If I can give you anything from this video it is that I want you to know how much control you have as a buyer and seller.
Always was and always knew is two different animals. Stating the obvious but these options being transparent and openly discussed by agents is a new thing. The form makes it difficult or at least more difficult not to have those conversations. “Transparency” is the goal because first timers are generally not aware 👍👍
A form is only usefull if it is explained by the agent. So many times they are signed without any clear intent.
Great presentation. There are a lot of discrepancies being stated by agents on these youtube videos. I wonder what happens if a potential buyer does not disclose that he has already signed one, two, or three buyer agreements to cover overlapping time periods. Who determines which agent can rightfully claim the commission?
Great question. The buyer broker agreement has been in place for years and has held up in many cases as you are pointing out. It also boils down to many other facts as well including procuring cause. Who showed the home that was purchased. If there were multiple buyer broker agreements the buyer signed they put themselves at risk.
It may not last long..Some Michigan Agents have filed a class action against NAR. The Realrors should win as its easy to show that NAR is a monopoly concerning Multiple Listing Service. Plus NAR is such a poor organization, They need to be shut down. BYE BYE, And they should get a huge class action settlement!

i may be the 1st victim of the changes in AZ. My listing expired 7/31. renewed it. i checked on audras site and she said to do an addendum. I was about to do that and i got an offer the next day. I asked my agent who is paying for the buyers fee. My agent told me I signed and he wont pay it he didnt ask. Buyer is paying $120k cash mortgaging 60k. so i paid $5500 to recoat my roof (hoa renegged) and $4500 commission so $10k i could use. so APPARENTLY it isnt part of the negotiation process. i had NOT signed the papers at that point. feeling ripped off

Rick, #51 is still sketchy to me. Though you stated that the listing agent has their fiduciary to the seller; however will "assist" the buyer......Isn't that what a dual agent does?
There are two agreements. Dual Agency which requires the agent to fully represent they buyer and has a fiduciary duty to do so with both buyer and seller. Or an agreement as an unrepresented buyer where the agent does not have a fiduciary duty to represent but rather to just process their end of the transaction.
