergo, limited actual damages. So, we're down to tallying up whatever platform income came from those videos, specifically, and of course, legal fees are always on the table, as well.

    Yeah!! Quick Bits It's easy, her religious freedom does not trump the rights of the person she is slandering. She can have her opinion but it is illegal to force your beliefs on another. The Professors Lawyer needs to do better. Use the Psychic's own logic back at her. Her Tarot cards need to be certified. If they cannot be certified then her readings can not be verified as accurate in any way. She needs to be tested in her field to be able to claim she is in fact using the Tarot cards correctly. A Priest has to verify they are a priest and Rabbi has to verify same, a Lawyer has to prove they are licensed to practise law. Where is her certification to make these serious claims?

    Some part of me wonders, and I mean this in the best way possible, if the Professor has darker motivations. Not sinister! I mean, like, "You dragged my name through the mud. How does that mud taste now? How does it feel?" I couldn't blame her if that mixture of emotions bubbled inside her unconscious. The Psychic is outrageous with a capital 'O'; the Professor is in the right, morally and legally. I only suggest there's room for pettiness with someone who chose you as her nemesis at random.
